The PA Supreme Court emphasized the mandatory\u2062 requirement of returning mail ballots in secrecy envelopes,\u2063 ruling out the right to cure ballot errors.\u200d The issue may significantly impact the 2024 Primary Election.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p style=\"font-weight: 400\">In what could be a pivotal and crucial state in the 2024 presidential election, the Republican National Committee and the Pennsylvania Republican Party filed a petition for leave to intervene against the Butler County Board of Elections after the Secretary of State allowed \u2014 during the state\u2019s primary \u2014 voters whose mail ballots lacked the required <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/eight-states-have-already-made-universal-mail-in-ballots-permanent\/\" title=\"Eight States Have Already Made Universal Mail-In Ballots Permanent\u00a0\">secrecy envelope<\/a> to cast a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/9-key-points-from-trump-campaign-press-conference-on-challenges-to-election-results\/\" title=\"9 Key Points from Trump Campaign Press Conference on Challenges to Election Results\">provisional ballot<\/a>.<\/p>\n<p style=\"font-weight: 400\">The Pennsylvania Supreme Court has affirmed that returning a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/facebook-bans-gop-account-allows-inflammatory-dnc-ads\/\" title=\"Facebook bans GOP account, allows inflammatory DNC ads\">mail ballot<\/a> in the secrecy envelope is mandatory under the Election Code and stated that the code does not provide a right to cure mail ballot errors.<\/p>\n<p style=\"font-weight: 400\">\u201cIt appears likely that as part of the 2024 Primary Election, the Board weighed mail-in ballots as they were received, and where it suspected that a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/rnc-other-conservative-groups-file-lawsuit-against-pennsylvania-for-illegally-altering-ballots\/\" title=\"RNC, Other Conservative Groups File Lawsuit Against Pennsylvania For Illegally Altering Ballots\">secrecy ballot<\/a> was missing based on the returned ballot\u2019s weight, included a notation in the SURE system indicating that the ballot was likely missing a secrecy envelope,\u201d the petition <a href=\"https:\/\/prod-static.gop.com\/media\/documents\/Pennsylvania_Lawsuit_Filing_1715088324.pdf\" target=\"_blank\" rel=\"noopener\">notes<\/a>. \u201cThis information is available to the Department, which has apparently set up an automatic email notice to voters through the SURE system informing them that their mail-in ballot had been rejected, and further advising such voters to appear in person and cast a provisional ballot. The Republican Committees believe that such a practice constitutes a clear violation of the Pennsylvania Election Code, which prohibits anyone from disclosing the results of the pre-canvass, and exceeds the Department\u2019s authority under the Election Code.\u201d<\/p>\n<p style=\"font-weight: 400\">\u201cIf a vote is not legally cast, it should not be counted,\u201d RNC Chairman Michael Whatley <a href=\"https:\/\/gop.com\/press-release\/documentspennsylvania_lawsuit_filing_1715088324pdf\/\">stated<\/a>. \u201cButler County does not allow ballot curing for ballots missing the required secrecy envelope \u2013 plain and simple. We are at a critical point in our Nation, and it is of the utmost importance that we have orderly administration of this November\u2019s election. We will continue to fight to ensure that our elections are fair and safe.\u201d<\/p>\n<p>\u201cThe Department of State has taken it upon itself to unilaterally reach out to voters whose mail-in ballots have been rejected due to a perceived lack of a secrecy envelope and encourage them to cure such ballots by appearing in person and voting provisionally,\u201d the lawsuit adds. \u201cTo be clear, there is no right under Pennsylvania law to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/poll-53-percent-support-the-senate-filibuster-up-6-percent-since-june\/\" title=\"Poll: 53 Percent Support the Senate Filibuster, Up 6 Percent Since June\">cure mail-<\/a>in ballots which lack a secrecy envelope and Petitioners\u2019 attempt to create such a right where none exists should be rejected.
