This decision \u2064follows the approval of Amendment 4 by over 63% of Missouri voters, requiring\u200c a 20%\u2064 to 25% budget increase for\u200c the state-controlled \u2062<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/officials-launch-murder-probe-into-death-of-officer-following-d-c-protests\/\" title=\"Officials launch murder probe into death of officer following D.C. protests\">police force<\/a> in Kansas\u200c City.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>(The Center Square) \u2013 Voters will once again decide on a constitutional amendment to increase minimum funding for Kansas City\u2019s police department after the Missouri Supreme Court set aside a previous result from the 2022 election.<\/p>\n<p>Last September, the state\u2019s highest court <a href=\"https:\/\/www.thecentersquare.com\/missouri\/article_aa52ecf8-5d7a-11ee-826b-2b9e6882e938.html\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>heard arguments<\/strong><\/a> from Kansas City Mayor Quinton Lucas stating the exact cost of the ballot measure wasn\u2019t provided to voters. On Tuesday, Justice Paul Wilson wrote in a <a href=\"https:\/\/www.courts.mo.gov\/file.jsp?id=207700\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>42-page opinion<\/strong><\/a> the ballot\u2019s summary misstated and misrepresented the cost of the change.<\/p>\n<p>\u201cA voter reading this summary not only would not understand the portion of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/tennessee-senate-passes-bill-defining-sex-as-gender-at-birth\/\" title=\"Tennessee Senate passes bill defining sex as gender at birth\">fiscal note<\/a> describing the fiscal impact on the City, that voter surely would be surprised to discover that a large portion of the fiscal note was devoted to that subject,\u201d Wilson wrote.<\/p>\n<p><strong><a href=\"https:\/\/www.senate.mo.gov\/22info\/BTS_Web\/Bill.aspx?SessionType=R&#038;BillID=71259748\" target=\"_blank\" rel=\"noreferrer noopener\">Senate Bill 678<\/a><\/strong> and <strong><a href=\"https:\/\/www.senate.mo.gov\/22info\/BTS_Web\/Bill.aspx?SessionType=R&#038;BillID=71259749\" target=\"_blank\" rel=\"noreferrer noopener\">Senate Joint Resolution 38<\/a><\/strong>, both sponsored by Tony Luetkemeyer, R-Parkville, were <strong><a href=\"https:\/\/www.thecentersquare.com\/missouri\/article_41eeb422-f669-11ec-9834-bf5525a8671f.html\" target=\"_blank\" rel=\"noreferrer noopener\">signed into law<\/a><\/strong> by Republican Gov. Mike Parson, a former sheriff of Polk County. Republicans in the legislature said the bill would stop a \u201cdefund the police\u201d approach by Lucas. More than 63% of Missouri voters approved the initiative, titled Amendment 4.<\/p>\n<p>It mandated a police department established by a state board of commissioners must increase its budget from 20% to 25%. Kansas City\u2019s police department is the only force controlled by the state.<\/p>\n<p>\u201cThe Missouri Supreme Court sided with what is fair and just: the people of Kansas City\u2019s voices should not be ignored in conversations about our own safety,\u201d <strong><a href=\"https:\/\/twitter.com\/QuintonLucasKC\/status\/1785384556385693878\" target=\"_blank\" rel=\"noreferrer noopener\">Lucas posted<\/a><\/strong> on X, the platform formerly known as Twitter. \u201cThis is an important decision standing up for the rights of cities and their people.\u201d<\/p>\n<p>Luetkemeyer said the second vote won\u2019t change the outcome.<\/p>\n<p>\u201cThe voters of every county in this state overwhelmingly passed Amendment 4 in 2022,\u201d <strong><a href=\"https:\/\/twitter.com\/TonyForMissouri\/status\/1785398815605882931\" target=\"_blank\" rel=\"noreferrer noopener\">Luetkemeyer posted<\/a><\/strong> on X. \u201cI\u2019m confident they\u2019ll do the same this November. The mayor\u2019s radical agenda to defund the Kansas City Police Department will never take root in Missouri.\u201d<\/p>\n<p>However, Wilson was direct in his criticism of the 2022 ballot information.<\/p>\n<p>\u201cFor the state to decide what to put on the ballot and, as a result of that decision, to make the voter read information that is both materially inaccurate and seriously misleading is an \u2018irregularity\u2019 of the highest conceivable magnitude,\u201d Wilson wrote.<\/p>\n<p>Wilson wrote state law requires the court to order the new election and provide the language for the ballot. However, the secretary of state will be allowed to change the amendment number to avoid confusion. The ballot will read:<\/p>\n<p>\u201cShall the Missouri Constitution be amended to authorize laws, passed before December 31st, 2026, that increase minimum funding for a police force established by a state board of police commissioners to ensure such police force has additional resources to serve its communities?<\/p>\n<p>This would authorize a law passed in 2022 increasing required funding by the City of Kansas City for police department requests from 20% of general revenue to 25%, an increase of $38,743,646, though the City previously provided that level of funding voluntarily.
