The 12th Amendment restricts a ticket \u200bwith two candidates \u2062from the same state.\u2063 Choosing Rubio could leverage Latino voter\u200d support and also exert pressure on Gov. Ron \u2064DeSantis. This strategic \u2062move might\u200d involve Rubio resigning as senator, leading to\u200b a \u2063unique\u200b political scenario in Florida.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>A <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/florida\/\" target=\"_blank\" rel=\"noopener\" title>Floridian<\/a> may not be the easiest choice for <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/vice-president\/\" target=\"_blank\" rel=\"noopener\" title>vice president<\/a> for former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\" target=\"_blank\" rel=\"noopener\" title>Donald Trump<\/a>, but that\u2019s not stopping him from considering <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/marco-rubio\/\" target=\"_blank\" rel=\"noopener\" title>Sen. Marco Rubio<\/a> (R-FL) to be his right-hand man. <\/p>\n<p>Trump has a long list of people he is rumored to be <a href=\"https:\/\/www.cbsnews.com\/news\/trumps-potential-vp-picks\/\" target=\"_blank\" rel=\"noopener\" title>considering<\/a> for the vice presidency, including Rubio, Sen. J.D. Vance (R-OH), Sen. Tim Scott (R-SC), and Gov. Doug Burgum (R-ND). However, the 12th Amendment may complicate his pick if he moves forward with Rubio. <\/p>\n<p>The 12th Amendment <a href=\"https:\/\/www.tampabay.com\/news\/florida-politics\/elections\/2024\/04\/29\/can-trump-pick-vice-president-florida\/\" target=\"_blank\" rel=\"noopener\" title>prohibits a ticket<\/a> with two people from the same state being voted upon by that state. <\/p>\n<p>\u201cThe Electors shall meet in their respective states and vote by ballot for President and Vice-President, one of whom, at least, shall not be an inhabitant of the same state with themselves,\u201d the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/oregon-dems-use-recycling-bill-to-codify-equity-definition\/\" title=\"Oregon Dems Use Recycling Bill To Codify \u2018Equity\u2019 Definition\">amendment reads<\/a>.<\/p>\n<p>Because both men are Floridians, Florida\u2019s 30 Electoral College members would not be allowed to vote for a Trump-Rubio ticket. Florida makes up about 11% of the Electoral College, and the 2024 general election is slated to be another close race between Trump and President Joe Biden.<\/p>\n<p>But picking Rubio as a running mate would have a couple of advantages for Trump. Not only would his former 2016 rival give him in-roads with Latino voters, but Rubio\u2019s position as a sitting senator would give the former president a chance to turn the screws on Gov. Ron DeSantis (R-FL).<\/p>\n<p>Although the two Florida men have appeared to make amends following a bruising 2024 primary fight that featured DeSantis turning on Trump and challenging him for the party\u2019s nomination, it isn\u2019t clear that Trump has forgiven the governor. <\/p>\n<p>If Trump selected Rubio as his No. 2, there\u2019s a chance Trump would tell the senator to resign his seat in the upper chamber immediately, forcing a contest for the slot, instead of allowing DeSantis to appoint someone to finish out the term. This would mean Florida would have had both Senate races in the same year, which hasn\u2019t occurred since 1936.<\/p>\n<p>\u201cTrump doesn\u2019t want Ron to get a Senate pick,\u201d a Trump adviser <a href=\"https:\/\/www.thebulwark.com\/p\/trump-vp-shortlist-marco-rubio\" target=\"_blank\" rel=\"noopener\" title>said<\/a>. \u201cAnd if Trump really wants Rubio on the ticket, he\u2019ll want to make sure Ron\u2019s pick is as short-lasting as possible.\u201d<\/p>\n<p>However much Trump might want to take a swing at DeSantis, the problem of essentially giving up Florida\u2019s 30 Electoral College votes has deterred him so far.<\/p>\n<p>\u201cTrump respects Marco, and if it wasn\u2019t for the residency issue, Marco would probably get it,\u201d one Republican who spoke recently to Trump <a href=\"https:\/\/www.thebulwark.com\/p\/trump-vp-shortlist-marco-rubio\" target=\"_blank\" rel=\"noopener\" title>said<\/a>. \u201c[Trump] is concerned about it. He said Rubio\u2019s people have a memo showing it\u2019s not a problem, but I\u2019m not sure he\u2019s convinced.\u201d<\/p>\n<p>The former president could decide the juice is worth the squeeze and either change his own residency to New York, where he is staying during his hush money trial, or New Jersey, where one of his favorite golf courses is. But it\u2019s unlikely he will step aside to make room for someone running beneath him on the ticket \u2014 or abandon the tax- and politics-friendly confines of Florida.<\/p>\n<p>This isn\u2019t the first time a president has considered selecting a fellow state resident to join him on the ticket, forcing a shuffling of addresses. A similar situation happened in the <a href=\"https:\/\/www.politifact.com\/factchecks\/2015\/apr\/16\/lawrence-odonnell\/president-vice-president-same-state-allowed\/\" target=\"_blank\" rel=\"noopener\" title>2000 election<\/a>, in which George W. Bush and Dick Cheney had called Texas home in the run-up to the nomination,\u201d said Robert Bennett, a law professor at Northwestern University.<\/p>\n<p>Cheney ended up moving his residency to Wyoming to avoid a problem.
