Despite resistance, legal actions by \u200dconservative groups and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/chinese-state-media-promote-pro-hamas-propaganda\/\" title=\"Chinese state media promotes pro-Hamas propaganda\">media outlets aim<\/a> to obtain the \u200drecordings \u2063for\u200b transparency on Biden&#8217;s mental fitness and decision-making. Newsom\u2019s Side\">facing mounting pressure<\/a> from <a href=\"https:\/\/www.washingtonexaminer.com\/news\/house\/2937347\/republicans-threaten-garland-contempt-biden-classified-documents\/\" target=\"_blank\" rel=\"noopener\" title>Congress<\/a> and various organizations to provide audio recordings of President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\" target=\"_blank\" rel=\"noopener\" title=\"Joe Biden\">Joe Biden<\/a>\u2019s interview with the special counsel who investigated his handling of classified documents.<\/p>\n<p>The DOJ has thus far resisted the requests from House Judiciary Committee Chairman Jim Jordan (R-OH), House Oversight Committee Chairman James Comer (R-KY), conservative groups such as Judicial Watch, and CNN, resulting in escalating legal pursuits, a tense impasse with Congress, and healthy doses of criticism.<\/p>\n<p>\u201cThis is yet another brazen cover-up,\u201d Judicial Watch President Tom Fitton said in a statement Tuesday. \u201cThe Biden Justice Department\u2019s political gambit in asserting Joe Biden\u2019s privacy concerns in order to withhold audio of his criminal interviews with the special counsel really takes the cake.\u201d<\/p>\n<p>Judicial Watch, as well as the Heritage Foundation and CNN, have filed legal complaints in an attempt to enforce Freedom of Information Act requests for the recordings, which feature Biden interviewing with former special counsel Robert Hur about how the president handled classified material from when he was vice president and senator.<\/p>\n<p>Hur found after a yearlong investigation that Biden mishandled classified documents as well as <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-pentagon-pick-colin-kahl-denies-leaking-classified-information-on-social-media\/\" title=\"Biden Pentagon Pick Colin Kahl Denies Leaking Classified Information on Social Media\">disclosed classified information<\/a> to the ghostwriter of his 2017 book, <em>Promise Me, Dad<\/em>.<\/p>\n<p>However, based on the interview Hur conducted with Biden, Hur found that the president might give a jury reasonable doubt that he acted willfully because he came off as a \u201csympathetic, well-meaning, elderly man with a poor memory.\u201d The president\u2019s mental acuity was one reason Hur said he declined to prosecute Biden.<\/p>\n<p>The DOJ did provide to Congress a redacted transcript of Hur\u2019s interview with Biden, and the transcript confirmed the president did indeed have memory lapses at times. At other times, though, Biden was quick-witted and recalled information without a problem.<\/p>\n<p>Audio recordings of the interview could shed additional light on the president\u2019s mental fitness, revealing the pace at which he spoke, filler words, or other exchanges not captured through a written transcript.<\/p>\n<p>According to court papers <a href=\"https:\/\/www.judicialwatch.org\/wp-content\/uploads\/2024\/04\/JW-v-DOJ-Biden-Hur-Interview-refusal-00700-1.pdf\" target=\"_blank\" rel=\"noopener\" title>filed<\/a> Tuesday, the DOJ is preparing to fight Judicial Watch, Heritage, and CNN in a joint lawsuit over its position that the audio recordings are exempt from being made public under FOIA because of privacy provisions and concern for the chilling effect it could have on law enforcement.<\/p>\n<p>\u201cObviously, the public\u2019s right to know outweighs Joe Biden\u2019s privacy in this widely public case,\u201d Fitton said.<\/p>\n<p>In recent letters to Congress obtained by the <em>Washington Examiner<\/em>, a DOJ spokesman emphasized the department had already provided most of the material Jordan and Comer requested and that providing the audio could hinder future DOJ investigations by discouraging witnesses from talking to law enforcement.<\/p>\n<p>\u201cThe Committees have already received the extraordinary accommodation of the transcripts, which gives you the information you say you need,\u201d Carlos Uriarte, an assistant attorney general, wrote to the chairmen on April 8. \u201cTo go further by producing the audio files would compound the likelihood that future prosecutors will be unable to secure this level of cooperation. They might have a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/garland-risks-contempt-of-congress-as-doj-spurns-house-gop-demand-for-biden-audio\/\" title=\"Garland faces potential contempt of Congress as DOJ rejects House GOP's request for Biden audio\">harder time obtaining consent<\/a> to an interview at all. It is clearly not in the public interest to render such cooperation with prosecutors and investigators less likely in the future.\u201d<\/p>\n<p>The chairmen, dissatisfied, responded by <a href=\"https:\/\/www.washingtonexaminer.com\/news\/house\/2937347\/republicans-threaten-garland-contempt-biden-classified-documents\/\" target=\"_blank\" rel=\"noopener\" title>threatening<\/a> contempt of Congress, leading Uriarte to reiterate the department\u2019s stance on April 25 and claim contempt would be illegitimate because of Jordan and Comer\u2019s \u201cinability to identify a need for these files.\u201d<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong> <\/p>\n<p>\u201cWe have also repeatedly urged the Committees to avoid unnecessary conflict and to respect the public interest in the Department\u2019s ability to conduct effective investigations by protecting sensitive law enforcement files,\u201d Uriarte wrote.<\/p>\n<p>The stalemate signals Congress\u2019s next moves will be to begin contempt proceedings or negotiate some middle ground with the department, while in court, organizations aiming to obtain the recordings from the DOJ could see legal proceedings play out well into the summer.<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Congress and organizations pressuring the DOJ for audio recordings of President Biden&#8217;s interview with the special counsel investigating his handling of classified documents.
