classified documents trial has revealed an issue some experts say could become important.<\/p>\n<p>Special Counsel <a href=\"https:\/\/www.westernjournal.com\/official-ethics-complaint-filed-special-counsel-jack-smith-face-discipline\/\" target=\"_blank\" rel=\"noopener\">Jack Smith<\/a> has revealed that at some point after boxes of documents were seized from Trump\u2019s Mar-a-Lago estate, the order of the documents changed, which the court did not learn about until now.<\/p>\n<p>The revelation was contained in a new <a href=\"https:\/\/justthenews.com\/sites\/default\/files\/2024-05\/gov.uscourts.flsd_.648653.522.0.pdf\" target=\"_blank\" rel=\"noopener\">court filing<\/a>.<\/p>\n<p>The filing concerned a claim from defendant Walt Nauta that he needs more time to know which documents seized from Trump\u2019s Mar-a-Lago estate were in which boxes and the order of the documents in the boxes.<\/p>\n<p>The filing admitted the current order of <a href=\"https:\/\/www.westernjournal.com\/selective-prosecution-trump-calls-hypocrisy-biden-not-charged-classified-documents-case\/\" target=\"_blank\" rel=\"noopener\">documents<\/a> in the boxes does not match scans that were made earlier.<\/p>\n<p>\u201cSince the boxes were seized and stored, appropriate personnel have had access to the boxes for several reasons, including to comply with orders issued by this Court in the civil proceedings noted above, for investigative purposes, and to facilitate the defendants\u2019 review of the boxes,\u201d the Justice Department prosecutors wrote.<\/p>\n<p>\u201cThere are some boxes where the order of items within that box is not the same as in the associated scans,\u201d the document said.<\/p>\n<p>Then came a confession of misleading the court.<\/p>\n<p>\u201cThe Government acknowledges that this is inconsistent with what Government counsel previously understood and represented to the Court,\u201d the document said.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Will more problems arise in the case against Trump?<\/p>\n<\/p><\/div>\n<p>\u201cThere are several possible explanations, including the above-described instances in which the boxes were accessed, as well as the size and shape of certain items in the boxes possibly leading to movement of items,\u201d the filing said.<\/p>\n<p>\u201cFor example, the boxes contain items smaller than standard paper such as index cards, books, and stationary, which shift easily when the boxes are carried, especially because many of the boxes are not full,\u201d prosecutors wrote.<\/p>\n<p>But the detail is a big deal, because part of <a href=\"https:\/\/www.westernjournal.com\/jack-smiths-nuclear-option-will-directly-target-judge-trump-trial\/\" target=\"_blank\" rel=\"noopener\">Trump\u2019s defense<\/a> is expected to be that documents were packed in chronological order, with no regard for classification marking, according to <a href=\"https:\/\/justthenews.com\/politics-policy\/all-things-trump\/trump-whodunnit-prosecutors-admit-key-evidence-document-case-has\" target=\"_blank\" rel=\"noopener\">Just the News<\/a>.<\/p>\n<p>\u201cProsecutors and investigators should never tamper with or alter evidence in their possession, including the order of documents in a box, because one never knows what may become relevant or crucial to a court or jury later in a case,\u201d Harvard Law Professor Emeritus Alan Dershowitz told the news outlet.<\/p>\n<p>Attorney Tim Parlatore, who was part of Trump\u2019s defense team at one point, said \u201dthis admission is stunning on multiple levels.\u201d<\/p>\n<p>The new information \u201creinforces the incompetence\u201d of the DOJ team \u201cin conducting basic criminal investigations and prosecutions that I observed when I was on the team.<\/p>\n<p>\u201cBut at a deeper level, the loss of specific document locations is a destruction of exculpatory evidence,\u201d he said. \u201cI went through all of the boxes at NARA and the document order was important because it was clear to us that the boxes had been untouched since leaving the White House.<\/p>\n<p>\u201cFor prosecutors who are trying to prove that the defendants knowingly possessed these documents to then destroy the evidence that would undermine that claim is a very serious violation,\u201d he said<\/p>\n<p>Trump reacted to the news by posing \u201cARREST DERANGED JACK SMITH.
