Trump&#8217;s attorney challenged the relevance of \u200cthe claims, expressing \u200dconcerns \u2064about prejudicing the jury. The judge found Daniels challenging to manage and criticized the defense for not objecting more. The court \u2064proceedings drew controversy for their sensational and\u2062 irrelevant nature.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/news\/\">  News <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/russdavis\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/russdavis\/%20\"><span>Jack Davis<\/span><\/a> <\/span> <span>   May 8, 2024 at 6:32am <\/span> <\/span>  <\/header>\n<section>\n<p>The judge in former President Donald Trump\u2019s hush money trial rejected a mistrial Tuesday after porn star Stormy Daniels offered an explicit version of a sexual encounter with Trump that he has said never happened.<\/p>\n<p>Trump attorney Todd Blanche said Daniels\u2019 claim that there was an \u201cimbalance of power\u201d at the time of the alleged encounter could unfairly \u201cinflame the jury,\u201d according to the <a href=\"https:\/\/nypost.com\/2024\/05\/06\/us-news\/trumps-hush-money-nyc-trial-live-updates-testimony-photos-more\/\" target=\"_blank\" rel=\"noopener\">New York Post<\/a>.<\/p>\n<p>\u201cIt\u2019s extremely prejudicial to insert safety concerns in a trial about business records,\u201d he said.<\/p>\n<p>\u201cThe issue is she has testified today about consent, about danger \u2014 that\u2019s not the point of this case. That\u2019s not the point of her testimony,\u201d he said. \u201cHow can you unring that bell?\u201d<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">\u201cThe material that came in was not relevant to this criminal case at all. And I think it shows that she was trying to \u2018get Trump.\u2019 I actually thought there was a motive there.\u201d<\/p>\n<p>\u2014Former Federal judge to CNN on Stormy Daniels\u2019 testimony in the NY Trump Trial <a href=\"https:\/\/t.co\/SLC46mNpja\">pic.twitter.com\/SLC46mNpja<\/a><\/p>\n<p>\u2014 ALX \ud83c\uddfa\ud83c\uddf8 (@alx) <a href=\"https:\/\/twitter.com\/alx\/status\/1788010389181026545?\">May 8, 2024<\/a><\/p>\n<\/blockquote>\n<p>  Judge <a href=\"https:\/\/www.westernjournal.com\/watch-trump-sidesteps-judges-gag-order-reads-cnns-news-report-trial\/\" target=\"_blank\" rel=\"noopener\">Juan Merchan<\/a> rejected a bid for a mistrial but commented \u201cthat there are some things that would have been better <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/confirmed-the-number-of-indefinitely-confined-wisconsin-voters-who-can-vote-without-ids-increased-from-60000-in-2016-to-over-200000-in-2020\/\" title=\"Confirmed: The Number of 'Indefinitely Confined' Wisconsin Voters Who Can Vote without IDs Increased from 60,000 in 2016 to Over 200,000 in 2020\">left unsaid<\/a>.\u201d<\/p>\n<p>He then threw a prop to the prosecution, noting, \u201cI believe that the witness was very difficult to control.\u201d<\/p>\n<p>And he also blamed <a href=\"https:\/\/www.westernjournal.com\/prosecutor-paid-democratic-national-committee-political-consulting-taking-trump-trial-report\/\" target=\"_blank\" rel=\"noopener\">the defense<\/a>, saying, \u201cI was surprised there were not more objections to this testimony.\u201d<\/p>\n<div id=\"firefly-poll-container\">\n<p>Do you think Trump is innocent?<\/p>\n<\/p><\/div>\n<p>During her testimony, Merchan advised prosecutors, \u201cThe degree of detail that we\u2019re going into here is just unnecessary.\u201d<\/p>\n<p>At one point, he told Daniels, \u201cPlease keep the answers short, just listen to the question, and answer the question.\u201d<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">Perspective: Sitting front row attempting to figure out how any of this garbage from 20 years ago relates to \u201clegal\u201d bills submitted by a long time personal attorney being booked as a \u201clegal\u201d expense \u2014 but I digress. To be clear, they don\u2019t give a s**t about the merits of this\u2026<\/p>\n<p>\u2014 Eric Trump (@EricTrump) <a href=\"https:\/\/twitter.com\/EricTrump\/status\/1787870712876671379?\">May 7, 2024<\/a><\/p>\n<\/blockquote>\n<p>In an Op-Ed for the <a href=\"https:\/\/nypost.com\/2024\/05\/07\/opinion\/judge-allows-stormy-daniels-to-give-irrelevant-salacious-testimony-just-to-humiliate-trump\/\" target=\"_blank\" rel=\"noopener\">New York Post<\/a>, legal scholar Jonathan Turley said Merchan was quite happy to allow Daniels to humiliate Trump.<\/p>\n<p>\u201cHe allowed the prosecutors to get into the details of the affair despite the immateriality of the evidence to any criminal theory,\u201d he wrote, adding, \u201cIt is also uncontested that Trump wanted to pay to get the story (and other stories, including untrue allegations) from being published.\u201d<\/p>\n<p>\u201cThe value of the testimony was entirely sensational and gratuitous, yet Merchan was fine with humiliating Trump. Daniels\u2019 testimony was a dumpster fire in the courtroom,\u201d he wrote.<\/p>\n<p>He wrote that <a href=\"https:\/\/www.westernjournal.com\/watch-stormy-daniels-calls-trump-supporters-suicide-bombers-appearance-view\/\" target=\"_blank\" rel=\"noopener\">Daniels<\/a> was \u201cin her element in Merchan\u2019s courtroom.\u201d<\/p>\n<p>\u201cIn New York, the relevance or credibility of witnesses like Daniels is largely immaterial,\u201d he explained.<\/p>\n<p>Turley wrote that it was \u201ca bit late for the court to express shock over her testimony.
