Douglas \u2063Horn, a long-time driver, filed\u2063 the lawsuit, alleging misrepresentation by companies like Medical Marijuana Inc. \u2062The lawsuit includes\u2064 claims of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/actblue-facilitating-donations-to-terror-tied-charity-legal-group-says\/\" title=\"ActBlue Facilitating Donations to Terror-Tied Charity, Legal Group Says\">violating federal laws<\/a> and fraud in the\u200d production of the \u200dDixie X elixir. The Supreme Court will examine a case where \u2063a \u2063truck driver was dismissed for \u2062failing a drug\u200b test due to using a supposedly THC-free CBD product. Douglas Horn, a seasoned \u2062driver, initiated the lawsuit,\u2062 accusing \u200dcompanies such as Medical Marijuana\u200d Inc. of false claims. Allegations encompass breaches of federal \u2063regulations and fraudulent activities in manufacturing \u2062the Dixie X elixir.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div data-td-block-uid=\"tdi_78\">\n<p>The <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a> on Monday agreed to consider whether the maker of a CBD <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/marijuana\/\" target=\"_blank\" rel=\"noopener\" title>marijuana<\/a> product can be sued under the federal Racketeer Influenced and Corrupt Organizations Act after a truck driver said he was fired for using an elixir that made him fail a drug test.<\/p>\n<p>Douglas Horn, who has been a truck driver for 14 years, alleges a CBD elixir advertised to contain no THC, the psychoactive ingredient in marijuana, caused him to fail a drug test that resulted in his termination in 2012. Horn contends that he has never used marijuana or a THC product other than the elixir he used to help alleviate his pain, known as \u201cDixie X.\u201d<\/p>\n<figure><figcaption>This Feb. 17, 2016, file photo shows marijuana plants at a home in Honolulu. (AP Photo\/Marina Riker, File)<\/figcaption><\/figure>\n<p>Horn initially filed suit in the Western District of New York in 2015, alleging in part that Medical Marijuana Inc. and other companies involved in the production and distribution of the elixir known as Dixie X violated the Controlled Substances Act and engaged in mail and wire fraud.<\/p>\n<p>The Supreme Court <a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/042924zor_ihdj.pdf\" target=\"_blank\" rel=\"noopener\" title=\"agreed\">agreed<\/a> to consider whether Horn was allowed to file his lawsuit under the RICO Act, which allows plaintiffs in civil lawsuits to seek triple damages in some instances.<\/p>\n<p>Some <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-to-decide-whether-americans-can-carry-guns-in-public\/\" title=\"Supreme Court To Decide Whether Americans Can Carry Guns in Public\">federal appeals courts<\/a> have held that civil suits cannot be filed based on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-approves-83-million-settlement-for-victims-of-last-years-florida-condo-collapse\/\" title=\"Judge Approves  Million Settlement for Victims of Last Year\u2019s Florida Condo Collapse\">personal injury claims<\/a>, but the U.S. Court of Appeals for the 2nd Circuit allowed the suit to move forward.<\/p>\n<p>\u201cBecause the term \u2018business\u2019 encompasses \u2019employment,\u2019 Horn has suffered an injury \u2018in his business,\u2019 as contemplated by the RICO statute,\u201d\u00a0Circuit Judge Gerard Lynch <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-365\/284014\/20231003113235969_Horn%20Petition%20for%20Certiorari%20-%20Appendix.pdf\" target=\"_blank\" rel=\"noopener\" title=\"wrote\">wrote<\/a> for a three-judge panel, adding that the truck driver\u2019s termination \u201ccost him current and future wages and his insurance and pension benefits \u2014 all of which were tied to his employment.\u201d<\/p>\n<p>Medical Marijuana Inc. appealed to the Supreme Court in October, arguing that the RICO Act was never intended to be used in this way and that allowing the case to move forward would expand the number and type of \u201ccivil RICO\u201d lawsuits.<\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>President Richard Nixon initially signed the RICO Act in 1970 to open up more avenues for the federal government to tackle heads of organized crime.
