Cindy Hyde-Smith, R-Miss., <a href=\"https:\/\/thefederalist.com\/2024\/02\/29\/republican-cindy-hyde-smith-blocks-democrats-radical-ivf-bill-but-whiffs-on-the-why\/\" target=\"_blank\" rel=\"noreferrer noopener\">blocked<\/a> a vote on congressional Democrats\u2019 radical assisted reproductive technology bill at the end of February, she cited Louisiana as an example of\u00a0a state with <a href=\"https:\/\/thefederalist.com\/2024\/02\/29\/republican-cindy-hyde-smith-blocks-democrats-radical-ivf-bill-but-whiffs-on-the-why\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201ccommon-sense\u201d in vitro fertilization restrictions<\/a>. Those little protections the 1986 law provided to unborn life, however, are subject to change now that the state House has advanced two bills aimed at shielding fertility facilities that handle and store embryos from liability. <\/p>\n<p>A coalition of Republican and Democrat legislators in Louisiana \u2014 <a href=\"https:\/\/www.washingtonpost.com\/nation\/2024\/03\/03\/louisiana-ivf-embryos-law-alabama\/\" target=\"_blank\" rel=\"noreferrer noopener\">egged on<\/a> <a href=\"https:\/\/www.axios.com\/local\/new-orleans\/2024\/03\/06\/louisiana-ivf-treatment-clinics-embryo-law-alabama\" target=\"_blank\" rel=\"noreferrer noopener\">by corporate media<\/a> and their <a href=\"https:\/\/thefederalist.com\/2024\/02\/23\/fearmongering-about-alabama-supreme-court-embryo-ruling-obscures-truth-about-reproductive-tech\/\" target=\"_blank\" rel=\"noreferrer noopener\">fearmongering<\/a> about the Alabama Supreme Court\u2019s embryo ruling \u2014 advanced two bills this week that seek to overhaul the <a href=\"https:\/\/legis.la.gov\/legis\/Law.aspx?d=108446\" target=\"_blank\" rel=\"noreferrer noopener\">Pelican State\u2019s 1986<\/a> law governing embryos.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-2115663365\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-49cde4197453d7a5cdada9eaa497c5ec fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-49cde4197453d7a5cdada9eaa497c5ec\"><\/div>\n<p>The state\u2019s <a href=\"https:\/\/legis.la.gov\/legis\/Law.aspx?p=y&#038;d=108438\" target=\"_blank\" rel=\"noreferrer noopener\">current statute<\/a> appears to offer embryos protections that other states don\u2019t by classifying them as \u201chuman cells and human genetic material\u201d that \u201cwill develop in utero into an unborn child.\u201d The 1986 law Hyde-Smith praised as \u201ccommon sense,\u201d however, already fell short of the moral and ethical duties posited by the <a href=\"https:\/\/legis.la.gov\/legis\/Law.aspx?d=964985#:~:text=The%20legislature%20does%20solemnly%20declare,state%20and%20Constitution%20of%20Louisiana.\" target=\"_blank\" rel=\"noreferrer noopener\">statewide recognition that life begins at conception<\/a> because it did virtually nothing to stop the serial creation and destruction of embryos.<\/p>\n<p><a href=\"https:\/\/www.axios.com\/local\/new-orleans\/2024\/03\/06\/louisiana-ivf-treatment-clinics-embryo-law-alabama\" target=\"_blank\" rel=\"noreferrer noopener\">Loopholes<\/a> in the 1986 law allow fertility facilities to destroy an embryo as long as it <a href=\"https:\/\/legis.la.gov\/legis\/Law.aspx?d=108446\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cfails to develop further over a thirty-six hour period,\u201d<\/a> is deemed nonviable, or is stored out of state, something a<a href=\"https:\/\/www.washingtonpost.com\/nation\/2024\/03\/03\/louisiana-ivf-embryos-law-alabama\/#:~:text=The%20majority%20of%20Louisiana's%20fertility,of%20embryos%20created%20during%20IVF.\" target=\"_blank\" rel=\"noreferrer noopener\"> majority of Louisiana\u2019s IVF industry<\/a> opts to do. <\/p>\n<p>The statute also does nothing to prevent ethically questionable procedures associated with IVF such as <a href=\"https:\/\/thefederalist.com\/2023\/06\/08\/popular-genetic-testing-pits-unborn-siblings-against-each-other-and-the-highest-scorer-gets-to-live\/\" target=\"_blank\" rel=\"noreferrer noopener\">genetic testing,<\/a> <a href=\"https:\/\/www.hfea.gov.uk\/treatments\/fertility-preservation\/embryo-freezing\/\" target=\"_blank\" rel=\"noreferrer noopener\">cryopreservation (which hurts an embryo\u2019s survival chances),<\/a> or <a href=\"https:\/\/thefederalist.com\/2023\/07\/22\/the-global-fertility-industry-seeks-to-erase-women-from-procreation-one-manufactured-egg-at-a-time\/\" target=\"_blank\" rel=\"noreferrer noopener\">rapidly developing reproductive technologies<\/a>,\u00a0such as <a href=\"https:\/\/thefederalist.com\/2023\/05\/15\/with-artificial-wombs-sci-fi-horrors-would-become-reality\/\" target=\"_blank\" rel=\"noreferrer noopener\">artificial wombs<\/a>, <a href=\"https:\/\/nypost.com\/2022\/12\/10\/how-one-scientist-lost-big-trying-to-genetically-enhance-unborn-babies\/\" target=\"_blank\" rel=\"noreferrer noopener\">gene editing<\/a>, and <a href=\"https:\/\/thefederalist.com\/2023\/07\/22\/the-global-fertility-industry-seeks-to-erase-women-from-procreation-one-manufactured-egg-at-a-time\/\" target=\"_blank\" rel=\"noreferrer noopener\">manufacturing eggs with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-global-fertility-industry-seeks-to-erase-women-from-procreation-one-manufactured-egg-at-a-time\/\" title=\"Global fertility industry erases women from procreation, one artificial egg at a time.\">male stem cells<\/a><\/a>, which threaten to hit the ART markets soon.<\/p>\n<p>Now the state\u2019s lower chamber is considering new legislation that would grant certain immunities to the fertility industry, whose <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lousiana-republicans-democrats-advance-bill-granting-immunity-for-killing-embryos\/\" title=\"Louisiana GOP and Democrats Push Bill for Immunity in Embryo Deaths\">standard practice involves serially creating<\/a> and <a href=\"https:\/\/www.geneticsandsociety.org\/article\/17-million-human-embryos-created-ivf-thrown-away\" target=\"_blank\" rel=\"noreferrer noopener\">discarding<\/a> unlimited embryos.<\/p>\n<div class=\"fdrlst__b89e9-9271a6a2695ea5c737a0f5127be6734c fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-9271a6a2695ea5c737a0f5127be6734c\"><\/div>\n<p>Both pieces of legislation \u2014 <a href=\"https:\/\/legis.la.gov\/legis\/ViewDocument.aspx?d=1367710\" target=\"_blank\" rel=\"noreferrer noopener\">House Bill 833<\/a>, which was written by Republican Rep. Paula Davis and 15 other GOP and Democrat coauthors, and <a href=\"https:\/\/legis.la.gov\/Legis\/ViewDocument.aspx?d=1367601\" target=\"_blank\" rel=\"noreferrer noopener\">House Bill 742<\/a>, which was written by Democrat Rep. Denise Marcelle \u2014 declare that any fertility professional dealing with embryos in \u201cgood faith\u201d can\u2019t be criminally or civilly sued. <\/p>\n<p>HB 833, which the House Civil Law and Procedure Committee <a href=\"https:\/\/archive.ph\/acHOe#selection-4587.4-4587.43\" target=\"_blank\" rel=\"noreferrer noopener\">sent to the full House on Monday<\/a>, does not protect Big Fertility in the state in cases of \u201cgross negligence,\u201d but it intentionally redefines the word \u201cembryo\u201d to remove any reference to \u201cunborn child.\u201d <\/p>\n<p>One lawyer who helped write the legislation <a href=\"https:\/\/www.nola.com\/gambit\/news\/the_latest\/louisiana-house-committee-passes-two-bills-aimed-at-protecting-ivf-access\/article_95266bee-00f3-11ef-966d-5f71075fb7ed.html\" target=\"_blank\" rel=\"noreferrer noopener\">told local news outlet Gambit<\/a> that legislators  wanted to \u201cremove the idea that every human embryo will develop in utero into an unborn child.\u201d<\/p>\n<p>As the Louisiana Illuminator <a href=\"https:\/\/lailluminator.com\/2024\/04\/22\/legislation-to-protect-ivf-services-in-louisiana-moves-forward\/\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a> in its coverage of the bill, HB 833 also designates some embryos as \u201cnon-viable,\u201d a grading process that results in the abandonment, discard, and destruction of <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC5237322\/\" target=\"_blank\" rel=\"noreferrer noopener\">likely viable<\/a> life. \u201cNon-viable\u201d embryos \u201caren\u2019t afforded the same protections regarding destruction as those that could lead to a pregnancy.\u201d<\/p>\n<div class=\"fdrlst__b89e9-2712cd96248187131bf5948f30008827 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-2712cd96248187131bf5948f30008827\"><\/div>\n<p>Both the Louisiana Conference of Catholic Bishops and the Louisiana Family Forum \u2014 which <a href=\"https:\/\/x.com\/lafamilyforum\/status\/1783254651166494872\" target=\"_blank\" rel=\"noreferrer noopener\">acknowledged the bill<\/a> still allows the \u201cillegal habit of shipping out of Louisiana and destroying human embryos\u201d \u2014 oppose the legislation.<\/p>\n<div class=\"fdrlst__b89e9-994c1653be782e0dba0889aaacf1ed81 fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-994c1653be782e0dba0889aaacf1ed81\"><\/div>\n<hr class=\"wp-block-separator\">    \t\t\t\t\t   \t\t\t\t\t\t\t\t\t<\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In February, Sen.
