Amy Klobuchar Introduces Big Tech Antitrust Bill Proposal\">trial date<\/a> proposed \u200bby Smith.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>House Republican Conference Chairwoman <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/elise-stefanik\/\" target=\"_blank\" rel=\"noopener\" title=\"Elise Stefanik\">Elise Stefanik<\/a> (R-NY) is <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2636488\/stefanik-demands-ethics-inquiry-into-dc-judge-ahead-of-trump-election-interference-trial\/\" target=\"_blank\" rel=\"noopener\" title=\"Elise Stefanik\">demanding an ethics investigation<\/a> into Justice Department special counsel Jack Smith, accusing him of attempting to expedite former President Donald Trump\u2019s Jan. 6 criminal case in order to interfere with the 2024 election. <\/p>\n<p><a href=\"https:\/\/www.scribd.com\/document\/727855082\/Stefanik-Complaint-Against-Jack-Smith\" target=\"_blank\" rel=\"noopener\" title>In an ethics complaint<\/a> submitted on Tuesday, Stefanik accused Smith of pushing for an accelerated trial in violation of the U.S. District Court for the District of Columbia, which the chairwoman argued was a \u201clawless breach of trial ethics.\u201d The complaint demands an investigation into Smith for possible misconduct and unlawful interference with the election. <\/p>\n<p>\u201cJack Smith\u2019s actions brought disrepute to the Justice Department and the federal government as a whole, and he should face discipline appropriately,\u201d Stefanik wrote in the complaint, which was obtained by the <em>Washington Examiner. <\/em>\u201cPresident Trump is now the presumptive Republican nominee for President, having won enough delegates to secure the nomination on March 12, 2024. As we will demonstrate, Biden special counsel Jack Smith is attempting to expedite the trial in order to influence the general election in November.\u201d<\/p>\n<p>Stefanik pointed to several instances in which Smith pushed for a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/theres-hunter-hunter-biden-appears-in-court-for-paternity-dispute\/\" title=\"There's Hunter: Hunter Biden Appears in Court for Paternity Dispute\">trial start date<\/a> far ahead of the election, accusing the special counsel of failing to apply the law and instead seeking to \u201cget President Trump \u2014 and get him before November.\u201d <\/p>\n<p>Smith first petitioned the district court to begin the trial on Jan. 2, prompting pushback from Trump\u2019s legal team, who argued they needed adequate time to review roughly 13 million pages of discovery as well as thousands of hours of camera footage. Smith requested the trial date in August 2023, which would have given Trump\u2019s team five months to prepare. <\/p>\n<p>\u201cProsecutors bringing a case of this complexity\u2013with so many consequential and novel legal issues to sort out\u2013would normally never seek to bring it to trial within five months,\u201d Stefanik wrote. \u201cThe only reason to push for such an early trial date was to work to get the case tried before the November election, and the Justice Department Manual clearly forbids Jack Smith from taking any action on that basis.\u201d<\/p>\n<p>Stefanik also accused Smith of unfairly rejecting a request by Trump to dismiss the trial on the basis of presidential criminal immunity for official acts. Smith declined Trump\u2019s petition for certiorari, claiming there was \u201ca compelling interest in the prompt resolution of this case.\u201d<\/p>\n<p>Stefanik pushed back against that notion, accusing Smith of overriding \u201cthe due process rights of a criminal defendant\u201d in an attempt to harm his presidential campaign. <\/p>\n<p>\u201cJack Smith has not talked about the election in his filings because it is an obviously improper reason to expedite President Trump\u2019s trial,\u201d Stefanik wrote. \u201cBiden special counsel Jack Smith\u2019s actions, however, leave no doubt that the election is driving his timing decisions. No other plausible reason exists for why he is rushing this case against a criminal defendant in a manner inconsistent with the Justice Department\u2019s usual practice.\u201d<\/p>\n<p>The complaint comes as the Supreme Court is set to decide on Trump\u2019s claims of presidential immunity sometime in the next 60 days. Much of the argument surrounded whether Trump engaged in \u201cprivate\u201d conduct to allegedly subvert <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/2020-elections\" target=\"_blank\" rel=\"noreferrer noopener\">an election<\/a>, which wouldn\u2019t be protected, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-seems-open-to-middle-ground-on-trump-immunity\/\" title=\"Supreme Court signals willingness to consider middle ground on Trump's immunity\">versus \u201cofficial\u201d acts<\/a> that would carry with them protection from prosecution.<\/p>\n<p>If the justices do agree to send the case back to a lower court to weigh which acts were official or not official, it could further delay Trump\u2019s trial as he mounts his <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/2024-elections\" target=\"_blank\" rel=\"noreferrer noopener\">2024 reelection bid<\/a>.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\"><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/news\/2636488\/stefanik-demands-ethics-inquiry-into-dc-judge-ahead-of-trump-election-interference-trial\/\" target=\"_blank\" rel=\"noopener\" title>This is not the first time<\/a> Stefanik has gotten involved in Trump\u2019s legal troubles. The fourth highest-ranking House Republican has submitted several <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/watchdog-accuses-three-house-democrats-of-ethics-violations\/\" title=\"Watchdog Accuses Three House Democrats of Ethics Violations\">ethics complaints<\/a> against judges involved in the former president\u2019s Jan. 6 Capitol riot case, decrying the trial as being politically motivated. <\/p>\n<p>It\u2019s not yet clear whether the Justice Department\u2019s Office of Professional Responsibility will open an investigation into the matter.
