Despite\u200c the outcome, the office emphasized its commitment to prosecuting criminal acts. Kelly, who maintained that he did not shoot Cuen-Buitimea, pled not guilty to a second-degree murder charge in March 2023. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cBecause of the unique circumstances and challenges surrounding this case, the Santa Cruz County Attorney\u2019s Office has decided not to seek a retrial,\u201d said chief deputy Santa Cruz county attorney Kim Hunley. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cHowever, our office\u2019s decision in this case should not be construed as a position on future cases of this type,\u201d Hunley\u2019s office added. \u201cOur office is mandated by statute to prosecute criminal acts, and we take that statutory mandate seriously.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">The decision not to retry Kelly came after a four-week trial. Kelly\u2019s legal team said that the jury had been 7-1 in favor of the rancher being found not guilty. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cI\u2019m just so happy for them. We got the right answer,\u201dsaid defense lawyer Kathy Lowthorp on Monday, <a href=\"https:\/\/tucson.com\/news\/local\/border\/arizona-border-rancher-mistrial-hung-jury-murder-charge-dismissed\/article_d8c5eedc-0653-11ef-be51-a74a35b43877.html\" target=\"_blank\" rel=\"noopener\">according<\/a> to local media. \u201cI think he\u2019s ready to get out of the area.
