(Etienne Laurent\/Pool Photo via AP)<\/figcaption><\/figure>\n<p>\u201cThis today is an act of institutional betrayal,\u201d actor and activist Ashley Judd said. \u201cOur institutions betray survivors of male sexual violence.\u201d<\/p>\n<p>Judd was one of the first women to accuse Weinstein of sexual harassment publicly.<\/p>\n<p>One accuser, Ambra Battilana Gutierrez, said the decision represented an \u201congoing failure of the justice system \u2014 and the courts \u2014 to take survivors seriously and to protect our interests.\u201d<\/p>\n<p>In 2015, Gutierrez filed a sexual abuse complaint against Weinstein to the New York Police Department. The following day, NYPD\u2019s Special Victims Division set up a meeting between Gutierrez and Weinstein in which Gutierrez wore a recording device. During their talk, Weinstein admitted to touching her inappropriately and apologized. <\/p>\n<p>New York prosecutors, however, did not deem that as enough evidence to be incriminating, and Gutierrez and Weinstein agreed to an undisclosed settlement. <\/p>\n<p>Another woman, Dawn Dunning, said she was \u201cstunned\u201d when she heard the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/third-degree-murder-charge-against-ex-cop-derek-chauvin-reinstated-by-appeals-court\/\" title=\"Third-Degree Murder Charge Against Ex-Cop Derek Chauvin Reinstated By Appeals Court\">appeals court decision<\/a>.<\/p>\n<p>\u201cPreparing for the trial took two years of my life. I had to relive the trauma of the assault every day. But since today\u2019s ruling, people have asked me if I regret having testified,\u201d Dunning said. \u201cAnd my answer is a resounding, \u2018No.\u2019\u201d<\/p>\n<p>Attorneys Debra S. Katz and Lisa Banks, who represented accusers including Dunning, called on Manhattan District Attorney Alvin Bragg to retry the case. One accuser, Miriam \u201cMimi\u201d Haley, said she would testify again in a new trial, according to her attorney, Gloria Allred.<\/p>\n<p>\u201cEven though the process of testifying was grueling and retraumatizing for Mimi, she reaffirmed to me today that she would consider testifying again if [Manhattan] District Attorney Alvin Bragg decided to proceed with a new trial of Harvey Weinstein,\u201d Allred said.<\/p>\n<p>Dunning remained firm that she had \u201cnothing to gain\u201d by coming forth with the original accusations but was proud of her decision to do so. <\/p>\n<p>\u201cI had nothing to gain and much to lose in terms of loss of privacy and the trauma that comes with confronting one\u2019s abuser in court. I am a stronger person for having done so, and I know that other women found strength and courage because I and other Weinstein survivors confronted him publicly. The culture has changed, and I am confident that there is no going back,\u201d Dunning said.<\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>In 2020, Weinstein was sentenced to 23 years in prison on first<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lets-go-bro-shes-waking-up-2-nypd-officers-arrested-for-allegedly-assaulting-woman-while-off-duty\/\" title=\"Two NYPD Officers Arrested for Alleged Off-Duty Assault on Waking Woman\">-degree criminal sexual act<\/a> and third-degree rape charges. He was found guilty in a separate case in California for sexual assault charges and was <a href=\"https:\/\/www.washingtonexaminer.com\/news\/114903\/harvey-weinstein-sentenced-to-16-more-years-in-prison-for-sexual-assault-charges\/\" target=\"_blank\" rel=\"noreferrer noopener\">sentenced<\/a> to 16 years in prison.<\/p>\n<p>On Thursday, the\u00a0appeals court\u00a0ruled 4-3 that the judge had made \u201cegregious errors\u201d with how the trial was conducted, specifically testimony that was allowed in the trial.<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Harvey Weinstein&#8217;s accusers responded to the New York Court of Appeals overturning his 2020 sexual assault conviction.
