The complaint, lodged with the DOJ, states that Smith&#8217;s \u2064expedited trial plans breach DOJ guidelines. \u2062Stefanik argues that Smith&#8217;s actions are a deliberate \u200cattempt to disrupt the election process.\u200c New York Representative Elise Stefanik has formally\u200d filed an ethics complaint against Special Counsel Jack Smith, alleging that\u2063 his accelerated\u2064 legal proceedings\u200c targeting ex-President Trump are aimed at\u2064 swaying the \u2062outcome of the 2024 election. The complaint, submitted to the Department of Justice (DOJ), contends that Smith&#8217;s fast-tracked\u200c trial strategy violates DOJ protocols. Elise Stefanik filed an ethics complaint Tuesday alleging Special Counsel Jack Smith\u2019s rushed lawfare campaign against former President Donald Trump is tantamount to election interference. Smith, Stefanik said, has been \u201cabusing the resources of the federal government to unlawfully interfere with the 2024 presidential election.\u201d<\/p>\n<p>The <a href=\"https:\/\/eliseforcongress.com\/wp-content\/uploads\/2024\/04\/Jack-Smith-Complaint-to-USDOJ-OPR-0429.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">complaint<\/a>, filed with the Office of Professional Responsibility within Biden\u2019s Department of Justice (DOJ), argues Smith is attempting to rush the trial of Trump <a href=\"https:\/\/thefederalist.com\/2024\/04\/09\/last-week-in-lawfare-land-what-to-know-about-each-legal-crusade-against-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">regarding his speech<\/a> about the 2020 election ahead of this November\u2019s rematch, in violation of the DOJ\u2019s Justice Manual.<\/p>\n<p>Section 9-85.500 of the <a href=\"https:\/\/www.justice.gov\/jm\/jm-9-85000-protection-government-integrity\" target=\"_blank\" rel=\"noreferrer noopener\">manual<\/a> stipulates \u201cfederal prosecutors \u2026 may never select the timing of any action \u2026 for the purpose of affecting any election, or for the purpose of giving an advantage or disadvantage to any candidate or political party.\u201d<\/p>\n<p>Stefanik argues Smith violated the statute in August of 2023 when \u201che petitioned the District Court for a January 2, 2024, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sen-amy-klobuchar-introduces-big-tech-antitrust-bill-proposal\/\" title=\"Sen. Amy Klobuchar Introduces Big Tech Antitrust Bill Proposal\">trial date<\/a>.\u201d Stefanik cites the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/stefanik-accuses-doj-special-counsel-jack-smith-of-attempting-to-interfere-with-2024-election\/\" title=\"Stefanik claims DOJ special counsel Jack Smith meddled in 2024 election\">roughly 13 million pages<\/a> of discovery Trump\u2019s team had to review, alongside other evidence, to argue that Smith\u2019s intended five-month turnaround was an obvious attempt to rush a complex case to get a judgment before Election Day. <\/p>\n<p>\u201cIt\u2019s obvious to any reasonable observer that Jack Smith is trying to interfere with the 2024 election and stop the American people from electing Donald Trump,\u201d Stefanik said in a statement. \u201cAt every turn, he has sought to accelerate his illegal prosecution of President Trump for the clear (if unstated) purpose of trying him before the November election.\u201d<\/p>\n<p>Stefanik also alleges Smith violated the same statute when he unsuccessfully tried to expedite his case against Trump by begging the Supreme Court to grant certiorari before a lower court had rendered a judgment. <\/p>\n<p>\u201cThat Jack Smith was solely motivated by the desire to interfere in the November election was effectively proven two months later\u201d when he opposed Trump\u2019s petition for certiorari on the issue of presidential immunity, Stefanik reasoned. Smith argued the nation had a \u201ccompelling interest in the prompt resolution of this case\u201d in opposing Trump\u2019s petition. <\/p>\n<p>\u201cThe public, respondent, and the government are entitled to nothing less,\u201d Smith <a href=\"https:\/\/cdn01.dailycaller.com\/wp-content\/uploads\/2023\/12\/No.-23-624-U.S.-v.-Donald-J.-Trump-Petition.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">argued<\/a>, despite the fact that the <a href=\"https:\/\/www.law.cornell.edu\/constitution\/sixth_amendment#:~:text=The%20Sixth%20Amendment%20guarantees%20the,charges%20and%20evidence%20against%20you.\">Sixth Amendment<\/a> grants the right to a speedy trial to defendants, not \u201cthe government\u201d or \u201cthe public.\u201d<\/p>\n<p>\u201cAside from the upcoming election, what \u2018compelling interest\u2019 does the public have in the prompt resolution of this case?\u201d Stefanik asked. \u201cWhy should this interest\u2014based on an unstated reason\u2014override the due process rights of a criminal defendant?\u201d<\/p>\n<p>The congresswoman also alleged Smith \u201crepeatedly and deliberately violated\u201d a district court\u2019s stay of proceedings, including when he served an additional nearly 4,000 pages of discovery to Trump\u2019s team. The district court had stayed \u201cany further proceedings that would move this case towards trial or impose additional burdens of litigation on Defendant.\u201d<\/p>\n<p>In addition to the 4,000 pages of discovery, Stefanik pointed to Smith\u2019s decision to file \u201ca motion in limine in District Court\u201d <em>after <\/em>Smith indicated to the Supreme Court that \u201cthe case is now on hold\u201d at the district level. Smith\u2019s \u201crefusal to abide by the District Court\u2019s stay\u201d violated D.C. Rule of Professional Conduct 3.4(c), and his admission to the Supreme Court that the case was \u201con hold\u201d indicated he did so \u201cknowingly,\u201d Stefanik argued.<\/p>\n<p>\u201cJack Smith emphatically said that \u2018no one in this country \u2026 is above the law.\u2019 If that is true, then he should be open to, and welcome, an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sen-hawley-files-counter-complaint-against-senate-dems\/\" title=\"Sen. Hawley files counter-complaint against Senate Dems\">ethics investigation<\/a> into conduct that, on its face, implicates potential violations of DOJ policy and multiple rules of professional conduct,\u201d Stefanik wrote. \u201cBiden special counsel Jack Smith\u2019s highly unusual and clearly improper attempts to expedite trial, and his blatant violation of District Court orders, evidence his partisan attempt to influence the results of the 2024 presidential election.\u201d<\/p>\n<p>Florida Rep.
