Trump 2.0 little more than six months away.\u00a0And the Trump-hating accomplice media will be aiding and abetting this specialized brand of lawfare every step of the way. <\/p>\n<p>But the litigious left has run into some problems trying to sell its legally flawed narrative that former President Donald Trump, along with his campaign attorneys and supporters, unlawfully used an alternate electors strategy to subvert the results of the 2020 elections.  <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-132888384\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-0d6470373a5a5baaf877a5c5f24f1783 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-0d6470373a5a5baaf877a5c5f24f1783\"><\/div>\n<p>Last week, <a href=\"https:\/\/apnews.com\/article\/arizona-fake-electors-charges-2020-election-9da5a7e58814ed55ceea1ca55401af85\" target=\"_blank\" rel=\"noreferrer noopener\">Arizona<\/a> became the latest Democrat swing state to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sen-cruz-obama-biden-doj-was-politicized-and-weaponized-against-opponents\/\" title=\"Sen. Cruz: Obama-Biden DOJ was \u2018politicized and weaponized\u2019 against opponents\">target political opponents<\/a> via the \u201cfake electors\u201d narrative. <a href=\"https:\/\/www.azag.gov\/kris-mayes\" target=\"_blank\" rel=\"noreferrer noopener\">Attorney General Kris Mayes<\/a> announced the <a href=\"https:\/\/www.azag.gov\/sites\/default\/files\/2024-04\/Indictment%20Redacted.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">indictment<\/a> of 18 people, including 11 alternate electors for Trump. The accused include former Trump campaign attorney <a href=\"https:\/\/www.newsweek.com\/donald-trump-lawyer-christina-bobb-could-spend-life-prison-1895309\" target=\"_blank\" rel=\"noreferrer noopener\">Christina Bobb<\/a>, who currently serves as the Republican National Committee\u2019s senior counsel for election integrity, and <a href=\"https:\/\/apnews.com\/article\/arizona-fake-electors-charges-2020-election-indictment-747677165e1f1d34ac47e8a6fec2bace\" target=\"_blank\" rel=\"noreferrer noopener\">John Eastman<\/a>, former Trump attorney who is facing disbarment in California for leading an alternate electors strategy similar to the one that was employed by John F. Kennedy\u2019s 1960 campaign. <\/p>\n<p>Also indicted are Trump adviser <a href=\"https:\/\/www.cnn.com\/2024\/04\/24\/politics\/arizona-criminal-charges-2020-election-subversion\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">Rudy Giuliani<\/a> and the former president\u2019s White House Chief of Staff Mark Meadows, in a move Forbes <a href=\"https:\/\/www.forbes.com\/sites\/alisondurkee\/2024\/04\/25\/all-the-states-investigating-the-2020-election-arizona-brings-charges-against-giuliani-meadows-and-fake-electors\/?sh=da4551f1fe2a#:~:text=Arizona's%20attorney%20general%20brought%20criminal,Chief%20of%20Staff%20Mark%20Meadows%E2%80%94\" target=\"_blank\" rel=\"noreferrer noopener\">described<\/a> as \u201cthe latest in a string of states where false electors and Trump allies are now facing criminal charges and investigations years after the 2020 election.\u201d <\/p>\n<p>\u201cI think these are political prosecutions that are outside of the law,\u201d said <a href=\"https:\/\/www.heritage.org\/staff\/hans-von-spakovsky\" target=\"_blank\" rel=\"noreferrer noopener\">Hans von Spakovsky,<\/a> a senior legal fellow in the Heritage Foundation\u2019s Edwin Meese III Center for Legal and Judicial Studies. \u201cQuite apart from the historical precedent for the moment, keep in mind that what these individuals did in Arizona, Georgia, and elsewhere is get alternate electors to be ready as a contingency if it was decided the election should be overturned.\u201d <\/p>\n<p>There\u2019s nothing illegal about that, von Spakovsky said. <\/p>\n<div class=\"fdrlst__b89e9-d9fa2c21f5e0c6d0c7cb459a0cd8c862 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-d9fa2c21f5e0c6d0c7cb459a0cd8c862\"><\/div>\n<h2 class=\"wp-block-heading\">\u2018Dueling Electors\u2019<\/h2>\n<p>The 18 indicted in the Arizona case face <a href=\"https:\/\/www.azag.gov\/sites\/default\/files\/2024-04\/Indictment%20Redacted.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">felony charges<\/a> of conspiracy, \u201cfraudulent schemes and artifices,\u201d fraudulent schemes and practices, and forgery. They are accused, <a href=\"https:\/\/sourcenm.com\/2024\/04\/29\/5-more-trump-attorneys-aides-publicly-named-in-az-fake-elector-indictment\/\" target=\"_blank\" rel=\"noreferrer noopener\">according to<\/a> the Arizona Mirror, of \u201csigning bogus documents claiming that they were Arizona\u2019s certified electors and that Donald Trump won the 2020 election.\u201d Republicans in Georgia, Michigan, and Nevada have been similarly charged with falsely certifying that Trump, not Biden, won the election.<\/p>\n<p>But, as von Spakovsky notes, the alternate electors strategy used while legal disputes over Biden\u2019s razor-thin victories in several swing states were pending was not some novel theory. In the disputed 1876 election, in which Southern Democrats were accused of widespread voter fraud, three states offered two sets of electors \u2014 one set each for Democrat Samual Tilden and Republican Rutherford B. Hayes. <\/p>\n<p>As Reuters <a href=\"https:\/\/www.reuters.com\/article\/idUSKBN2781G4\/\" target=\"_blank\" rel=\"noreferrer noopener\">notes:<\/a><\/p>\n<blockquote class=\"wp-block-quote\">\n<p><em>In Southern states, the voting was marred by threats of violence from Democrats who aimed to keep black voters away from the polls. The Democrats also created ballots that carried pictures of famous Republican Abraham Lincoln to try to trick illiterate voters into choosing Tilden.<\/em><\/p>\n<p>At the end of the tumultous campaign, competing political camps in three states each sent two different slates of electors \u2013 one for Tilden, the other for Hayes \u2013 to Congress.<\/p>\n<p><em>The dueling slates from Florida, Louisiana and South Carolina arrived with varying degrees of authority; the Republican slate from Louisiana supporting Hayes was sent by the state\u2019s governor while the Democratic slate backing Tilden was sent by that party\u2019s gubernatorial candidate.<\/em><\/p>\n<p><em>The election hinged on the disputed states. If their Republican electoral votes were counted, Hayes would be president. If the Democratic slates were counted, Tilden would be elected.<\/em><\/p>\n<\/blockquote>\n<p>None of the contingent electors was indicted or threatened with years in prison for attempting to protect their candidate in the disputed presidential election. <\/p>\n<div class=\"fdrlst__b89e9-b3aba8acd44f037e59752007d55ea985 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-b3aba8acd44f037e59752007d55ea985\"><\/div>\n<p>The same can be said for the 1960 election, when Hawaii\u2019s electors for Richard Nixon, the Republican presidential candidate, and John Kennedy, the Democrat, met on Dec. 19 to \u201ccast their votes for President and Vice President\u201d and certify \u201ctheir own meeting and votes.\u201d Nixon had won the state by a mere 141 votes and a recount was ongoing. <\/p>\n<p>As The Federalist\u2019s Margot Cleveland wrote last year in a piece headlined, \u201c<a href=\"https:\/\/thefederalist.com\/2023\/05\/15\/the-lefts-2020-fake-electors-narrative-is-fake-news\/\" target=\"_blank\" rel=\"noreferrer noopener\">The Left\u2019s 2020 \u2018Fake Electors\u2019 Narrative Is Fake News<\/a>\u201c:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p><em>In casting their electoral ballots for Kennedy, the three Hawaiian Democrats certified they were the \u201cduly and legally qualified and appointed\u201d electors for president and vice president for the state of Hawaii and that they had been \u201ccertified (as such) by the Executive.\u201d The Hawaii electors further attested: \u201cWe hereby certify that the lists of all the votes of the state of Hawaii given for President, and of all the votes given for Vice President, are contained herein.\u201d<\/em><\/p>\n<p><em>Two of the three Democrat electors were <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-frontrunner-was-a-zealous-advocate-for-gitmo-terror-suspects\/\" title=\"Supreme Court Frontrunner Was a Zealous Advocate for Gitmo Terror Suspects\">retired federal judges<\/a>, William Heen and Delbert Metzger, and Heen personally mailed the Democrat electoral votes to Congress on Dec. 20. In fact, the envelope containing the certificates, further <\/em><a href=\"https:\/\/www.politico.com\/news\/2022\/02\/07\/1960-electoral-college-certificates-false-trump-electors-00006186\" target=\"_blank\" rel=\"noreferrer noopener\"><em>attested<\/em><\/a><em>: \u201cWe hereby certify that the lists of all the votes of the state of Hawaii given for president \u2026 are contained herein.\u201d<\/em><\/p>\n<\/blockquote>\n<p>The electors were simply attempting to protect their candidate\u2019s position, even though the initial numbers showed Kennedy lost Hawaii, albeit by just 0.08 percent of the vote. <\/p>\n<p>On Dec. 30, 1960, the judge who had ordered the recount \u201cheld that Kennedy had won the election,\u201d Cleveland wrote. The judge, she added, \u201cstressed the importance of the Democrat electors having met on Dec. 19, as prescribed by the Electoral Count Act, to cast their ballots in favor of Kennedy. That step allowed the Hawaii governor to then certify Kennedy as the winner of Hawaii\u2019s three electoral votes and, in turn, Congress to count Hawaii\u2019s electoral votes in favor of Kennedy.\u201d<\/p>\n<p>Von Spakovsky noted that in more recent presidential elections numerous legislators, particularly Democrats, have filed objections to electoral votes. In January 2017, Democrats voiced their disdain for Trump by attempting to object to some states\u2019 Electoral College votes, as NBC News <a href=\"https:\/\/www.nbcnews.com\/politics\/congress\/despite-objections-congress-certifies-donald-trump-s-election-n704026\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> at the time. <\/p>\n<h2 class=\"wp-block-heading\">Preserving Trump\u2019s Legal Standing<\/h2>\n<p>So why are the alternate electors for Trump four years later being rounded up as criminals? <\/p>\n<p>\u201cThese are politically motivated political prosecutors, certainly in the case of <a href=\"https:\/\/www.heritage.org\/crime-and-justice\/commentary\/the-georgia-fake-electors-scheme-what-does-legal-and-political-history\" target=\"_blank\" rel=\"noreferrer noopener\">Fani Willis<\/a> in Atlanta. And it\u2019s the same thing in Arizona,\u201d von Spakovsky said. <\/p>\n<p>But leftists have tried \u2014 and failed \u2014 to push their phony \u201cfake electors\u201d lawfare scheme elsewhere. <\/p>\n<p>In Pennsylvania, even far-left Democrat Gov. Josh Shapiro, the Keystone State\u2019s attorney general at the time, was <a href=\"https:\/\/www.timesleader.com\/news\/1538076\/shapiros-office-gop-elector-plan-not-illegal-but-misleading\" target=\"_blank\" rel=\"noreferrer noopener\">forced by the facts to concede<\/a> that \u201cour office does not believe this meets the legal standards for forgery.\u201d The Trump alternate electors there specified that <em>if<\/em> the courts later determine that they are the \u201c<a href=\"https:\/\/www.spotlightpa.org\/news\/2023\/07\/pennsylvania-trump-fake-electors-jan-6-committee-charges-explainer\/\" target=\"_blank\" rel=\"noreferrer noopener\">duly elected and qualified electors<\/a>,\u201d their certification of the election for Trump would then be considered valid. <\/p>\n<p>Like the alternate electors in other swing states where the election results were questioned, the Pennsylvania stand-ins have said they wanted to be in position by the statutory deadline in case the Trump campaign won its legal challenges. The campaign didn\u2019t win, but that doesn\u2019t make the legal strategy illegal, von Spakovsky said. <\/p>\n<p>In Wisconsin, the Wisconsin Elections Commission <a href=\"https:\/\/apnews.com\/article\/wisconsin-fake-electors-trump-2020-062c7b6638b945f816185bdf1f231195\" target=\"_blank\" rel=\"noreferrer noopener\">twice rejected complaints<\/a> from a leftist lawfare group about Republican alternate electors. Interestingly, the Wisconsin Department of Justice, led by far-left Democrat Attorney General <a href=\"https:\/\/www.doj.state.wi.us\/exec-profile\/josh-kaul\" target=\"_blank\" rel=\"noreferrer noopener\">Josh Kaul,<\/a> said the Republicans who attempted to cast electoral voters for Trump did not violate any election laws. <\/p>\n<p>\u201cThe state Justice Department concluded that Republicans were legitimately trying to preserve Trump\u2019s legal standing as courts were deciding if he or Biden won the election,\u201d the Associated Press <a href=\"https:\/\/apnews.com\/article\/wisconsin-fake-electors-trump-2020-062c7b6638b945f816185bdf1f231195\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>. What happened in Wisconsin, which was involved in a recount in the days after the election, is the same strategy employed in Arizona, Nevada, Michigan, and the other states Trump was contesting. <\/p>\n<h2 class=\"wp-block-heading\">\u2018Kennedy was a Democrat\u2019<\/h2>\n<p>Curiously,\u00a0as the 2020 election sequel is set, reports suggest Kaul may be changing his tune. A spokeswoman for the AG recently <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/elections\/2024\/04\/26\/wisconsin-could-prosecute-trump-2020-fake-electors\/73452583007\/\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> USA Today that the department \u201cdoes not confirm or deny the existence of an investigation\u201d but that Kaul \u201cbelieves that those who committed crimes in an effort to unlawfully subvert the outcome of an election\u00a0should be held accountable.\u201d<\/p>\n<p>Special prosecutor Jack Smith is leading the politically driven federal <a href=\"https:\/\/thefederalist.com\/2024\/04\/19\/last-week-in-lawfare-land-jury-selection-dueling-schedules-and-a-big-scotus-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">conspiracy and obstruction charges<\/a> against Trump over his actions on Jan. 6, 2021. Smith <a href=\"https:\/\/sourcenm.com\/2023\/08\/17\/new-mexico-attorney-general-working-with-jack-smith-to-investigate-fake-elector-scheme\/\" target=\"_blank\" rel=\"noreferrer noopener\">reportedly<\/a> has been working with the New Mexico attorney general\u2019s office, which in January <a href=\"https:\/\/apnews.com\/article\/new-mexico-fake-electors-9ec6f35313c6bbfe8f1ac65e8d5b323c\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a> that alternate electors there could not be charged because they did not break election law. <\/p>\n<p>Still, the plot thickens in the attempt to cancel President Joe Biden\u2019s opponent in November\u2019s general election. And Big Tech and the accomplice media are ready to assist. As CNN <a href=\"https:\/\/www.cnn.com\/2024\/04\/29\/politics\/michigan-search-warrants-google-twitter-2020-fake-electors\/index.html#:~:text=Google%20and%20X,%20formerly%20Twitter,a%20major%20role%20in%20the\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> this week, Google and X have delivered \u201chundreds of files to Michigan prosecutors for their 2020 election subversion probe, complying with search warrants that investigators obtained after <a href=\"https:\/\/www.cnn.com\/2024\/02\/26\/politics\/kenneth-chesebro-secret-twitter-account-kfile\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">CNN revealed secret social media accounts<\/a> belonging to pro-Trump lawyer Kenneth Chesebro, who played a major role in the fake electors plot.\u201d<\/p>\n<p>These Democrats are prosecuting Republicans for the same thing Democrats did in 1960.
