Biden administration argues\u2064 that Idaho&#8217;s\u200b ban contradicts EMTALA, risking hospital \u200cfunding. Alito highlighted the federal law&#8217;s \u200cmention \u2064of &#8220;unborn child,&#8221; questioning \u2064its role in abortion mandates.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>Justice <a href=\"https:\/\/www.dailywire.com\/topic\/samuel-alito\" target=\"_blank\" rel=\"noopener\">Samuel Alito<\/a> revived the legal debate about fetal personhood this week during oral arguments for the Idaho abortion case currently before the Supreme Court.<\/p>\n<p>The Idaho case deals with whether Idaho emergency room doctors are required by federal law to perform abortions to stabilize pregnant women in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bro-time-with-ben-shapiro-and-jordan-peterson\/\" title=\"Bro Time With Ben Shapiro And Jordan Peterson\">medical crises<\/a>. Idaho bans all abortions except to save the life of the mother or in cases of rape and incest.<\/p>\n<p>The case is the first time the high court has considered whether a state abortion ban is constitutional since the demise of <em>Roe v. Wade<\/em>.<\/p>\n<p>In the Idaho case, the Biden administration is arguing that Idaho\u2019s abortion ban flies in the face of a federal law, the Emergency Medical Treatment &#038; Labor Act, known as EMTALA, which <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/heres-whats-happening-in-the-idaho-abortion-case-at-the-supreme-court\/\" title=\"Latest Updates on Idaho Abortion Case at Supreme Court\">requires hospitals receiving federal funds<\/a> to provide patients with stabilizing care. Hospitals that flout the law are at risk of losing their Medicare funding.<\/p>\n<p>Meanwhile, Idaho officials counter that the Biden administration is simply trying to undermine the state\u2019s abortion ban.<\/p>\n<p>Alito drew the court\u2019s attention to the federal law\u2019s reference to the \u201cunborn child.\u201d<\/p>\n<p>\u201cIsn\u2019t that an odd phrase to put in a statute that imposes a mandate to perform abortions?\u201d Alito <a href=\"https:\/\/thehill.com\/policy\/healthcare\/4622500-alito-fetal-rights-idaho-abortion-case\/\" target=\"_blank\" rel=\"noopener\">asked<\/a> Solicitor General Elizabeth Prelogar.<\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1700760801843000&#038;usg=AOvVaw2PQrVSrJfhxNb4LcARqniG\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p>\u201cThe hospital must stabilize the threat to the unborn child, and it seems that the plain meaning is that the hospital must try to eliminate any immediate threat to the child, but performing an abortion is antithetical to that duty,\u201d Alito said.<\/p>\n<p>The Justice Department pushed back on Alito\u2019s argument, saying hospitals only have a duty to stabilize pregnant women, not their unborn children.<\/p>\n<p>Prelogar said Congress amended the law to add the phrase \u201cunborn child\u201d in order to better <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/louisiana-legislature-passes-bill-to-ban-the-shipment-of-abortion-drugs\/\" title=\"Louisiana Legislature Passes Bill To Ban The Shipment Of Abortion Drugs\">protect pregnant women<\/a>.<\/p>\n<p>\u201cCongress wanted to be able to protect her in situations where she\u2019s suffering some kind of emergency and her own health isn\u2019t at risk, but the fetus might die,\u201d she said.<\/p>\n<p>The focus on fetal personhood was a concern abortion supporters had before the Idaho case reached the high court \u2014 they hoped the case would not be used to advance fetal rights.<\/p>\n<p>The case is being closely watched since the justices\u2019 decision could potentially have broad implications for the more than a dozen states that have enacted strict state abortion bans.<\/p>\n<p>Back in 2022, Alito penned the court\u2019s opinion in the <em>Dobbs<\/em> case overturning <em>Roe vs. Wade<\/em>. His opinion sparked speculation about whether he was trying to bring forth the issue of fetal personhood.<\/p>\n<p>\u201cOur opinion is not based on any view about if and when prenatal life is entitled to any of the rights enjoyed after birth,\u201d he <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/19-1392_6j37.pdf\" target=\"_blank\" rel=\"noopener\">wrote<\/a> in that opinion. \u201cThe dissent, by contrast, would impose on the people a particular theory about when the rights of personhood begin.
