The Biden administration&#8217;s actions\u2064 have sparked legal battles,\u200c with\u2063 states like Kansas and \u2062Texas leading the charge \u2064to defend \u200dcitizens&#8217; constitutional rights. State attorneys general are resisting President Joe Biden&#8217;s efforts to limit Second Amendment rights, opposing the criminalization of gun owners for selling firearms privately. Legal disputes\u200c have arisen as Kansas and Texas spearhead the defense of citizens&#8217; constitutional rights against\u2062 the Biden administration&#8217;s\u200d actions.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/commentary\/\">  Commentary <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/igcolonel\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/igcolonel\/%20\"><span>Warner Todd Huston<\/span><\/a> <\/span> <span>   May 6, 2024 at 11:04am <\/span> <\/span>  <\/header>\n<section>\n<p>As president, Joe Biden has tried every trick he can to limit or eliminate Second Amendment rights, but a coalition of state attorneys general is fighting back.<\/p>\n<p>For well over a year, the Biden administration has been looking to <a href=\"https:\/\/www.westernjournal.com\/biden-atf-set-sights-banning-private-gun-sales-new-rules-report\/\" target=\"_blank\" rel=\"noopener\">criminalize<\/a> millions of gun owners who sell their privately owned firearms to another private citizen, thereby redefining common, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-atf-set-sights-on-banning-private-gun-sales-with-new-rules-report\/\" title=\"Biden and ATF aim to prohibit private gun sales: Report.\">everyday gun owners<\/a> as \u201cgun dealers.\u201d<\/p>\n<p>Now, Biden\u2019s Bureau of Alcohol, Tobacco and Firearms is attempting to <a href=\"https:\/\/www.westernjournal.com\/bidens-atf-creating-sneaky-backdoor-gun-owners-proposal-will-soon-finalized-enacted\/\" target=\"_blank\" rel=\"noopener\">implement<\/a> Biden\u2019s sneaky, backdoor attack on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/utah-axes-gun-permit-requirement\/\" title=\"Utah Axes Gun-Permit Requirement\u00a0\">law-abiding gun owners<\/a>.<\/p>\n<p>According to an <a href=\"https:\/\/www.nraila.org\/articles\/20240412\/with-a-stroke-of-the-pen-biden-atf-criminalizes-tens-of-thousands-of-private-firearm-sellers\" target=\"_blank\" rel=\"noopener\">April 12 report<\/a> from the National Rifle Association\u2019s Institute for Legislative Action, the 2022 Bipartisan Safer Communities Act made a subtle change in the definition of\u00a0who can be considered a \u201cgun dealer\u201d by eliminating the language that once defined a \u201cgun dealer\u201d as someone who engages in repetitive sales of guns, ammunition or accessories with the \u201cprincipal objective\u201d of making a \u201clivelihood or profit.\u201d<\/p>\n<p>The <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/2938\" target=\"_blank\" rel=\"noopener\">bill<\/a>, which Biden <a href=\"https:\/\/www.npr.org\/2022\/06\/25\/1107626030\/biden-signs-gun-safety-law\" target=\"_blank\" rel=\"noopener\">signed into law<\/a> on June 25, 2022, eliminates the \u201clivelihood\u201d portion of that definition, so that only the \u201cprofit\u201d remains.<\/p>\n<p>This means that if any gun owner sells a weapon to a friend, family member, or neighbor, he could be considered a \u201cgun dealer\u201d who could be forced to buy an expensive gun dealer license and could be jailed if he did not run an expensive and intrusive \u201cuniversal background check\u201d on the person to whom he sold his firearm.<\/p>\n<p>On April 10, the Justice Department, which oversees the ATF, published the rule in the <a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/04\/19\/2024-07838\/definition-of-engaged-in-the-business-as-a-dealer-in-firearms\" target=\"_blank\" rel=\"noopener\">Federal Register<\/a>. It will take effect May 20.<\/p>\n<p>These rules would have a chilling effect on gun owners. If the ATF begins arresting, prosecuting, and jailing Americans for merely selling a gun to a friend, this would send a dangerous ripple effect throughout the country and represent a near-de facto ban on private gun transfers, the NRA-ILA notes.<\/p>\n<p>These rules are also meant to cover the ATF as they perform \u201ccivil forfeiture actions by the government seeking to confiscate firearms, ammunition, and profits from gun sales,\u201d the group warns.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Should Americans need a license for a private firearm sale between individuals?<\/p>\n<\/p><\/div>\n<p>But at least two major lawsuits have been filed by the states to stop this massive anti-gun power grab by the ATF and the <a href=\"https:\/\/www.westernjournal.com\/biden-gun-grab-hundreds-firearms-dealers-lose-licenses-admin-crackdown-law-enforcement-says-will-backfire\/\" target=\"_blank\" rel=\"noopener\">Biden administration<\/a>.<\/p>\n<p>Kansas Attorney General Kris Kobach has filed one of them and has garnered the support of 21 other state AGs in defense of the Second Amendment.<\/p>\n<p>\u201cBiden\u2019s latest attempt to strip away the Second Amendment rights of Americans through ATF regulations will make many law-abiding gun owners felons if they sell a firearm or two to family or friends,\u201d Kobach said in a <a href=\"https:\/\/ag.ks.gov\/media-center\/news-releases\/2024\/05\/01\/kobach-leads-21-state-coalition-in-defense-of-second-amendment\" target=\"_blank\" rel=\"noopener\">news release<\/a> about the suit. \u201cThis rule is blatantly unconstitutional. We are suing to defend the Second Amendment rights of all Americans.\u201d<\/p>\n<p>Kobach warns that the rule will make millions of citizens into <a href=\"https:\/\/www.westernjournal.com\/house-dems-prepare-law-will-devastate-private-gun-sales\/\" target=\"_blank\" rel=\"noopener\">instant criminals<\/a>.<\/p>\n<p>The new ATF rule, Kobach\u2019s press release explains, would require individuals to obtain a federal firearms dealer license for any sale the ATF thinks of as a profit, including currency, exchange of another firearm, or a gun smithing service.<\/p>\n<p>\u201cIt could make a felon of a gun hobbyist who sells a firearm to another family member or of a hunter who trades a firearm with another hunting buddy,\u201d the AG\u2019s press release explained.<\/p>\n<p>\u201cUntil now, those who repetitively purchased and sold firearms as a regular course of business had to become a licensee\u2026 This rule would put innocent firearm sales between law-abiding friends and family members within reach of federal regulation,\u201d the court filing reads. \u201cSuch innocent sales between friends and family would constitute a felony if the seller did not in fact obtain a federal firearms license and perform a background check.\u201d<\/p>\n<p>Kobach\u2019s lawsuit has been joined by the AGs from Alabama, Alaska, Arkansas, Georgia, Indiana, Idaho, Iowa, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Virginia, West Virginia, and Wyoming.<\/p>\n<p>Texas Attorney Genderal Ken Paxton has also launched a lawsuit against <a href=\"https:\/\/www.westernjournal.com\/biden-mulls-exec-order-end-run-2a-house-dems-push-1000-excise-tax-assault-weapons-high-capacity-mags\/\" target=\"_blank\" rel=\"noopener\">Biden\u2019s out-of-control government<\/a> and said in a <a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/attorney-general-ken-paxton-leads-multistate-coalition-suing-biden-administration-over-unlawful-ban\" target=\"_blank\" rel=\"noopener\">news release<\/a> that he is suing the federal government for \u201cunlawfully attempting to abridge Americans\u2019 constitutional right to privately buy and sell firearms.\u201d<\/p>\n<p>\u201cThe ATF\u2019s regulatory restrictions go beyond the authority granted to the agency by Congress. The new Final Rule is arbitrary and capricious and is a flagrant violation of the Second Amendment. Attorney General Paxton is seeking immediate injunctive relief to stop the ATF from enforcing its unlawful edict while the issue is considered fully by the courts,\u201d Paxton said in his news release.<\/p>\n<p>Paxton adds that Biden\u2019s redefinition of what constitutes a \u201cgun dealer\u201d would \u201csubject hundreds of thousands of law-abiding gun owners to presumptions of criminal guilt\u201d just for selling a single gun to a friend.<\/p>\n<p>\u201cYet again, Joe Biden is weaponizing the federal bureaucracy to rip up the Constitution and destroy our citizens\u2019 Second Amendment rights,\u201d Paxton said. \u201cThis is a dramatic escalation of his tyrannical abuse of authority. With today\u2019s lawsuit, it is my great honor to defend our Constitutionally-protected freedoms from the out-of-control federal government.\u201d<\/p>\n<p>Utah, Mississippi, and 23 other states have joined Paxton\u2019s lawsuit, the news release added.<\/p>\n<p>These attorneys general, who represent more than half the states, are right. <a href=\"https:\/\/www.westernjournal.com\/biden-administration-announces-new-gun-control-measures-republicans-slam-unconstitutional\/\" target=\"_blank\" rel=\"noopener\">Biden and his ATF<\/a> are using their power to make rules to eliminate the Second Amendment and criminalize millions of Americans for engaging in the right to keep and bear arms.<\/p>\n<p>The ATF\u2019s dangerous new rules are meant as a backdoor effort to squash our Second Amendment rights.
