The \u200bjudge&#8217;s decision to move the trial date was influenced by the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/proud-boys-j6-case-upended-by-hidden-fbi-messages-judge-calls-much-ado-about-nothing\/\" title=\"Proud Boys J6 Case Upended By Hidden FBI Messages Judge Calls \u2018Much Ado About Nothing\u2019\">defense team&#8217;<\/a>s need for more preparation\u200c time.\u2062 The\u2064 trial is now set to run from\u2063 October \u200d15 to November 15, with pretrial evidence hearings \u200dscheduled in May.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>The trial of Richard Allen, who is accused of killing two Delphi, Indiana, teenagers back in 2017, has been pushed back to October.<\/p>\n<p>Jury selection was scheduled to begin next week, but on Tuesday, Special Judge Fran Gull accepted a defense attorney\u2019s request to waive Allen\u2019s right to a speedy trial, WTHR <a href=\"https:\/\/www.wthr.com\/article\/news\/crime\/delphi-girls-murdered\/delphi-murders-hearing-tuesday-length-trial-terms-names-banned-jury-selection-richard-allen-libby-german-abby-williams-indiana\/531-065c4277-6461-461d-830a-963d01a043fb\" target=\"_blank\" rel=\"noopener\">reported<\/a>. Allen\u2019s defense attorneys had asked for 15 days to present the case and said if Gull wouldn\u2019t allow that in May, the trial could be moved to a later date.<\/p>\n<p>\u201cIf you can\u2019t try this case in one month, there\u2019s something wrong,\u201d Gull told Allen\u2019s attorneys at the hearing, according to WTHR.<\/p>\n<p>\u201cYou don\u2019t know anything about this case,\u201d Allen\u2019s attorney, Brad Rozzi, responded.<\/p>\n<p>The exchange highlighted a contentious relationship between the judge and Allen\u2019s defense attorneys. Gull had previously forced Rozzi and Allen\u2019s other attorney, Andrew Baldwin, to withdraw from the case by threatening to embarrass them in open court. The attorneys took the case to the Indiana Supreme Court and <a href=\"https:\/\/www.dailywire.com\/news\/new-charges-filed-against-delphi-murder-suspect-original-attorneys-reinstated\" target=\"_blank\" rel=\"noopener\">were reinstated<\/a>, but their request to remove Gull as judge was denied.<\/p>\n<p>At the hearing on Tuesday, Baldwin also introduced a motion again requesting that Gull be removed from the case.<\/p>\n<p>Rozzi argued that it was not practical for the trial to start so soon, with issues like whether the jury will hear Allen\u2019s jailhouse confessions \u2013 which the defense contends came under duress \u2013 still pending. He suggested that no end date be set for the trial.<\/p>\n<p>\u201cWe\u2019re not saying we\u2019re not ready \u2013 we\u2019re just saying we don\u2019t want you to bookend this,\u201d Rozzi said multiple times during the hearing.<\/p>\n<p>The new trial will run from October 15 to November 15, Fox 59 <a href=\"https:\/\/fox59.com\/indiana-news\/richard-allens-trial-in-delphi-murders-case-pushed-back-to-october-defense-withdraws-request-for-speedy-trial\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>, and three days of pretrial evidence hearings will take place between May 21 and May 23.<\/p>\n<p>The hearing came just a week after Gull declined to hold Baldwin and Rozzi in contempt but called them \u201c<a href=\"https:\/\/www.dailywire.com\/news\/delphi-judge-declines-to-hold-defense-attorneys-in-contempt-but-calls-them-incompetent\" target=\"_blank\" rel=\"noopener\">incompetent<\/a>.\u201d Carroll County Prosecutor Nicholas McLeland had accused defense attorneys Andrew Baldwin and Bradley Rozzi of contempt of court due to an evidence leak and allegations they violated a gag order, Fox 59 <a href=\"https:\/\/fox59.com\/news\/indycrime\/judge-finds-delphi-defense-team-sloppy-and-incompetent-but-not-in-contempt\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1715184052205000&#038;usg=AOvVaw30mpznqHO0I3crFOdodkQW\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p>Gull said in her ruling that McLeland \u201cproved by a preponderance of the evidence that defense counsel was sloppy, negligent and incompetent in their handling of discovery material.\u201d However, she added that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/delphi-judge-declines-to-hold-defense-attorneys-in-contempt-but-calls-them-incompetent\/\" title=\"Delphi Judge Criticizes Defense Attorneys as 'Incompetent\">prosecutor failed<\/a> to prove \u201cbeyond a reasonable doubt\u201d that the attorneys were \u201cwillful and intentional\u201d in their actions.<\/p>\n<p>Gull also agreed with the defense attorneys that they didn\u2019t violate the gag order because it was put in place after they made the remarks McLeland claimed violated it.<\/p>\n<p>Allen was charged in October 2022 with two counts of murder while committing or attempting to commit the kidnapping of 13-year-old Abby Williams and 14-year-old Libby German on a hiking trail in 2017.
