<\/span> <span>   April 25, 2024 at 2:51pm <\/span> <\/span>  <\/header>\n<section>\n<p>Disgraced Hollywood mogul Harvey Weinstein\u2019s 2020 rape conviction was overturned by a New York court on Thursday, setting the stage for a retrial.<\/p>\n<p>The New York Court of Appeals ruled that the judge in the notable #MeToo case had prejudiced the jury against Weinstein with incorrect decisions, including allowing testimony from women about accusations not directly related to the charges brought against him, according to the <a href=\"https:\/\/nypost.com\/2024\/04\/25\/us-news\/harvey-weinsteins-felony-sex-crime-charges-overturned-by-nys-highest-court\/\" target=\"_blank\" rel=\"noopener\">New York Post<\/a>.<\/p>\n<p>The state\u2019s highest court \u2014 in a 4-3 ruling \u2014 found that the Manhattan trial judge, James Burke, \u201cerroneously\u201d allowed testimony from three women whose <a href=\"https:\/\/www.westernjournal.com\/legendary-pro-wrestler-rock-star-compared-harvey-weinstein-shocking-allegations-surface\/\" target=\"_blank\" rel=\"noopener\">allegations<\/a> were not connected to the case.<\/p>\n<p>\u201cWe conclude that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/harvey-weinsteins-sexual-assault-conviction-overturned-by-new-york-appeals-court\/\" title=\"New York appeals court overturns Harvey Weinstein's sexual assault conviction\">trial court erroneously admitted testimony<\/a> of uncharged, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/new-york-appeals-court-tosses-harvey-weinstein-rape-conviction\/\" title=\"Appeals Court in New York Overturns Harvey Weinstein's Rape Conviction\">alleged prior sexual acts<\/a> against persons other than the complainants of the underlying crimes because that testimony served no material non-propensity purpose,\u201d the court\u2019s <a href=\"https:\/\/www.nycourts.gov\/ctapps\/Decisions\/2024\/Apr24\/24opn24-Decision.pdf\" target=\"_blank\" rel=\"noopener\">decision<\/a> read.<\/p>\n<p>The appellate decision further criticized the lower court for permitting the cross-examination of Weinstein, who had no prior criminal record, about these allegations and other misconduct claims.<\/p>\n<p>It said these allegations cast him in an extremely negative light.<\/p>\n<p>Judge Jenny Rivera described these judicial mistakes as \u201cegregious\u201d and declared that a new trial was necessary.<\/p>\n<p>\u201cWe reaffirm that no person accused of illegality may be judged on proof of uncharged crimes that serve only to establish the accused\u2019s propensity for criminal behavior,\u201d Rivera, a Democrat, wrote in the court\u2019s majority opinion.<\/p>\n<p>\u201cIt is an abuse of judicial discretion to permit untested allegations of nothing more than bad behavior that destroys a defendant\u2019s character but sheds no light on their credibility as related to the criminal charges lodged against them,\u201d she said.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Do you think Hollywood is fully corrupt?<\/p>\n<\/p><\/div>\n<p>In a dissenting opinion, Judge Madeline Singas criticized the <a href=\"https:\/\/www.westernjournal.com\/harvey-weinsteins-worst-nightmare-judge-clears-way-mel-gibson-take-stand\/\" target=\"_blank\" rel=\"noopener\">majority<\/a> for overturning the ruling and suggested they had altered the narrative to a basic \u201che-said\/she-said\u201d scenario.<\/p>\n<p>She added her belief that the jury could consider Weinstein\u2019s history of assaults.<\/p>\n<p>\u201c[B]y failing to recognize that the jury was entitled to consider defendant\u2019s previous assaults, this Court has continued a disturbing trend of overturning juries\u2019 guilty verdicts in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/horrified-oscar-winner-and-other-hollywood-stars-react-to-overturned-weinstein-rape-verdict\/\" title=\"Shocking: Celebrities Respond to Weinstein Verdict Reversal\">cases involving sexual violence<\/a>,\u201d Singas wrote.<\/p>\n<p>Meanwhile, Weinstein spokesman Juda Engelmayer told <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/harvey-weinsteins-rape-conviction-overturned-rcna149328\" target=\"_blank\" rel=\"noopener\">NBC News<\/a> said he and his team were \u201cthrilled with the court\u2019s decision.\u201d<\/p>\n<p>\u201cWe obviously have a long road ahead of us in California,\u201d Engelmayer added.<\/p>\n<p>The overturning of the initial ruling could mean Weinstein\u2019s <a href=\"https:\/\/www.westernjournal.com\/harvey-weinstein-faces-1-less-sex-assault-charge-thanks-judge\/\" target=\"_blank\" rel=\"noopener\">accusers<\/a> might testify once more.<\/p>\n<p>\u201cThat is unfair to survivors,\u201d actress Ashley Judd told <a href=\"https:\/\/www.nytimes.com\/live\/2024\/04\/25\/nyregion\/harvey-weinstein-appeal?partner=slack&#038;smid=sl-share\" target=\"_blank\" rel=\"noopener\">The New York Times<\/a>. \u201cWe still live in our truth. And we know what happened.\u201d<\/p>\n<p>Judd was the first actress to come forward with allegations against Weinstein.<\/p>\n<p>The 72-year-old producer has been serving a 23-year sentence in a New York correctional facility after he was found guilty of a criminal sex act in 2006 involving forced oral sex on a TV and film production assistant and\u00a0rape in the third degree in a 2013 incident involving an aspiring actress.<\/p>\n<p>Meanwhile, in Los Angeles, Weinstein was tried and convicted of raping an Italian model and <a href=\"https:\/\/www.thewrap.com\/harvey-weinstein-sentenced-los-angeles-rape-trial\/\" target=\"_blank\" rel=\"noopener\">sentenced<\/a> to 16 years in prison in 2023.<\/p>\n<p>That sentence wasn\u2019t scheduled to begin until the New York prison term was completed.<\/p>\n<hr>\n<div>\n<p><b><i>A Note from Our Deputy Managing Editor:<\/i><\/b><\/p>\n<p><i><span>\u201cWe don\u2019t even know if an election will be held in 2024.\u201d Those 12 words have been stuck in my head since I first read them. <\/span><\/i><\/p>\n<p><i><span>Former Lt.
