He was fined $9,000 \u200cfor falsifying records to hide a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-rejects-trump-bid-to-shield-financial-records\/\" title=\"Supreme Court Rejects Trump Bid To Shield Financial Records\">hush money payment<\/a> to a porn star.\u200c Experts suggest the gag\u200b order could help Trump portray the trial as &#8220;election interference.&#8221; However, some view\u200b the order as \u200doverly restrictive, allowing others\u2063 to speak freely about Trump.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">Donald Trump<\/a> has decried the gag order against him in his <a href=\"http:\/\/washingtonexaminer.com\/tag\/new-york\/\" target=\"_blank\" rel=\"noopener\" title>Manhattan<\/a> criminal court trial as \u201cunconstitutional,\u201d a claim professors say could be working to galvanize his base.<\/p>\n<p>Trump earlier this week was fined $9,000 by Judge Juan Merchan, who is presiding over the trial that accuses Trump of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/are-the-charges-brought-against-the-trump-organizations-cfo-part-of-a-witch-hunt-experts-weigh-in\/\" title=\"Are The Charges Brought Against The Trump Organization\u2019s CFO Part Of A Witch Hunt? Experts Weigh In\">falsifying business records<\/a> to conceal a hush money payment to a porn star in order to deride damaging allegations in the final weeks of his 2016 campaign. <\/p>\n<p>College professors told the <em>Washington Examiner <\/em>that while gag orders are \u201crare,\u201d they are still legal and may ultimately help the former president further his claims that the trial is \u201celection interference.\u201d<\/p>\n<figure><figcaption>Former President Donald Trump returns to the courtroom following a break in his trial at Manhattan criminal court in New York, on Friday, May 3, 2024. (Charly Triballeau\/Pool Photo via AP)<\/figcaption><\/figure>\n<p>\u201cIt does appear that Trump has been able to both ignore aspects of the order and flip it to his advantage,\u201d said Roy Gutterman, a director of the Tully Center for Free Speech at Syracuse University.<\/p>\n<p>\u201cNow, he is cleverly using it as a campaign tool, talking about and complaining about being gagged,\u201d Gutterman added.<\/p>\n<p>At the end of a seven-hour day in court on Thursday, Trump told members of the press, \u201cI\u2019m not allowed to testify because this judge, who\u2019s totally conflicted, has me under an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/georgia-state-senator-reported-results-must-be-viewed-as-untrustworthy\/\" title=\"Georgia State Senator: \u201cReported Results Must Be Viewed As Untrustworthy\u201d\">unconstitutional gag order<\/a>.\u201d On Friday, Merchan sought to correct the record about Trump\u2019s comments, explaining that the gag order \u201cdoes not prohibit you from taking the stand\u201d and that it \u201conly applies to extrajudicial statements.\u201d<\/p>\n<p>The gag order prevents Trump from making public statements about witnesses, jurors, and some family members of prosecutors and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-stares-down-ex-attorney-cohen-as-he-testifies-in-new-york-civil-fraud-trial\/\" title=\"Trump glares at former attorney Cohen during New York fraud trial.\">court staff members<\/a>.<\/p>\n<h2>\u2018Very rare\u2019 but not illegal<\/h2>\n<p>Donald Nieman, a Binghamton University professor who specializes in teachings on U.S. legal history,\u00a0conceded that \u201cgag orders are very rare\u201d but not illegal.<\/p>\n<p>\u201cIt\u2019s not just high-profile people that you might have a gag or against, but it\u2019s people who defy the norms of justice and of legal process,\u201d Nieman said while acknowledging that Trump\u2019s claims about his gag order are an effective way of drawing sympathy over his legal plights.<\/p>\n<p>\u201cIt just goes into the narrative that he\u2019s being persecuted. And then he transforms that into [a message] that because he represents the everyday American, they\u2019re being persecuted too because the person they really want to be president is being denied a fair chance to run his campaign,\u201d Nieman added.<\/p>\n<p>However, some experts have said the gag order does go too far, such as the fact that key witnesses such as former Trump attorney Michael Cohen and porn star Stormy Daniels have been allowed to speak freely about the former president while he is unable to even utter their names.<\/p>\n<p>\u201cEven more ridiculous, while Trump was slapped with sanctions for commenting on Michael Cohen\u2019s dubious credibility, Cohen has run a media machine mocking Trump and rallying for his conviction, with nightly livestreams, even featuring a Trump impersonator,\u201d former federal prosecutors Andrew Cherkasky and Katie Cherkasky <a href=\"https:\/\/nypost.com\/2024\/05\/03\/opinion\/banning-trump-from-talking-about-his-trial-is-blatant-election-interference\/\" target=\"_blank\" rel=\"noopener\" title=\"wrote\">wrote<\/a> in a <em>New York Post <\/em>op-ed.<\/p>\n<p>Trump on Friday agreed to pay the $9,000 for violating the gag order <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2989894\/trump-vows-to-challenge-gag-order\/\" target=\"_blank\" rel=\"noopener\" title=\"but vowed to put up a fight \">but vowed to put up a fight <\/a>against Merchan\u2019s decision to hold him in contempt for violating the order. Defense attorney Todd Blanche said he took issue with Merchan\u2019s penalties for online social media reposts, instances in which Trump shared someone else\u2019s post with his followers on Truth Social.<\/p>\n<p>Meanwhile, prosecutor Chris Conroy this week claimed Trump is doing everything in his power to intentionally violate the gag order to bring chaos into the trial. He said there is no question that Trump continues to violate his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-gag-order-defense-knocks-bidens-whcd-speech-and-cohens-tiktok\/\" title=\"Trump's Defense Criticizes Biden's WHCD Speech and Cohen's TikTok Actions\">gag order willfully<\/a>, stating that such violations are \u201cpart of the plan.\u201d<\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>\u201cThe defendant thinks the rules should be different for him,\u201d Conroy said.<\/p>\n<p>Although gag order violations aren\u2019t meant to work in favor of defendants, Trump on Friday gained a small victory after Merchan declined prosecutors\u2019 request to cite his recent gag order in the event that Trump takes the witness stand in the trial.
