This marks the second instance of nitrogen gas being used for an execution in the state. Governor Kay Ivey has yet to set a date\u200b for Miller&#8217;s execution. Miller survived a previous execution\u200b attempt and his attorney argues against the use of nitrogen gas. \u200cThe Alabama Supreme Court sanctioned the\u2063 use of nitrogen gas for the execution of prisoner Alan Eugene Miller, marking the second time\u2063 this method has been employed in the state. Governor \u2064Kay Ivey has not scheduled a\u200b date for the execution. \u200bNotably,\u200b Miller \u200csurvived a prior execution attempt, \u2062prompting his attorney to \u200ccontest the use of nitrogen gas.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The <a href=\"http:\/\/washingtonexaminer.com\/tag\/alabama\/\" target=\"_blank\" rel=\"noopener\" title>Alabama<\/a> Supreme Court <a href=\"https:\/\/apnews.com\/article\/alabama-execution-nitrogen-death-penalty-64c48e9f1089ad9eb97e4d18069d3a2d\" target=\"_blank\" rel=\"noopener\" title>authorized<\/a> the state attorney general\u2019s request for an <a href=\"http:\/\/washingtonexaminer.com\/tag\/death-penalty\/\" target=\"_blank\" rel=\"noopener\" title>execution<\/a> date for inmate Alan Eugene Miller using nitrogen gas.<\/p>\n<p>The Alabama Supreme Court authorized the use of nitrogen gas on Miller, which will be the second time it is used for execution in the state. Gov. Kay Ivey (R-AL) has not yet set a date for Miller\u2019s execution.<\/p>\n<p>Miller <a href=\"https:\/\/apnews.com\/article\/alabama-united-states-executions-88119552972412ff0a3aeb2062af643d\" target=\"_blank\" rel=\"noopener\" title>survived<\/a> a previous execution attempt in 2022. His attorney said Alabama subjected Miller \u201cto precisely the unnecessary and wanton infliction of pain that the Eighth Amendment was intended to prohibit.\u201d  <\/p>\n<p>Miller was convicted of killing three men in a workplace shooting in 1999 and has a federal lawsuit against the use of nitrogen gas as <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/idaho-student-murders-report-suggests-death-penalty-could-cost-1-million-more-than-life-sentence\/\" title=\"Report: Death penalty in Idaho student murders may cost  million more than life sentence.\">lethal injection due<\/a> to the constitutional ban on cruel and unusual punishment.<\/p>\n<p>\u201cRather than address these failures, the State of Alabama has attempted to maintain secrecy and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/china-backed-confucius-institute-rebrands-to-avoid-scrutiny\/\" title=\"China-Backed Confucius Institute Rebrands to Avoid Scrutiny\">avoid public scrutiny<\/a>, in part by misrepresenting what happened in this botched execution,\u201d the lawyers wrote. Miller\u2019s attorneys are expected to ask a federal judge to block the execution.<\/p>\n<p>The state first used nitrogen gas as a form of lethal injection in January on Kenneth Smith, who reportedly \u201cthrashed violently on the gurney\u201d and was seen breathing for several minutes before being pronounced dead.<\/p>\n<p>\u201cI\u2019ve been to four previous executions, and I\u2019ve never seen a condemned inmate thrash in the way that Kenneth Smith reacted to the nitrogen gas,\u201d Lee Hedgepeth, a member of the media present at the execution, <a href=\"https:\/\/www.bbc.com\/news\/world-us-canada-68085513\" target=\"_blank\" rel=\"noopener\" title>told<\/a> the BBC<em>. <\/em>\u201cKenny just began to gasp for air repeatedly, and the execution took about 25 minutes total.\u201d<\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>Smith also survived another execution attempt in 2022, marking the state\u2019s third failed execution attempt. During his original execution attempt, prison officials repeatedly failed to execute him as \u201cstate prosecutors attempted to lift a stay of execution issued by a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-court-is-fast-tracking-sidney-powells-request-for-a-forensic-exam-of-dominion-voting-machines\/\" title=\"Federal Court Is Fast-Tracking Sidney Powell\u2019s Request For A Forensic Exam Of Dominion Voting Machines\">federal appeals court<\/a>.\u201d<\/p>\n<p>\u201cAs the night progressed, as Mr. Smith was subjected to ever-escalating levels of pain and torture, no one responded to his pleas to stop the pain, told him of the Eleventh Circuit\u2019s stay, or answered his questions about what they were doing to him.
