The regulation mandates background checks and a federal license for those selling guns for profit, regardless of the sales method. Lawsuits argue that the regulations infringe on Second \u2062Amendment rights, with\u200b Texas and \u200dKansas leading separate legal actions.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><span style=\"font-weight: 400\">More than two dozen Republican attorneys general announced challenges on Wednesday to the proposed gun control rule from the Biden administration regulating private firearm sales. <\/span><\/p>\n<p><span style=\"font-weight: 400\">Multiple suits were filed in federal court against the proposal, which would require individuals who \u201cearn a profit\u201d selling guns to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-administration-will-use-semi-permanent-soft-sided-structures-to-house-migrant-children-trump-was-blasted-for-tent-cities\/\" title=\"Biden Administration Will Use \u2018Semi-Permanent, Soft-Sided\u2019 Structures To House Migrant Children. Trump Was Blasted For \u2018Tent Cities.\u2019\">conduct background checks<\/a> and have a federal firearms license <a href=\"https:\/\/www.dailywire.com\/news\/kamala-harris-announces-new-rule-all-gun-dealers-must-conduct-background-checks\" target=\"_blank\" rel=\"noopener\">no matter<\/a> where or how they sell their merchandise. Republicans say that the proposed <\/span><a href=\"https:\/\/www.regulations.gov\/document\/ATF-2023-0002-0001#:~:text=921(a)(21)(C)%20as%20%E2%80%9Ca%20person,makes%20occasional%20sales%2C%20exchanges%2C%20or\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">regulations<\/span><\/a><span style=\"font-weight: 400\">, put forth by the Justice Department, infringe on Second Amendment rights and would make it a felony for family members and friends to sell guns to each other without conducting background checks or having a federal license. <\/span><\/p>\n<p><span style=\"font-weight: 400\">One effort, led by Texas Attorney General Ken Paxton, sued the DOJ and the ATF, arguing that the ATF doesn\u2019t have the statutory authority to enforce the rule and that it\u00a0violates the Second and Fifth Amendments. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cYet again, Joe Biden is weaponizing the federal bureaucracy to rip up the Constitution and destroy our citizens\u2019 Second Amendment rights,\u201d Paxton <a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/attorney-general-ken-paxton-leads-multistate-coalition-suing-biden-administration-over-unlawful-ban\" target=\"_blank\" rel=\"noopener\">said<\/a>. \u201cThis is a dramatic escalation of his tyrannical abuse of authority. With today\u2019s lawsuit, it is my great honor to defend our Constitutionally-protected freedoms from the out-of<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/majority-say-bidens-anti-maga-speech-was-designed-to-incite-conflict\/\" title=\"Majority Say Biden's Anti-MAGA Speech Was \"Designed to Incite Conflict\"\">-control federal government<\/a>.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">The suit was joined by Louisiana, Mississippi, Utah, the Gun Owners of America, the Virginia Citizens Defense League, and the Tennessee Firearms Association. <\/span><\/p>\n<p><span style=\"font-weight: 400\">A separate lawsuit, led by Kansas Attorney General Kris Kobach, also challenges the DOJ and the ATF. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cBiden\u2019s latest attempt to strip away the Second Amendment rights of Americans through ATF regulations will make many <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/utah-axes-gun-permit-requirement\/\" title=\"Utah Axes Gun-Permit Requirement\u00a0\">law-abiding gun owners<\/a> felons if they sell a firearm or two to family or friends,\u201d Kobach <a href=\"https:\/\/ag.ks.gov\/media-center\/news-releases\/2024\/05\/01\/kobach-leads-21-state-coalition-in-defense-of-second-amendment\" target=\"_blank\" rel=\"noopener\">said<\/a>. \u201cThis rule is blatantly unconstitutional. We are suing to defend the Second Amendment rights of all Americans.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">Kansas was joined by Iowa, Montana, Alabama, Alaska, Arkansas, Georgia, Indiana, Idaho, Missouri, Nebraska, New Hampshire, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Virginia, West Virginia, and Wyoming.<\/span><\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1714657703188000&#038;usg=AOvVaw0-8IzS3B7axoRMsynY0m75\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p><span style=\"font-weight: 400\">Florida Attorney General Ashley Moody filed A third lawsuit against the DOJ and ATF.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The Biden administration <a href=\"https:\/\/www.dailywire.com\/news\/biden-signs-most-expansive-gun-control-bill-in-decades-into-law-following-republican-support\" target=\"_blank\" rel=\"noopener\">said<\/a> it had proposed the rules to implement the \u201cBipartisan Safer Communities Act,\u201d which added background check stipulations and gave grants for states to enact \u201cred flag\u201d laws. The measure, which was backed by\u00a015 Republicans in the Senate and 14 Republicans in the House, was the <a href=\"https:\/\/www.dailywire.com\/news\/biden-signs-most-expansive-gun-control-bill-in-decades-into-law-following-republican-support\" target=\"_blank\" rel=\"noopener\">most expansive<\/a> gun control law signed into law in decades. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThe challenged rule, in fact, goes far beyond the plain text of the BSCA,\u201d Florida\u2019s <a href=\"https:\/\/www.myfloridalegal.com\/sites\/default\/files\/2024-05\/atf-complaint_as-filed.pdf\">suit<\/a> says. \u201cIt purports to force thousands of law-abiding gun owners to register as federal firearms dealers and navigate a federal bureaucracy as a precondition to engaging in constitutionally protected activity.
