A majority of U.S. adults <a href=\"https:\/\/thefederalist.com\/2023\/06\/16\/poll-majority-of-americans-still-reject-democrats-unlimited-abortion-agenda\/\" target=\"_blank\" rel=\"noreferrer noopener\">reject that position<\/a>, but that fact hasn\u2019t stopped the ballot measure battle that plagued Ohio last year from infiltrating several other states, including those controlled by Republicans, during the 2024 election cycle. <\/p>\n<h2 class=\"wp-block-heading\">On the Ballot<\/h2>\n<h3 class=\"wp-block-heading\">Florida<\/h3>\n<p>Florida voters will be asked come November 5 to weigh in on a <a href=\"https:\/\/initiativepetitions.elections.myflorida.com\/InitiativeForms\/Fulltext\/Fulltext_2307_EN.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">state constitutional amendment<\/a> declaring, \u201cNo law shall prohibit, penalize, delay, or restrict abortion before viability or when necessary to protect the patient\u2019s health, as determined by the patient\u2019s healthcare provider.\u201d<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1173455836\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-0db7e4c250ab701cb45036c472f11abf fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-0db7e4c250ab701cb45036c472f11abf\"><\/div>\n<p>As with other abortion measures led by <a href=\"https:\/\/dos.elections.myflorida.com\/committees\/ComDetail.asp?account=83927\" target=\"_blank\" rel=\"noreferrer noopener\">out-of-state activists<\/a>, the path to the Sunshine State\u2019s ballot measure involved <a href=\"https:\/\/thefederalist.com\/2024\/04\/02\/florida-supreme-court-rules-to-allow-deceptive-abortion-amendment-on-november-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">deception<\/a> and, in this case, <a href=\"https:\/\/sbaprolife.org\/newsroom\/press-releases\/fl-pro-abortion-activists-arrested-for-phony-petition-signatures\" target=\"_blank\" rel=\"noreferrer noopener\">fraudulent signatures<\/a>. The amendment itself is laced with loose terms like \u201cviability,\u201d which can easily be exploited to ensure abortion at any point in gestation and includes language that does away with parental consent. <\/p>\n<p>If the proposed amendment passes this fall, medical professionals in Florida could deem abortion at any stage of pregnancy necessary for a woman\u2019s \u201chealth,\u201d physical, emotional, or mental. If it fails, <a href=\"https:\/\/thefederalist.com\/2024\/05\/01\/with-floridas-heartbeat-law-now-in-effect-democrats-stir-up-pro-abortion-ballot-measures\/\" target=\"_blank\" rel=\"noreferrer noopener\">Florida\u2019s heartbeat law will stand.<\/a><\/p>\n<h3 class=\"wp-block-heading\">Maryland<\/h3>\n<p>Maryland is already one of the most pro-abortion states in the U.S., but a <a href=\"https:\/\/ballotpedia.org\/Maryland_Right_to_Reproductive_Freedom_Amendment_(2024)\" target=\"_blank\" rel=\"noreferrer noopener\">ballot measure<\/a> up for vote on Election Day 2024 could make the state\u2019s sweeping abortion provisions more permanent and prevent any limits from being enacted in the future.  <\/p>\n<p>The amendment in question seeks to enshrine an undefined \u201cright to reproductive freedom\u201d in the Declaration of Rights portion of the state constitution because it claims abortion is \u201ca central component of an individual\u2019s rights to liberty and equality.\u201d <\/p>\n<div class=\"fdrlst__b89e9-d61472729d7f2a5c8d058c31023cd3c3 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-d61472729d7f2a5c8d058c31023cd3c3\"><\/div>\n<p>The proposal, which is strongly supported by <a href=\"https:\/\/www.plannedparenthoodaction.org\/planned-parenthood-advocates-dc-maryland-nova\/ppadmv-blog\/marylands-ballot-measure-to-protect-reproductive-freedom-what-it-is-and-why-it-matters\" target=\"_blank\" rel=\"noreferrer noopener\">abortion giant Planned Parenthood<\/a>, also says the state \u201cmay not, directly or indirectly, deny, burden, or abridge the right unless justified by a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/michigan-is-hiding-a-childrens-constitutional-right-to-genital-amputation-in-its-abortion-amendment-2\/\" title=\"Michigan Is Hiding A Children\u2019s Constitutional Right To Genital Amputation In Its Abortion Amendment\">compelling state interest achieved<\/a> by the least restrictive means.\u201d<\/p>\n<h3 class=\"wp-block-heading\">New York<\/h3>\n<p>New York, similar to Maryland, already has <a href=\"https:\/\/ag.ny.gov\/publications\/abortion-legal-and-protected-new-york-state\" target=\"_blank\" rel=\"noreferrer noopener\">unlimited abortion<\/a> as long as a medical professional deems the life or health \u2014 physical or mental \u2014 of the mother at risk. Abortion activists are asking New Yorkers to further enshrine abortion in the state by ratifying an <a href=\"https:\/\/www.nyclu.org\/en\/press-releases\/equal-rights-amendment-advances-new-york-voters-november-2024\" target=\"_blank\" rel=\"noreferrer noopener\">Equal Rights Amendment<\/a> that would effectively prevent the government from enacting limits on baby-killing in the future.<\/p>\n<p>The proposed amendment also includes broad language that could stop the state from banning transgender mutilation and chemical castration for children and would infringe on parents\u2019 rights.  <\/p>\n<p>\u201cWhether through Albany sloppiness \u2014 or pernicious ideological intent \u2014 Proposition One would strip the legal rights of\u00a0parents with school-age\u00a0children to know about crucially important things happening with their kids, including controversial gender transformation procedures,\u201d the Coalition to Protect Kids <a href=\"https:\/\/www.foxnews.com\/politics\/ny-ballot-initiative-could-ban-parents-approving-childs-trans-surgery-critics-warn-fiery-campaign\" target=\"_blank\" rel=\"noreferrer noopener\">told Fox News Digital.<\/a><\/p>\n<div class=\"fdrlst__b89e9-87cd948710592ebd4b11f5662992dfb8 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-87cd948710592ebd4b11f5662992dfb8\"><\/div>\n<h2 class=\"wp-block-heading\">Could Be on the Ballot<\/h2>\n<h3 class=\"wp-block-heading\">Arizona<\/h3>\n<p>Democrats, including <a href=\"https:\/\/x.com\/MSNBC\/status\/1778908912739029226\" target=\"_blank\" rel=\"noreferrer noopener\">Vice President Kamala Harris<\/a> and outside abortion groups such as <a href=\"https:\/\/www.plannedparenthoodaction.org\/planned-parenthood-advocates-arizona\/arizona-for-abortion-access\" target=\"_blank\" rel=\"noreferrer noopener\">ACLU and Planned Parenthood<\/a>, flocked to the Grand Canyon State this year to promote a measure that, if added to the 2024 ballot and passed, adds a \u201cfundamental right to abortion\u201d to the state constitution. <\/p>\n<p>The <a href=\"https:\/\/ballotpedia.org\/Arizona_Right_to_Abortion_Initiative_(2024)\" target=\"_blank\" rel=\"noreferrer noopener\">sweeping language<\/a> not only leaves the definition of \u201cviability\u201d up to the subjective judgment of a health care professional but also prevents the state from passing or <a href=\"https:\/\/thefederalist.com\/2024\/04\/09\/arizona-supreme-court-upholds-law-punishing-abortionists-as-unlimited-abortion-ballot-battle-rages\/\" target=\"_blank\" rel=\"noreferrer noopener\">enforcing laws <\/a>punishing abortionists for killing babies. <\/p>\n<p>Organizers have until July 3 to collect 383,923 valid signatures but <a href=\"https:\/\/www.nbcnews.com\/politics\/2024-election\/arizona-abortion-rights-amendment-backers-says-gathered-signatures-nee-rcna145922\" target=\"_blank\" rel=\"noreferrer noopener\">already claim<\/a> they hit the threshold necessary to add the amendment to the November ballot. <\/p>\n<h3 class=\"wp-block-heading\">Arkansas<\/h3>\n<p>A majority of Americans say they believe abortion <a href=\"https:\/\/thefederalist.com\/2023\/06\/16\/poll-majority-of-americans-still-reject-democrats-unlimited-abortion-agenda\/\" target=\"_blank\" rel=\"noreferrer noopener\">should be limited to 15 weeks<\/a>. Abortion activists in Arkansas, however, are scrambling before July 5 to collect signatures for a <a href=\"https:\/\/ballotpedia.org\/Arkansas_Right_to_Abortion_Initiative_(2024)\" target=\"_blank\" rel=\"noreferrer noopener\">ballot measure<\/a> that would prohibit the state from regulating abortion until after 18 weeks gestation. <\/p>\n<p>The proposed constitutional amendment also carves out exceptions, regardless of state statute, for abortion beyond 18 weeks for fatal fetal anomalies and the undefined \u201chealth\u201d of the woman. <\/p>\n<h3 class=\"wp-block-heading\">Colorado<\/h3>\n<p>Colorado currently <a href=\"https:\/\/coag.gov\/app\/uploads\/2022\/06\/Know-Your-Reproductive-Rights.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">offers unlimited abortion<\/a> through all nine months of pregnancy to anyone who wants it, but that isn\u2019t good enough for the activists leading the national constitutional amendment abortion campaign. <\/p>\n<p>Organizers <a href=\"https:\/\/www.cbsnews.com\/news\/colorado-abortion-access-ballot-measure-signatures\/\" target=\"_blank\" rel=\"noreferrer noopener\">say<\/a> they have enough verified signatures to add a <a href=\"https:\/\/ballotpedia.org\/Colorado_Right_to_Abortion_and_Health_Insurance_Coverage_Initiative_(2024)\" target=\"_blank\" rel=\"noreferrer noopener\">constitutional amendment<\/a> to the 2024 ballot that would not only hamper future efforts to limit abortion but also permit \u201cabortion to be a covered service under health insurance plans.\u201d<\/p>\n<h3 class=\"wp-block-heading\">Missouri<\/h3>\n<p>Abortion in Missouri is banned except in cases of <a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=188.017\" target=\"_blank\" rel=\"noreferrer noopener\">medical emergencies<\/a>. A ballot measure <a href=\"https:\/\/www.sos.mo.gov\/cmsimages\/Elections\/Petitions\/2024-086.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">introduced<\/a> by the ill-named Missourians for Constitutional Freedom, however, seeks to enshrine abortion in the state constitution by adding a \u201cright to reproductive freedom\u201d that permits anyone to \u201cmake and carry out decisions about all matters relating to reproductive health care.\u201d<\/p>\n<p>Activists <a href=\"https:\/\/ballotpedia.org\/Missouri_Right_to_Reproductive_Freedom_Amendment_(2024)\" target=\"_blank\" rel=\"noreferrer noopener\">have until May 5<\/a> to collect the 171,500 valid signatures required to add the proposed amendment to the November 2024 ballot.<\/p>\n<h3 class=\"wp-block-heading\">Montana<\/h3>\n<p>To retaliate against Montana\u2019s Republican-controlled legislature for trying to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/unacceptable-two-red-states-each-fail-to-pass-pro-life-protections-by-one-vote\/\" title=\"\u2018Unacceptable\u2019: Two Red States Each Fail To Pass Pro-Life Protections By One Vote\">pass pro-life protections<\/a>, abortion activists introduced a ballot measure that seeks to amend the state constitution to \u201cexpressly provide a right to make and carry out decisions about one\u2019s own pregnancy, including the right to abortion.\u201d <\/p>\n<p>Montana Attorney General Austin Knudsen tried to invalidate the measure under Article XIV, Section 11 of the Montana constitution because <a href=\"https:\/\/montanafreepress.org\/2024\/01\/17\/montana-attorney-general-blocks-constitutional-abortion-proposal\/\" target=\"_blank\" rel=\"noreferrer noopener\">he said<\/a> it \u201clogrolls multiple distinct political choices into a single initiative.\u201d\u00a0The state Supreme Court, however, overruled his findings and <a href=\"https:\/\/montanafreepress.org\/2024\/04\/01\/montana-supreme-court-rewrites-abortion-ballot-language-signature-gathering-moves-closer\/\" target=\"_blank\" rel=\"noreferrer noopener\">rewrote the language<\/a>. <\/p>\n<p>Abortion activists have until the <a href=\"https:\/\/thehill.com\/policy\/healthcare\/4598829-montana-abortion-rights-group-launches-ballot-initiative\/\" target=\"_blank\" rel=\"noreferrer noopener\">June 21 deadline<\/a> to collect signatures.<\/p>\n<h3 class=\"wp-block-heading\">Nebraska <\/h3>\n<p>Abortion activists in Nebraska want a <a href=\"https:\/\/ballotpedia.org\/Nebraska_Right_to_Abortion_Initiative_(2024)\" target=\"_blank\" rel=\"noreferrer noopener\">constitutional amendment<\/a> that would \u201cprovide all persons the fundamental right to abortion without interference from the state\u201d to be added to the 2024 ballot. The campaign, however, faces challenges from <a href=\"https:\/\/ballotpedia.org\/Nebraska_Prohibit_Abortion_Procedures_and_Drugs_Initiative_(2024)\" target=\"_blank\" rel=\"noreferrer noopener\">two<\/a> other <a href=\"https:\/\/sos.nebraska.gov\/sites\/default\/files\/doc\/Protect%20Women%20and%20Children%20Constitutional%20Amendment.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ballot measures<\/a> that seek to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/a-worthy-recipient-pro-life-group-names-trump-pro-life-person-of-the-year\/\" title=\"\u201cA Worthy Recipient\u201d- Pro-Life Group Names Trump Pro-Life \u201cPerson Of The Year\u201d\">protect unborn babies<\/a> and mothers from the harms of abortion throughout pregnancy. <\/p>\n<p>Organizers of all petitions must turn in their collected signatures for certification by July 5. <\/p>\n<h3 class=\"wp-block-heading\">Nevada<\/h3>\n<p>Nevadans will know in July whether an effort to enshrine a <a href=\"https:\/\/www.nvsos.gov\/sos\/home\/showpublisheddocument\/12633\/638375592027970000\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cfundamental right to abortion\u201d<\/a> in the state constitution will make it on the November 2024 ballot. <\/p>\n<p>Currently, abortion in Nevada is <a href=\"https:\/\/dpbh.nv.gov\/Programs\/MIP\/AbortionInNevada\/\" target=\"_blank\" rel=\"noreferrer noopener\">permitted at any gestation<\/a> as long as \u201cthe physician has reasonable cause to believe an abortion is necessary to preserve the life or health of the pregnant person.\u201d The <a href=\"https:\/\/www.nvsos.gov\/sos\/home\/showpublisheddocument\/12633\/638375592027970000\" target=\"_blank\" rel=\"noreferrer noopener\">proposed amendment<\/a> would further shield abortion in the state from regulation or limit. <\/p>\n<p>Even if the amendment makes the 2024 ballot and passes, it must <a href=\"https:\/\/www.nvsos.gov\/sos\/elections\/initiatives-referenda\/filing-a-constitutional-initiative\" target=\"_blank\" rel=\"noreferrer noopener\">undergo another vote in a subsequent general election<\/a> to achieve full ratification.  <\/p>\n<h3 class=\"wp-block-heading\">South Dakota<\/h3>\n<p>Pro-life protections in South Dakota ban abortion except to save the life of the mother. A ballot measure that <a href=\"https:\/\/www.nbcnews.com\/politics\/south-dakota-abortion-ballot-measure-rcna150193\" target=\"_blank\" rel=\"noreferrer noopener\">activists say<\/a> has met the state\u2019s May 7 threshold for signatures, however, hopes to change that.<\/p>\n<p>The <a href=\"https:\/\/ballotpedia.org\/South_Dakota_Right_to_Abortion_Amendment_(2024)\" target=\"_blank\" rel=\"noreferrer noopener\">proposed amendment language<\/a> declares the state should not have any say over abortions in the first trimester.
