This bill aims to\u200d exclude noncitizens from House and\u200d Electoral \u2064College representation. Advocates argue that\u200c only American citizens should influence\u2064 federal\u2063 representation,\u2062 but debates suggest partisan outcomes favoring <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cnn-skips-fact-checking-to-run-with-nurses-unverified-story-about-covid-patients-last-dying-words\/\" title=\"CNN Skips Fact-Checking To Run With Nurse's Unverified Story About COVID Patients 'Last Dying Words'\">blue states<\/a>.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The battle over the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/immigration\/\" target=\"_blank\" rel=\"noopener\" title=\"illegal immigration\">illegal immigration<\/a>-related Equal Representation Act, a <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/gop\/\" target=\"_blank\" rel=\"noopener\" title=\"illegal immigration\">GOP-backed<\/a> bill, has big implications for the future of the country.<\/p>\n<p>The <a href=\"https:\/\/www.congress.gov\/118\/bills\/hr7109\/BILLS-118hr7109rh.pdf\" target=\"_blank\" rel=\"noopener\" title=\"bill\">bill<\/a> considered in the House this week would add a citizenship question to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/census-undercounted-illinois-population-in-2020\/\" title=\"Illinois population in 2020 was undercounted in census\">future census counts<\/a> while preventing noncitizens from being counted in House of Representatives and Electoral College apportionment.<\/p>\n<p>While not immediate, the impact of the bill could be enormous, as it could swing control of the House or even the outcome of a U.S. presidential election following the 2030 census.<\/p>\n<p>\u201cIncentivizing illegal immigration and exploiting our democracy to skew the number of congressional seats or electoral votes for the presidency is immoral and a sure path to the downfall of our nation,\u201d Rep. Chuck Edwards (R-NC) <a href=\"https:\/\/edwards.house.gov\/media\/press-releases\/edwards-davidson-introduce-bill-stop-illegal-immigrants-skewing-congressional\" target=\"_blank\" rel=\"noopener\" title=\"said\">said<\/a> when he dropped the bill, known as H.R. 7109, in late January. \u201cOnly American citizens can vote, and only American citizens should be counted when determining federal representation.\u201d<\/p>\n<p>Edwards and co-sponsor Warren Davidson (R-OH) argue that apportioning representation to illegal immigrants rewards \u201cthe <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/biden-administration\/\" target=\"_blank\" rel=\"noopener\" title=\"Biden administration\">Biden administration<\/a>\u2018s open border policies\u201d and creates an incentive to bring more noncitizens into the country.<\/p>\n<p>But the 14th Amendment reads that the House will \u201cbe apportioned among the several States according to their respective numbers, counting the whole number of persons in each state,\u201d making no mention of legal or voting status.<\/p>\n<p>President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noopener\" title=\"Joe Biden\">Joe Biden<\/a> highlighted that fact in a statement of opposition to the bill.<\/p>\n<p>\u201cThe Biden-Harris Administration is committed to ensuring that the census remains as accurate as possible and free from political interference, and to upholding the longstanding principle of equal representation enshrined in our Constitution, census statutes, and historical tradition,\u201d it read.<\/p>\n<p>Political fights over the act indicate that it would help blue states and cities more than red ones, and the data appear to bear that out.<\/p>\n<p>While there is no way to accurately measure how many illegal immigrants are living in each state, a 2020 <a href=\"https:\/\/cis.org\/Report\/Impact-Legal-and-Illegal-Immigration-Apportionment-Seats-US-House-Representatives-2020\" target=\"_blank\" rel=\"noopener\" title=\"estimate\">estimate<\/a> from the Center for Immigration Studies found that apportioning representatives based only on U.S. citizens would have a net positive effect for the GOP. <\/p>\n<p>Of the 26 seats that would be gained in a citizen-only census, 24 are from states that backed former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noopener\" title=\"Donald Trump\">Donald Trump<\/a> in 2016, while of the states that gain seats if illegal immigrants are included, 19 are from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/democrats-are-already-throwing-in-the-towel-on-multiple-2022-targets\/\" title=\"Democrats Are Already Throwing In The Towel On Multiple 2022 Targets\">solidly blue states<\/a>.<\/p>\n<p>Gains would be mixed overall, as among the 10 states <a href=\"https:\/\/www.dhs.gov\/sites\/default\/files\/publications\/immigration-statistics\/Pop_Estimate\/UnauthImmigrant\/unauthorized_immigrant_population_estimates_2015_-_2018.pdf\" target=\"_blank\" rel=\"noopener\" title=\"estimated\">estimated<\/a> to have the highest unauthorized population, four (Texas, Florida, Georgia, and North Carolina) lean red.<\/p>\n<p>The data at the House district level are more direct.<\/p>\n<p>Per a 2020 CIS <a href=\"https:\/\/cis.org\/Camarota\/Impact-NonCitizens-Political-Representation-House-Representatives\" target=\"_blank\" rel=\"noopener\" title=\"analysis\">analysis<\/a>, of the 29 House districts where at least 1-in-5 adults is not a U.S. citizen, only one is represented by a Republican. Of the 108 districts in which less than 3% of adults are not citizens, 87 are represented by a Republican.<\/p>\n<p>As a result, redistricting that reflected only citizens would likely lead to a net gain in Republican-leaning House districts. <\/p>\n<p>But another important factor for the bill\u2019s advocates is that it would remove an incentive for sanctuary jurisdiction to attract undocumented migrants in the first place, according to CIS fellow and former immigration Judge Art Arthur.<\/p>\n<p>\u201cThe perverse incentive [current census policy] creates is probably one of the biggest issues,\u201d he said. \u201cI can safely state that sanctuary policies themselves create a magnet for illegal immigration.\u201d<\/p>\n<p>As with most immigration-related battles, this one is not new. <\/p>\n<p>The Trump administration attempted to add a citizenship question to the 2020 census only to have that effort <a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/supreme-court-tosses-citizenship-question-2020-census-forms-victory-democratic-n1014651\" target=\"_blank\" rel=\"noopener\" title=\"tossed\">tossed<\/a> out by the Supreme Court.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>Democratic-led states had argued the question would discourage immigrants from completing the census and thus make the count less accurate.<\/p>\n<p>Trump was upset about the decision, <a href=\"https:\/\/twitter.com\/realDonaldTrump\/status\/1144298734311878657?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1144298734311878657%7Ctwgr%5E7d77c718d7baf797e0ccc4f08b9019e550ad2a67%7Ctwcon%5Es1_&#038;ref_url=https%3A%2F%2Fwww.nbcnews.com%2Fpolitics%2Fsupreme-court%2Fsupreme-court-tosses-citizenship-question-2020-census-forms-victory-democratic-n1014651\" target=\"_blank\" rel=\"noopener\" title=\"posting\">posting<\/a> on X, \u201cCan anyone really believe that as a great Country, we are not able to ask whether or not someone is a Citizen.
