Upper III<\/span><\/a> <\/span> <span>   May 6, 2024 at 10:33am <\/span> <\/span>  <\/header>\n<section>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-denies-request-to-move-chauvin-trial-limits-evidence\/\" title=\"Judge denies request to move Chauvin trial, limits evidence\">judge presiding<\/a> over the trial of former President Donald Trump for falsification of business records has threatened Trump with jail time if he continues to violate the judge\u2019s gag order than some legal experts have said is unconstitutional.<\/p>\n<p>Judge Juan Merchan said Monday that since it was \u201cclear\u201d that the previous 10 $1,000 fines levied against the former president weren\u2019t effective \u2014 current estimates of his net worth indicate that he could pay such a fine millions of times over and remain a billionaire \u2014 jail might be the only reasonable option.<\/p>\n<p>Merchan made the comments as he imposed the 10th fine against Trump for ignoring the gag order the judge put in place before the trial <a href=\"https:\/\/www.westernjournal.com\/ap-manhattan-da-demands-gag-order-trump-ahead-upcoming-trial\/\" target=\"_blank\" rel=\"noopener\">even began<\/a>.<\/p>\n<p>The order prohibits Trump, 77, from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fact-check-did-joe-biden-say-mark-my-words-peace-and-democracy-will-be-made-in-uganda\/\" title=\"FACT CHECK: Did Joe Biden Say, \u2018Mark My Words: Peace And Democracy Will Be Made In Uganda\u2019?\">making public statements<\/a> about witnesses, the prosecution, court or district attorney\u2019s office staff, or any of their families.<\/p>\n<p>In the court filing imposing the most recent fine, Merchan wrote that Trump is \u201chereby put on notice that if appropriate and warranted, future violations of its lawful orders will be punishable by incarceration,\u201d <a href=\"https:\/\/www.foxnews.com\/politics\/ny-v-trump-judge-threatens-jail-time-for-possibly-the-next-president-for-future-gag-order-violations\" target=\"_blank\" rel=\"noopener\">Fox News<\/a> reported.<\/p>\n<p>\u201cThe last thing I want to consider is jail,\u201d Merchan said in court Monday morning, according to Fox. \u201cYou are [the] former president and possibly the next president.\u201d<\/p>\n<p>He said he understood that enforcing such an order would be problematic \u2014 in fact, a former deputy independent counsel for the <a href=\"https:\/\/www.westernjournal.com\/prosecutor-responsible-clintons-impeachment-died-age-76\/\" target=\"_blank\" rel=\"noopener\">Whitewater<\/a> and <a href=\"https:\/\/www.westernjournal.com\/bill-clinton-denied-sexual-relations-monica-lewinsky-tv-21-years-ago\/\" target=\"_blank\" rel=\"noopener\">Clinton-Lewinsky<\/a> investigations said it would be \u201cinteresting\u201d to see if the <a href=\"https:\/\/www.westernjournal.com\/secret-service-drivers-account-jan-6-just-demolished-anti-trump-forces-say-happened-armored-vehicle\/\" target=\"_blank\" rel=\"noopener\">Secret Service<\/a>, which is responsible for Trump\u2019s protection, would even allow it to happen.<\/p>\n<p>\u201cThe magnitude of that decision is not lost on me,\u201d Merchan said, according to Fox. \u201cYour continued willful violation of the court\u2019s order \u2026 constitutes a direct attack \u2026 and will not be allowed to continue \u2026 It is not allowed to continue.\u201d<\/p>\n<p>Attorney Sol Wisenberg, who famously questioned then-President Bill Clinton in videotaped grand jury testimony about his relationship with Monica Lewinsky, told Fox\u2019s Laura Ingraham that he didn\u2019t think it would happen.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Will Trump beat Alvin Bragg\u2019s charges?<\/p>\n<\/p><\/div>\n<p>\u201cI don\u2019t think it\u2019s very likely that he\u2019s going to be put in jail,\u201d Wisenberg said. \u201cAnd that would be an interesting federalism question, wouldn\u2019t it? Would the Secret Service let them do that, Laura? I don\u2019t know.\u201d<\/p>\n<p>Fellow attorney David Schoen, who defended Trump during his second impeachment hearing before the House, said Merchan was just playing to his fans among the left.<\/p>\n<p>\u201cMerchan is someone who in my view lives to please these sort of folks, and he loves to exert his power,\u201d Schoen told Ingraham. \u201cHe\u2019s a very insecure sort of guy and he\u2019s a bully, in my experience with him. So he\u2019ll try to do it if he thinks he can get away with it and be a hero. But it\u2019s so abusive.\u201d<\/p>\n<p>\u201cMichael Cohen gets to speak freely, they say these horrible things that any defendant ought to be able to respond to,\u201d he added. \u201cThey had a long speaking indictment in this case playing out charges that anybody can download, but Trump\u2019s not allowed to speak.\u201d<\/p>\n<p>Schoen added that the gag order wasn\u2019t even the \u201cmost dangerous\u201d order Merchan had made in the case.<\/p>\n<p>\u201cMerchan literally ordered the press not to report on anything that they see,\u201d he explained. \u201cThat denies the defendant his constitutional right to a public trial and the public\u2019s independent right to a public trial.
