Legal battles contest the administration&#8217;s broadening of\u200c sex discrimination under Title IX, particularly concerning transgender policies in \u200bschools and sports, predicting \u200dpotential\u200b setbacks for the government \u2062in federal courts.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<h2>Biden admin rule replaces &#8216;sex&#8217; with &#8216;gender identity&#8217; and classifies &#8216;misgendering&#8217; as sexual harassment<\/h2>\n<figure><figcaption> \t\t\t\t \t\t\t\t(Photo by Alex Wong\/Getty Images)\t\t\t<\/figcaption><\/figure>\n<\/p><\/div>\n<div>\n<p>Red states and women\u2019s groups hit President Joe Biden with four <a href=\"https:\/\/www.iwf.org\/wp-content\/uploads\/2024\/04\/IWF-IWLC-PDE-SF-AL-FL-GA-SC-vs-Cardona-DeptofEducation.pdf\" target=\"_blank\" rel=\"noopener\">lawsuits<\/a> Monday and Tuesday over his overhaul of the federal Title IX ban on sex discrimination in schools and universities. The rule, slated to take effect August 1, replaces sex with gender identity in what the lawsuits say will allow males into female spaces and could punish staff or students who &#8220;misgender&#8221; a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jeremys-chocolate-celebrates-1-year-of-saying-no-to-woke-candy-companies\/\" title=\"Jeremy's Chocolate marks 1 year of rejecting woke candy companies\">trans-identifying colleague<\/a> or peer.<\/p>\n<p>&#8220;Forcing a young girl to change clothes in front of a boy or man in a locker room is entirely antithetical to the dignity and respect that Title IX was intended to preserve and advance,&#8221; a <a href=\"https:\/\/www.ag.state.la.us\/Files\/Article\/13219\/Documents\/File-Stamped-Louisianav.U.S.DeptofEducationTitleIX.pdf\" target=\"_blank\" rel=\"noopener\">complaint<\/a> from Louisiana, Mississippi, Montana, and Idaho says. &#8220;So, too, is forcing children of opposite sexes to share adjoining stalls in the traditionally private space of a bathroom. These are not close questions.&#8221;<\/p>\n<p>The lawsuits allege that <a href=\"https:\/\/www2.ed.gov\/about\/offices\/list\/ocr\/docs\/t9-unofficial-final-rule-2024.pdf\" target=\"_blank\" rel=\"noopener\">Biden\u2019s regulation<\/a> violates free speech rights, given that it renders as sex-based harassment the refusal to call trans-identifying students by their chosen names and pronouns, or the guarantee of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ohio-public-school-district-spends-134000-in-legal-fees-on-permits-for-gender-neutral-bathrooms\/\" title=\"Ohio Public School District Spends 4,000 In Legal Fees On Permits For \u2018Gender-Neutral\u2019 Bathrooms\">single-sex bathrooms<\/a>, locker rooms, or activities. They argue it also represents administrative overreach, since the policy unilaterally overrides Congress\u2019s original sex-based protections. Texas, which <a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/images\/press\/Title%20IX%20Complaint%20FIled.pdf\" target=\"_blank\" rel=\"noopener\">filed its own complaint<\/a>, notes the policy can only be enforced subjectively, since &#8220;anyone who may even only temporarily or intermittently \u2026 identify&#8221; as transgender can claim it as grounds for complaints.<\/p>\n<p>The court battles come as additional lawsuits and controversies pile up around the country to challenge the same &#8220;gender identity&#8221; policies that Biden wants to take nationwide. College female athletes <a href=\"https:\/\/www.cbsnews.com\/news\/riley-gaines-college-athletes-lawsuit-ncaa-transgender-policies\/\" target=\"_blank\" rel=\"noopener\">are suing <\/a>the NCAA over its policies to allow trans-identifying males to compete in women\u2019s sports. In West Virginia, middle school girls who <a href=\"https:\/\/twitter.com\/Riley_Gaines_\/status\/1781150007858470913\" target=\"_blank\" rel=\"noopener\">refused to compete <\/a>against a trans-identifying male in a track-and-field meet to protest unfairness <a href=\"https:\/\/westvirginiawatch.com\/2024\/04\/29\/morrisey-files-brief-supporting-wv-students-who-protested-competing-with-transgender-athlete\/#:~:text=West%20Virginia%20Attorney%20General%20Patrick,recent%20federal%20appeals%20court%20ruling.\" target=\"_blank\" rel=\"noopener\">have been blocked<\/a> from future competitions\u2014spurring a lawsuit from the state\u2019s attorney general to support the girls.<\/p>\n<p>In Virginia, meanwhile, parents of a girl who was sexually assaulted by a teen boy in her high school bathroom filed a $30 million civil rights <a href=\"https:\/\/www.loudounnow.com\/news\/30m-title-ix-lawsuit-filed-against-loudoun-school-board\/article_1b04df9a-6471-11ee-99d9-1b046d9d50d8.html\">lawsuit<\/a> against the district where it happened. In Colorado, parents whose 11-year-old daughter was forced to share a bed with a boy on an overnight field trip have filed <a href=\"https:\/\/adflegal.org\/article\/colorado-school-district-kept-parents-dark-over-gender-identity-rooming-scheme\" target=\"_blank\" rel=\"noopener\">legal letters<\/a> demanding answers from the school.<\/p>\n<p>Ilya Shapiro, director of constitutional studies at the Manhattan Institute, noted that the lawsuits will likely deal a blow to the Biden administration, given the seriousness of the allegations and the fact they\u2019re filed in federal courts\u2014such as Texas and Alabama\u2014that are &#8220;likely to give them a fair shake.&#8221;<\/p>\n<p>&#8220;I think there will be rulings adverse to the government,&#8221; Shapiro said. &#8220;I think there are very strong claims about the various redefinitions under Title IX-expansion of what sex-based discrimination is, and the changes in due process, and the chilling of speech. All three of those aspects are in serious legal jeopardy.&#8221;<\/p>\n<p>Biden\u2019s regulation would revamp Congress\u2019s original ban on sex discrimination to encompass discrimination based on &#8220;sex stereotypes, sex characteristics, pregnancy, sexual orientation, and gender identity.&#8221; Schools or universities that don\u2019t allow students into the sex-segregated locker rooms, restrooms, or activity of their choice based on gender identity would <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-city-declares-itself-sanctuary-city-from-federal-overreach\/\" title=\"California City Declares Itself Sanctuary City From Federal Overreach\">lose federal funding<\/a>. Harassment punishable under Title IX would include &#8220;misgendering&#8221; anyone who claims a new gender identity. It also limits legal defenses for those accused of sexual harassment.<\/p>\n<p>The rule has been in the works since the start of Biden\u2019s term in office and promotes ideas that are nationally unpopular among voters of both parties. A <a href=\"https:\/\/news.gallup.com\/poll\/507023\/say-birth-gender-dictate-sports-participation.aspx\" target=\"_blank\" rel=\"noopener\">Gallup poll<\/a> from last year, for example, found that 69 percent of Americans think athletes should compete on teams that match their sex, not gender identity. More than 240,000 groups and people wrote to the administration about the policy after it was proposed, with most registering their dismay.<\/p>\n<p>Shapiro said this contentiousness likely explains why it took so long for Biden to release the final version\u2014and also why he didn\u2019t wait until the eve of the election.<\/p>\n<p>&#8220;It\u2019s not a vote-getting mechanism\u2014it\u2019s just something the administration or enough of the relevant decision makers are committed to, and want to use their powers for,&#8221; he said.<\/p>\n<p>A spokesman for the Department of Education declined to comment on pending litigation, but said the agency &#8220;crafted the final Title IX regulations following a rigorous process.&#8221;\t<\/p>\n<p>&#8220;As a condition of receiving federal funds, all federally-funded schools are obligated to comply with these final regulations and we look forward to working with school communities all across the country to ensure the Title IX guarantee of nondiscrimination in school is every student\u2019s experience,&#8221; he said.<\/p>\n<p>On Monday, White House press secretary Karine Jean-Pierre addressed the controversial rule by saying &#8220;every student deserves a right to feel safe in school.&#8221;<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Biden&#8217;s Admin Replaces &#8216;Sex&#8217; with &#8216;Gender Identity&#8217; in Title IX, Faces Lawsuits from Red States and Women&#8217;s Groups.
