Douglas Golden<\/span><\/a> <\/span> <span>   May 2, 2024 at 5:15am <\/span> <\/span>  <\/header>\n<section>\n<p>If the Mexican government can\u2019t get a guilty verdict in an American court for the death of an illegal migrant who was allegedly spotted with a group of armed men on private property, its response, apparently, is to target the rancher who shot the migrant \u2014 and help sue the pants off of him.<\/p>\n<p>Arizona rancher George Alan Kelly, 75, will not be retried in the death of 48-year-old Gabriel Cuen-Buitimea in January of 2023, <a href=\"https:\/\/ktar.com\/story\/5572028\/mexican-officials-regret-us-decision-not-to-retry-american-rancher-in-fatal-shooting-of-mexican-man\/\" target=\"_blank\" rel=\"noopener\">The Associated Press<\/a> reported, after a jury deadlocked on charges of second-degree murder and aggravated assault. The charges were dismissed by Superior Court Judge Thomas Fink on Monday after he declared a mistrial April 22.<\/p>\n<p>According to <a href=\"https:\/\/www.nytimes.com\/2024\/04\/29\/us\/arizona-rancher-migrant-death-trial.html\" target=\"_blank\" rel=\"noopener\">The New York Times<\/a>, Brenna Larkin, an attorney for Kelly, said that jurors were deadlocked 7-1 in favor of a not-guilty verdict.<\/p>\n<p>\u201cBecause of the unique circumstances and challenges surrounding this case, the Santa Cruz County Attorney\u2019s Office has decided not to seek a retrial,\u201d Deputy County Attorney Kimberly Hunley told Fink in court on Monday, according to the <a href=\"https:\/\/ktar.com\/story\/5571905\/prosecutors-wont-retry-arizona-rancher-george-alan-kelly-accused-of-killing-man\/\" target=\"_blank\" rel=\"noopener\">AP<\/a>.<\/p>\n<p>Kelly, a cattle rancher who lives near <a href=\"https:\/\/www.westernjournal.com\/ap-arizona-rancher-rejects-plea-deal-fatal-shooting-migrant-near-us-mexico-border-trial-set\/\" target=\"_blank\" rel=\"noopener\">Nogales, Arizona<\/a>, said he was eating lunch on Jan. 30, 2023, when he saw a group of men crossing his property near his home. The men were armed with rifles, Kelly testified.<\/p>\n<p>The rancher said he fired several warning shots from his rifle over the group of men to scare them off. However, Cuen-Buitimea \u2014 who lived just south of the border in Nogales, Mexico, and had been deported from the United States several times, according to the <a href=\"https:\/\/apnews.com\/article\/rancher-migrant-shooting-arizona-mexico-border-4e6e07909f0b9d53ee58a99fbf515870\" target=\"_blank\" rel=\"noopener\">AP<\/a>, the last time in 2016 \u2014 was hit in the back and died when he was hit roughly 100 yards away.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">\u201cYou shoulda shot him because he was getting ready to shoot you\u2026\u201d<\/p>\n<p>George Alan Kelly gets emotional recounting the day that he says armed men trespassed on his property\u2014One of them was shot and killed\u2014Kelly maintains he didn\u2019t shoot anyone but rather shot over their\u2026 <a href=\"https:\/\/t.co\/hjaFVJ1BX2\">pic.twitter.com\/hjaFVJ1BX2<\/a><\/p>\n<p>\u2014 Ali Bradley (@AliBradleyTV) <a href=\"https:\/\/twitter.com\/AliBradleyTV\/status\/1785859911802589598?\">May 2, 2024<\/a><\/p>\n<\/blockquote>\n<p>\u201cMr. Kelly and his wife have been living through a nightmare for over a year, and they can finally rest easy,\u201d Larkin said in a statement, according to <a href=\"https:\/\/www.msn.com\/en-us\/news\/crime\/arizona-rancher-declares-nightmare-over-after-migrant-murder-case-dropped\/ar-AA1nVtog\" target=\"_blank\" rel=\"noopener\">Newsweek<\/a>.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Do you stand with George Allan Kelly?<\/p>\n<\/p><\/div>\n<p>\u201cWhile that injustice to Gabriel and his family is unfortunate, we are at least pleased to know that the injustice will not be compounded by scapegoating an innocent man.\u201d<\/p>\n<p>Which is why, of course, the top <a href=\"https:\/\/www.westernjournal.com\/mexico-breaks-diplomatic-ties-ecuador-major-division-forms-central-america\/\" target=\"_blank\" rel=\"noopener\">Mexican<\/a> official in Nogales, Arizona is choosing to scapegoat Kelly.<\/p>\n<p>\u201cThis seems to us to be a very regrettable decision,\u201d said Mexican Consul General Marcos Moreno Baez in a statement, according to the AP.<\/p>\n<p>\u201cWe will explore other options with the family, including a civil process,\u201d he added.<\/p>\n<p>And, according to NewsNation\u2019s Ali Bradley \u2014 who covers the border crisis for the network and is seen interviewing Kelly in the clip above \u2014 that\u2019s exactly what they plan to do.<\/p>\n<p>According to a post on X published late Wednesday night, Bradley said she had learned that \u201cMexico is now working with Cuen-Buitimea\u2019s family to sue George Alan Kelly according to his attorney, Brenna Larkin.\u201d<\/p>\n<p>In a statement, Larkin condemned the interference of the Mexican government in the case, particularly given the criminal background of the deceased.<\/p>\n<p>\u201cThe defense is curious about the Mexican government\u2019s continued involvement in this case, and its attempts to influence judicial proceedings in this case. Myself and my colleagues have represented many different Mexican nationals who have been stuck in custody in the United States,\u201d she said in a statement.<\/p>\n<p>\u201cThe Mexican consul general rarely (if ever) reaches out to get involved in their cases.\u201d<\/p>\n<blockquote data-conversation=\"none\">\n<p dir=\"ltr\" lang=\"en\">NEW: Mexico is now working with Cuen-Buitimea\u2019s family to sue George Alan Kelly according to his attorney, Brenna Larkin.<\/p>\n<p>Here is her response:<\/p>\n<p>\u201cThe defense is curious about the Mexican government\u2019s continued involvement in this case, and its attempts to influence judicial\u2026<\/p>\n<p>\u2014 Ali Bradley (@AliBradleyTV) <a href=\"https:\/\/twitter.com\/AliBradleyTV\/status\/1785861270887080212?\">May 2, 2024<\/a><\/p>\n<\/blockquote>\n<p>Cuen-Buitimea and his group were \u201cclearly involved in criminal activity,\u201d the statement continued.<\/p>\n<p>\u201cMr. Cuen-Buitimea had previously been <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/illegal-alien-accused-of-kidnapping-attempt-guess-what-was-protecting-him-from-deportation\/\" title=\"Illegal alien accused of attempted kidnapping - Guess what prevented his deportation?\">deported numerous times<\/a> from this country. Had he obeyed the law, he would never have been there and he would never have met this end.<\/p>\n<p>\u201cWe would hope that the Mexican consul general would encourage their citizens to respect the laws of the United States, just as we encourage our citizens to respect the laws of Mexico. It is unfortunate that Mr. Cuen-Buitimea continued to make the tragic choices that put him in harm\u2019s way, but those were his choices.\u201d<\/p>\n<p>Bradley added that Kelly\u2019s team was exploring its options in regards to suing the government.<\/p>\n<p>Regardless of what happens next, it\u2019s worth noting the hypocrisy at play here.<\/p>\n<p>If this had happened to a Nogales, Arizona, resident who had illegally crossed the border and was shot by a homeowner in Nogales, Mexico \u2014 and if there was reasonable suspicion of criminal activity aside from just the <a href=\"https:\/\/www.westernjournal.com\/invasion-usa-biden-sets-new-border-record-illegal-aliens-encountered-august-equivalent-army\/\" target=\"_blank\" rel=\"noopener\">illegal border crossing<\/a> \u2014 the Mexican government would be foaming at its collective mouths if there was a peep out of any American official.<\/p>\n<p>It would likely be hours, not days, before the visage of Mexican President <a href=\"https:\/\/www.westernjournal.com\/mexicos-president-accused-sending-biden-ransom-note-full-demands\/\" target=\"_blank\" rel=\"noopener\">Andr\u00e9s Manuel L\u00f3pez Obrador<\/a> would appear on national television in a conniption, demanding an apology from the highest levels of Washington, D.C., officialdom. It would be an international incident. Vice President Kamala Harris would be shuttled to the Mexican state of Sonora, home of Nogales <em>sur<\/em>, in order to address the \u201c<a href=\"https:\/\/www.westernjournal.com\/kamala-harris-claims-extreme-climate-one-root-causes-border-crisis\/\" target=\"_blank\" rel=\"noopener\">root causes<\/a>\u201d of such activity.<\/p>\n<p>But amid a border crisis of record proportions and a not-infrequently deported man who was killed while undertaking illegal activity and trespassing on private property, the Mexican government apparently feels it\u2019s not only in a position to lecture the United States on how its juries and courts rule, but also to help the family of the deceased man target the rancher whose property he was trespassing on.<\/p>\n<p>Mexican officials should not interfere with U.S. courts, period. The fact is that if they had their own border under control, this quite likely never would have happened.<\/p>\n<p>If the dead man\u2019s family members want to sue anyone, maybe they should sue their own government, instead, which refuses to clamp down on illegal immigration even as it strengthens criminal cartels and strains relations between Washington and Mexico City.<\/p>\n<hr>\n<div>\n<p><b><i>An Important Message from Our Staff:<\/i><\/b><\/p>\n<p><i><span>In just a few months, the world is going to change forever.
