The Liberty Justice Center\u200c is supporting him in this\u200d legal battle, emphasizing the \u2063importance of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/project-veritas-strips-cnn-naked\/\" title=\"Project Veritas Strips CNN Naked\">free speech<\/a> in educational settings. McGhee&#8217;s family and legal representatives are actively challenging the school&#8217;s decision, advocating for justice and fairness.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/news\/\">  News <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/johnathanjones\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/johnathanjones\/%20\"><span>Johnathan Jones<\/span><\/a> <\/span> <span>   May 7, 2024 at 11:42am <\/span> <\/span>  <\/header>\n<section>\n<p>A North Carolina teenager who was suspended from class for three days last month for using the term \u201cillegal aliens\u201d is suing his school district for violating his First and Fourteenth Amendment rights.<\/p>\n<p>Christian McGhee, 16, is a sophomore at Central Davidson High School in Lexington, <a href=\"https:\/\/www.westernjournal.com\/huge-win-election-integrity-north-carolina-republicans-override-democratic-governors-veto\/\" target=\"_blank\" rel=\"noopener\">North Carolina<\/a>.<\/p>\n<p><a href=\"https:\/\/libertyjusticecenter.org\/about\/\" target=\"_blank\" rel=\"noopener\">The Liberty Justice Center<\/a>, a non-profit litigation firm with a commitment to constitutional freedom, announced Tuesday it is suing McGhee\u2019s school district for sending him home.<\/p>\n<p>The group said in a <a href=\"https:\/\/libertyjusticecenter.org\/pressrelease\/fighting-for-free-speech-the-liberty-justice-center-sues-north-carolina-school-board-for-wrongly-suspending-student-for-question-about-aliens-who-need-green-cards\/\" target=\"_blank\" rel=\"noopener\">news release<\/a> that on April 9, the teen was involved in <a href=\"https:\/\/www.westernjournal.com\/state-law-prohibiting-sexual-discussion-schools-blocked-biden-appointed-judge\/\" target=\"_blank\" rel=\"noopener\">a classroom discussion<\/a> when his teacher used the word \u201calien.\u201d<\/p>\n<p>The teen asked the teacher to clarify if she was referring to \u201cspace aliens, or illegal aliens who need green cards?\u201d<\/p>\n<p>The Liberty Justice Center said the question caused no disruption in class, but <a href=\"https:\/\/www.westernjournal.com\/usc-senior-devastated-learn-graduation-canceled-cowardly-school-administrators-failed-twice-4-years\/\" target=\"_blank\" rel=\"noopener\">administrators<\/a> made a decision to suspend McGhee for three days for a \u201cvicious racial slur.\u201d<\/p>\n<p>On Tuesday, the group announced it was suing the Davidson County Board of Education on behalf of the teen.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">BREAKING \ud83d\udea8\ud83d\udea8\ud83d\udea8 We have filed a lawsuit against a North Carolina school board on behalf of Christian McGhee, a 16-year-old student whose question about the word \u201caliens\u201d in class led to a harsh suspension &#038; false accusations of racism by his own school.<\/p>\n<p>We proudly stand beside\u2026 <a href=\"https:\/\/t.co\/GvCB5H0wlm\">pic.twitter.com\/GvCB5H0wlm<\/a><\/p>\n<p>\u2014 Liberty Justice Center (@LJCenter) <a href=\"https:\/\/twitter.com\/LJCenter\/status\/1787864147490660665?\">May 7, 2024<\/a><\/p>\n<\/blockquote>\n<div id=\"firefly-poll-container\">\n<p>Will Christian win his lawsuit?<\/p>\n<\/p><\/div>\n<p>\u201cHaving been branded as a racist by his school, Christian\u2019s return [to class] was met with ostracism, bullying, and threats. Concerned for his safety, his parents unenrolled him, and he is now completing the semester through a homeschooling program,\u201d the Liberty Justice Center said in its release announcing the lawsuit.<\/p>\n<p>Buck Dougherty, an attorney with the firm, said that by suspending McGhee, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-asked-to-review-top-virginia-high-schools-race-based-admissions-policy\/\" title=\"Supreme Court urged to assess Virginia high school's race-based admissions policy.\">school board violated<\/a> his rights to <a href=\"https:\/\/www.westernjournal.com\/democratic-governor-criminalizes-free-speech-law-establishing-soviet-style-snitch-hotline\/\" target=\"_blank\" rel=\"noopener\">free speech<\/a> and due process.<\/p>\n<p>McGhee was not allowed to appeal the suspension.<\/p>\n<p>\u201cEven though Christian asked a factual, non-threatening question \u2014 about a word the class was discussing \u2014 the school board branded him with false accusations of racism,\u201d Dougherty said.<\/p>\n<p>He concluded, \u201cThe school has not only violated his constitutional right to free speech, but also his right to due process and his right to access education, a guaranteed right under North Carolina law. The school accused him of racism and\u2026 <a href=\"https:\/\/t.co\/45K4PkOgRp\">pic.twitter.com\/45K4PkOgRp<\/a><\/p>\n<p>\u2014 Suhr Majesty \u2122 (@ULTRA_MAJESTY) <a href=\"https:\/\/twitter.com\/ULTRA_MAJESTY\/status\/1787896012754850109?\">May 7, 2024<\/a><\/p>\n<\/blockquote>\n<p>Another <a href=\"https:\/\/www.westernjournal.com\/mexican-authorities-target-arizona-rancher-accused-shooting-illegal-immigrant-attorney\/\" target=\"_blank\" rel=\"noopener\">attorney<\/a> with the litigation firm said the lawsuit is about ensuring school districts understand that their rights to free speech apply when they are in class.<\/p>\n<p>Dean McGee with the Liberty Justice Center said, \u201cSchool officials have effectively fabricated a racial incident out of thin air and branded our client as a racist without even giving him an opportunity to appeal.\u201d<\/p>\n<p>Leah McGhee, the mother of the teen, also defended her son in the statement released by the group.<\/p>\n<p>\u201cI have raised our son to reject racism in all its forms, but it is the school, not Christian, that injected race into this incident,\u201d Leah McGhee said. \u201cIt appears that this administration would rather destroy its own reputation and the reputation of my son rather than admit they made a mistake.\u201d<\/p>\n<p>The <a href=\"https:\/\/www.westernjournal.com\/biden-files-lawsuit-gas-station-chain-day-mocked-shuffling\/\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a> is asking a court to recognize that the Davidson County Board of Education had no standing to suspend the teen.<\/p>\n<p>The suit is also asking for Christian McGhee\u2019s suspension to be removed from his academic record.<\/p>\n<hr>\n<div>\n<p><b><i>An Important Message from Our Staff:<\/i><\/b><\/p>\n<p><i><span>In just a few months, the world is going to change forever.
