The legal fight involves a\u200d DOJ subpoena for Trump&#8217;s documents, with\u2063 Trump pleading not guilty to\u200b the charges.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noopener\" title=\"Donald Trump\">Donald Trump<\/a> asked a judge in Florida to dismiss charges against him related to classified documents on the grounds that the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/justice-department\/\" target=\"_blank\" rel=\"noopener\" title>Department of Justice<\/a> was unfairly targeting him, according to court <a href=\"https:\/\/www.scribd.com\/document\/728722403\/Trump-Selective-and-Vindictive-Motion?secret_password=ZEGrjJGWg8KlFoNaAxXr\" target=\"_blank\" rel=\"noopener\" title>documents<\/a> made public on Thursday.<\/p>\n<p>Trump\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/attorneys-fbi-sources-plied-men-with-drugs-orchestrated-alleged-whitmer-kidnapping-plot\/\" title=\"Attorneys: FBI Sources Plied Men With Drugs, Orchestrated Alleged Whitmer Kidnapping Plot\">defense attorneys made<\/a> the request in March in a previously sealed filing, claiming that special counsel <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/jack-smith\/\" target=\"_blank\" rel=\"noopener\" title=\"Jack Smith\u2019s\">Jack Smith<\/a>\u2019s prosecution against him was \u201cselective and vindictive.\u201d<\/p>\n<p>Trump\u2019s attorneys drew comparisons to nine other officials, including President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/Joe-Biden\/\" target=\"_blank\" rel=\"noopener\" title>Joe Biden<\/a> and former Vice President Mike Pence, arguing that they had allegedly mishandled classified material but were never held accountable for it in the same way Trump has been.<\/p>\n<p>\u201cAmerican history is chock full of public examples involving alleged mishandling of classified information and documents, which did not result in the type of politically motivated charges that the Special Counsel\u2019s Office has brought against President Trump and his codefendants,\u201d the attorneys wrote.<\/p>\n<p>After more than a year of back-and-forth between Trump and the National Archives and Records Administration, a DOJ-issued subpoena for Trump\u2019s documents, and a search of Trump\u2019s Mar-a-Lago residence, Trump was indicted on charges of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/looming-decisions-set-to-shape-trump-classified-documents-case\/\" title=\"Impending choices to influence Trump's classified documents case\">willfully retaining national defense information<\/a> and obstructing a federal investigation. (AP Photo\/Paul Sancya)<\/figcaption><\/figure>\n<p>Trump\u2019s attorneys cited in their dismissal request what they described as \u201cglaring and egregious examples\u201d of classified documents controversies, which included former special counsel Robert Hur finding after a yearlong investigation that Biden was reckless with classified material and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-pentagon-pick-colin-kahl-denies-leaking-classified-information-on-social-media\/\" title=\"Biden Pentagon Pick Colin Kahl Denies Leaking Classified Information on Social Media\">disclosed classified information<\/a> to his ghostwriter.<\/p>\n<p>Hur\u2019s report of his findings, released in February, had <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2847694\/biden-classified-documents-revives-comparisons-trump\/\" target=\"_blank\" rel=\"noopener\" title>prompted<\/a> widespread comparisons between Trump\u2019s and Biden\u2019s cases. Hur, perhaps in anticipation of this, directly addressed their differences, saying Biden was a cooperative and proactive subject, while Trump\u2019s case involved \u201cserious aggravating facts.\u201d<\/p>\n<p>Smith, for his part, argued in a response that Trump\u2019s and Biden\u2019s cases had only \u201csuperficial similarities,\u201d citing the \u201cparticularly strong evidence of willfulness\u201d in Trump\u2019s case.<\/p>\n<p>Trump\u2019s defense attorneys also pointed to an incident from 2023 involving Trump\u2019s former vice president. In that case, the DOJ \u201cbypassed standard procedures\u201d to take back a small number of documents with classified markings from Pence\u2019s home in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/Indiana\/\" target=\"_blank\" rel=\"noopener\" title>Indiana<\/a>, Trump\u2019s attorneys wrote.<\/p>\n<p>The attorneys also detailed classified material issues involving former President Bill Clinton, Trump\u2019s 2016 presidential opponent Hillary Clinton, former FBI Director James Comey, former CIA Directors David Petraeus and John Deutch, former National Security Adviser Sandy Berger, and former COVID-19 coordinator Deborah Birx.<\/p>\n<p>\u201cDozens of public officials have faced allegations relating to the handling of classified information without being charged with the types of felonies alleged in the Superseding Indictment,\u201d Trump\u2019s attorneys wrote. \u201cIn this case, the record adequately demonstrates impermissible prosecutorial motives, driven in an unprecedented fashion by a sitting president to serve his political objective of prosecuting his predecessor and opponent.\u201d<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>Judge Aileen Cannon, a Trump appointee, has not yet ruled on whether to dismiss Trump\u2019s charges based on them being selective and vindictive.<\/p>\n<p>Cannon did, however, deny two other requests from Trump earlier this year that his charges be dropped based on claims that he was allowed to possess classified material under the Presidential Records Act and on the argument that his charges, brought under the Espionage Act, were unconstitutionally vague.<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Ex-President Trump seeks dismissal of charges in Florida court, citing DOJ bias in targeting him over classified document allegations.
