Pena. The case highlighted the \u2062constitutional guarantee \u2064of equal treatment, impacting future\u2064 discussions on affirmative action. The narrative explores the complexities of race, discrimination, and the pursuit of equality \u2063in American society.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>In 1994, I represented a Colorado Springs, <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/colorado\/\" target=\"_blank\" rel=\"noopener\" title=\"Colorado\">Colorado<\/a>, businessman, a college dropout who found his niche bidding on and building guardrails on federal and state <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/infrastructure\" target=\"_blank\" rel=\"noopener\" title=\"highway projects.\">highway projects.<\/a> Randy Pech developed a statewide reputation for having a sharp pencil, leaving behind well-built projects, and timely completion of subcontract awards.\u00a0That is, until a day when a bid he knew was the lowest was rejected by the prime contractor, who told Pech that the federal government gave him $10,000 to award the project, not to Pech, but to a competitor based on his race.\u00a0Pech believed racial preferences in federal highway contracting were unconstitutional and sued.<\/p>\n<p>When his case, <em>Adarand Constructors, Inc. v. Pena,<\/em> reached the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\" target=\"_blank\" rel=\"noopener\" title=\"Supreme Court,\">Supreme Court,<\/a> the corporate media labeled him an \u201cangry white man\u201d for his demand that the Constitution\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lawsuit-illinois-school-district-forced-students-on-privilege-walks-compared-whiteness-to-the-devil\/\" title=\"Lawsuit: Illinois School District Forced Students On \u2018Privilege Walks,\u2019 Compared \u2018Whiteness\u2019 To The Devil\">equal protection guarantee<\/a> be applied to him and to the United States government.\u00a0Remarkably, at the dawn of the 21st century, it did not; in fact, the solicitor general argued to the court that Congress, as a national legislature, could discriminate between and among people on the basis of race, including Pech.\u00a0The court disagreed.\u00a0Writing for a 5-4 majority, Justice Sandra Day O\u2019Connor vacated earlier court precedents to the contrary and held that, regardless of the race or the person burdened or benefited by congressional racial discrimination, everyone had a constitutional guarantee of equal treatment.<\/p>\n<p>So breathtaking was the ruling that it led the news on all three networks, made the front page (above the fold) of the nation\u2019s newspapers, and drew predictions from political pundits that \u201caffirmative action is dead.\u201d\u00a0In fact, in dissent, Justice John Paul Stevens concluded that, if it remained in force, <em>Adarand<\/em> doomed all the court\u2019s past racial carveouts.\u00a0Affirmative action did not die, in part because of an intervening misstep by the court (most recently corrected by the court of Chief Justice John Roberts when he wrote that<a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/551\/701\/\" target=\"_blank\" rel=\"noopener\" title> \u201cthe way to stop discrimination on the basis of race is to stop discriminating on the basis of race\u201d),<\/a> but also because a case challenging congressional racial preferences has not yet reached the nine justices. Nonetheless, <em>Adarand<\/em> remains controlling in the nation\u2019s courts \u2014 for example, it was used to strike down racial preferences set forth in President Joe Biden\u2019s partisan American Rescue Plan Act.   <\/p>\n<p>Although the founders\u2019 equal protection vision is embraced fully by the Supreme Court, something appears amiss in our culture in which one group and one group alone is subjected to the most un-American, uncivilized, and even unconstitutional of abuse.\u00a0In a nation where, as Tucker Carlson points out, \u201cbeing racist is the ultimate sin,\u201d how could that have happened?<\/p>\n<p>Fortunately, Jeremy Carl, in his crucially important new book, <em><a href=\"https:\/\/www.amazon.com\/Unprotected-Class-Anti-White-Destroying-America\/dp\/1684514584\">The Unprotected Class: How Anti-White Racism is Tearing America Apart<\/a>,<\/em> has answers and solutions.\u00a0Carl, a graduate of Yale University and the Kennedy School of Government at Harvard University, a top official in President Donald Trump\u2019s Interior Department, and a former research fellow at Stanford University\u2019s Hoover Institution, is now a senior fellow at the Claremont Institute out of his home in Montana, where he lives with his wife and children.<\/p>\n<p>For those who dream, as did the late Reverend Dr. Martin Luther King, Jr., that their children will be judged by the content of their character and not the color of their skin, Carl, whose dream for his children is similar (that they \u201cbe treated equally as they pursue their dreams\u201d), provides great information, insight, and inspiration.\u00a0Perhaps his greatest contribution is speaking the truth:\u00a0\u201cWhite Americans and \u2018whiteness\u2019\u201d have been stigmatized \u201cin the service of justifying blatant racial discrimination.\u201d\u00a0In doing so, Carl provides an exhaustive, dense, but highly readable education on how our culture, media, and, in some cases, our laws got to the sorry state in which we find ourselves.\u00a0Carl backs it all up with 76 pages of nearly 1,000 endnotes with authentication, source materials, and more information.<\/p>\n<p>Carl painstakingly documents that anti-whiteness has manifested itself throughout America\u2019s culture.\u00a0How could it not \u2014 after all, \u201cwhite supremacy\u201d is called the greatest threat to the country by the \u201cWhite House, Hollywood, and many major corporations.\u201d\u00a0That is not the worst of it, however, and if you think you have been paying attention, think again.\u00a0Carl provides chapter and verse on how anti-white racism has played out, including the distortion of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-campus-anti-semitism-skyrockets-even-as-coronavirus-forces-remote-learning\/\" title=\"Report: Campus Anti-Semitism Skyrockets Even as Coronavirus Forces Remote Learning\">civil rights laws<\/a>; the collapse of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/president-trump-please-pardon-jon-woods-a-victim-of-process-crimes-like-michael-flynn\/\" title=\"President Trump, Please Pardon Jon Woods, a Victim of Process Crimes Like Michael Flynn\">criminal justice system<\/a>, with the concomitant excoriation of police and one-sided application of \u201chate crimes;\u201d the destruction of white neighborhoods; the trashing of public education (CRT, nondiscipline, and affirmative action); the erasure of history; the elimination of barriers to illegal immigration, the racialization of movies, Madison Avenue, Broadway, television, music, and literature; the DEI-ing of big business and Big Tech; and finally the perversion of medicine, religion, and America\u2019s military.<\/p>\n<p>Led by the Democratic Party and its all-too-willing, enthusiastic, and contrary to decades of policy positions (e.g., \u201cschool busing\u201d) puppet President Joe Biden and the usual assortment of race hustlers, race-baiters, and demagogues, it has achieved bandwagon status as white liberals (whether out of guilt, ignorance, or ideology), colleges and universities (most of which were already leading the parade), the corporate media, and corporate America joined in decrying the alleged racism, crimes, and evils of white America.\u00a0Meanwhile, this band of banal bandits drew unwitting support from a host of useful idiots, as Carl points out.\u00a0After all, Vice President Dan Quayle coined the insanity, \u201cDiversity is our strength,\u201d President George W. Bush teamed with \u201cracial justice\u201d advocates to\u00a0adopt the lax lending standards that led to the 2008 market crash, and the Army\u2019s chief of staff whined that the worst tragedy of the Fort Hood jihad massacre (13 dead, 42 wounded) would be if \u201cdiversity\u201d became a casualty of the killings.<\/p>\n<p>It matters not that, for decades, the supply of white racism has exceeded exponentially progressives\u2019 demand for it.\u00a0Nor does it matter, as Carl points out, that \u201cwhite people are increasingly struggling with social dysfunctions\u201d that tragically yield \u201cdeaths of despair.\u201d\u00a0Carl argues, with authority, that they suffer from \u201cdownward mobility, declining fertility[,] rising drug addiction[,] depression, and narrowing opportunities.\u201d\u00a0Nonetheless, for example, lily-white environmental groups, when given a chance \u201cto promote a clean environment,\u201d will instead \u201cchoose to slander whites every time\u201d to establish their anti-white bona fides.<\/p>\n<p>Where is all this headed?\u00a0Carl maintains that the \u201ccommon ideological purpose\u201d is \u201cto create an intellectual and cultural environment to justify the expropriation of land, property, and other wealth from whites while instituting a permanent regime of anti-white employment and legal discrimination.\u201d\u00a0 Not all or even most participants in the movements Carl outlined share these goals, perhaps believing instead that their attacks on \u201cwhite privilege\u201d are merely a fight for \u201cjustice\u201d \u2014 however, the movements\u2019 leaders know the end game.<\/p>\n<p>Carl, perhaps more than most, is sensitive to such topics after living in India, where the saying was \u201cyou don\u2019t cast your vote, you vote your caste.\u201d\u00a0Nonetheless, Carl has hope \u201cfor all Americans\u201d and not just because a 2023 poll showed 72% of people agree it is \u201cokay to be white.\u201d (Fifty-three percent of black people agreed, and only 26% disagreed.)\u00a0Carl has hope because \u201cAmericans of all racial backgrounds understand the danger of our current situation\u201d and have joined in the fight for \u201cequal rights for Americans regardless of the color of their skin.\u201d Many of them have led that fight for decades, suffering abuse for doing so. Finally, Carl has hope because \u201chysterical [white racism] charges are no longer deterring people from speaking out.\u201d<\/p>\n<p>Carl\u2019s closing strategies and solutions merit thoughtful consideration and implementation by leaders and ordinary people, including reforming the census, net-zero immigration that he faults today as \u201cunfettered\u201d and worsened by \u201ca declining focus on cultural assimilation,\u201d embracing lawfare against the anti-white establishment, eliminating affirmative action, reforming civil rights laws, ending DEI bureaucracies, and strengthening law enforcement. Meanwhile, Carl proposes courting Asian Americans as allies, holding black political leaders and white progressives accountable for their anti-white policies and rhetoric, speaking out against anti-white discrimination, engaging in civil disobedience, and boycotting anti-white racism.<\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>Carl\u2019s final chapter, \u201cFinding Our Way Home,\u201d foresees a home that is \u201cone of freedom and equality under the law,\u201d as envisioned by the founders, particularly James Madison.\u00a0Carl notes that Madison thought that \u201cequal laws protecting equal rights\u201d ensure not only \u201cloyalty, and love of country,\u201d but also \u201cmutual respect and good will among citizens.\u201d<\/p>\n<p>As America continues its journey, Carl\u2019s vision of such a homecoming is encouraging.<\/p>\n<p><em>William Perry Pendley, a Wyoming attorney and a Colorado-based, public-interest lawyer for three decades with victories at the Supreme Court of the U.S., served in President Ronald Reagan\u2019s administration and led the Bureau of Land Management for former President Donald Trump.<\/em><\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In 1994, I advocated for a Colorado Springs businessman, known for excelling in bidding on and constructing guardrails for highway projects.
