Critics raise concerns \u200dabout the measure violating parental \u200crights and \u200bpushing the &#8220;transgender&#8221; agenda in educational institutions.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/commentary\/\">  Commentary <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/igcolonel\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/igcolonel\/%20\"><span>Warner Todd Huston<\/span><\/a> <\/span> <span>   May 7, 2024 at 2:28pm <\/span> <\/span>  <\/header>\n<section>\n<p>A state judge in New York has shot down a pro-abortion ballot measure just ahead of the November election, dealing a blow to Democrats who hoped to use the initiative as a top campaign issue this fall.<\/p>\n<p>A judge in Livingston County ruled on Tuesday that Democratic legislators did not follow the constitutionally required steps to place the measure on the ballot, according to the <a href=\"https:\/\/nypost.com\/2024\/05\/07\/us-news\/judge-nixes-controversial-abortion-rights-ballot-measure\/\" target=\"_blank\" rel=\"noopener\">New York Post<\/a>.<\/p>\n<p>State Supreme Court Justice Daniel Doyle found that they approved the measure before obtaining a legal opinion from state Attorney General <a href=\"https:\/\/www.westernjournal.com\/pro-life-groups-hit-back-new-york-ag-letitia-james-court-allege-unfair-witch-hunt\/\" target=\"_blank\" rel=\"noopener\">Letitia James\u2019<\/a> office, the <a href=\"https:\/\/www.democratandchronicle.com\/story\/news\/2024\/05\/07\/ny-equal-rights-amendment-must-be-cut-from-the-ballot-mistake\/73598969007\/\" target=\"_blank\" rel=\"noopener\">Rochester Democrat and Chronicle<\/a> reported.<\/p>\n<p>New York already has some of the strongest protections for abortion and abortionists in the country, yet Democrats in the Empire State have been trying to make abortion a central issue in this year\u2019s election with absurd claims that it is endangered in a deep-blue state that is fully controlled by Democrats.<\/p>\n<p>The <a href=\"https:\/\/www.westernjournal.com\/ny-governors-offer-safe-harbor-floridians-seeking-abortions-gets-turned\/\" target=\"_blank\" rel=\"noopener\">Democratic Party<\/a> hopes to use the initiative to boost voter turnout.<\/p>\n<p>\u201cOur decades-long fight to protect equality and reproductive freedom will not be thrown off track by one extremist judge and I look forward to casting my ballot for the Equal Rights Amendment in November,\u201d Gov. Kathy Hochul said in a statement.<\/p>\n<p>Critics of the ballot measure said the language is an attack on parental rights because it would make it illegal to deny a minor\u2019s request for an abortion \u2014 or other \u201chealth\u201d services, such as \u201ctransgender\u201d procedures.<\/p>\n<p>The measure would ask New York voters if they support adding language to the state constitution saying that people cannot be denied rights based on their \u201cethnicity, national origin, age, and disability\u201d or \u201csex, including sexual orientation, gender identity, gender expression, pregnancy, pregnancy outcomes, and reproductive healthcare and autonomy.\u201d<\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/exclusive-ny-bookstore-stands-new-abortion-law-closes-store-mourn-thousands-babies-will-die\/\" target=\"_blank\" rel=\"noopener\">Detractors<\/a> said that not only would parents be prohibited from having a say in abortions for their children, but the measure also would force schools to adopt the \u201ctransgender\u201d agenda.<\/p>\n<p>\u201cSchools would be required to permit biological males to compete on girls\u2019 sports teams if voters approve this amendment,\u201d the Coalition to Protect Kids said in a statement last month, according to the <a href=\"https:\/\/nypost.com\/2024\/04\/03\/us-news\/ny-proposed-era-curbs-parents-rights-over-kids-transgender-surgery-opponents\/\" target=\"_blank\" rel=\"noopener\">Post<\/a>.<\/p>\n<p>Critics blasted the measure as \u201cthe Parent Replacement Act,\u201d with the Coalition to Protect Kids saying it \u201copens the floodgates\u201d for government interference in families.<\/p>\n<p>\u201cThis ballot initiative is written so broadly and so poorly that it could cause irreparable harm to children and families,\u201d said Greg Garvey, New York executive director of the coalition.<\/p>\n<p>Opponents \u2014 including Republican Assemblywoman Marjorie Byrnes of Livingston County \u2014 went to court to prevent the measure from being placed on the ballot.<\/p>\n<p>Byrnes told the Post she was pleased with the judge\u2019s decision to block the measure.<\/p>\n<p>\u201cWhile the state is controlled by one party, our constitution and our laws must be honored. I am pleased with Justice Doyle\u2019s decision which upholds the plain meaning and integrity of the constitution of our state,\u201d she said.<\/p>\n<p>A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/changes-in-public-legal-perception-ahead-of-derek-chauvin-trial\/\" title=\"Changes in public, legal perception ahead of Derek Chauvin trial\">recent poll found<\/a> that a supermajority of American voters <a href=\"https:\/\/www.westernjournal.com\/poll-supermajority-american-voters-oppose-abortion-past-12-weeks\/\" target=\"_blank\" rel=\"noopener\">oppose<\/a> abortions after the third month of pregnancy, but the New York ballot measure would go against that sentiment by approving unrestricted abortion.<\/p>\n<p><a href=\"https:\/\/ag.ny.gov\/publications\/abortion-legal-and-protected-new-york-state\" target=\"_blank\" rel=\"noopener\">New York state law<\/a> currently guarantees a right to abortion up to 24 weeks \u2014 or six months \u2014 and also <a href=\"https:\/\/www.westernjournal.com\/new-york-abortion-law-allows-people-get-away-murder-unborn-children-lawsuit-says\/\" target=\"_blank\" rel=\"noopener\">protects abortion<\/a> until birth if the fetus is unviable or if the mother\u2019s life is endangered by the pregnancy.<\/p>\n<p>Shockingly, the law includes \u201cmental health\u201d as a reason for abortion up until birth.<\/p>\n<p>Naturally, Democrats plan to appeal the judge\u2019s ruling, so this measure might yet end up on the ballot.<\/p>\n<p>But it all just goes to show how Democrats use abortion as a political wedge even when the \u201cright\u201d they claim to be worried about isn\u2019t in danger in the least bit.<\/p>\n<hr>\n<div>\n<p><b><i>An Important Message from Our Staff:<\/i><\/b><\/p>\n<p><i><span>We who work here at The Western Journal have fought for years against Big Tech and the elites who want to shut us down and then shut America down. <\/span><\/i><\/p>\n<p><i><span>Make no mistake \u2014 nothing will be the same after November 2024.
