Controversies surrounding electors&#8217; certification were examined, challenging the narrative \u200dpresented.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>Justice Sonia Sotomayor used Thursday\u2019s Supreme Court hearing of Donald Trump\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-in-trump-election-case-says-she-lacks-jurisdiction-while-supreme-court-weighs-immunity\/\" title=\"Judge defers to Supreme Court on immunity in Trump election case\">presidential immunity claims<\/a> to further Democrats\u2019 debunked \u201cfake electors\u201d narrative.<\/p>\n<p>The moment came during the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cussin-cheerleaders-supreme-court-case-could-pose-challenge-for-woke-schools\/\" title=\"Cussin\u2019 Cheerleader\u2019s Supreme Court Case Could Pose Challenge for Woke Schools\">high court\u2019<\/a>s <a href=\"https:\/\/www.youtube.com\/watch?v=RpctDbO8wd4\" target=\"_blank\" rel=\"noreferrer noopener\">questioning<\/a> of Trump lawyer John Sauer, who argued that Special Counsel Jack Smith\u2019s indictments against Trump should be dismissed because presidents are granted lifelong immunity from criminal prosecutions and therefore cannot be charged for actions they took while in office that fall within the scope of their official duties as president. Citing the Jan. 6, 2021, riot at the U.S. Capitol, Smith <a href=\"https:\/\/thefederalist.com\/2023\/08\/01\/biden-delivers-another-blow-against-his-primary-political-rival-with-latest-trump-indictment\/\" target=\"_blank\" rel=\"noreferrer noopener\">indicted<\/a> Trump in August over his speech questioning the administration of the 2020 election.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1891405299\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-2b16cfeb47ea5062f97226ed83980f84 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-2b16cfeb47ea5062f97226ed83980f84\"><\/div>\n<p>In Thursday\u2019s hearing, justices probed Sauer on hypotheticals and whether immunity could be granted to a president who, for example, uses the military to target his political opponents. Justice Samuel Alito discussed the issue of viewing such actions through an objective lens and noted that \u201cone could say it\u2019s not plausible \u2026 that that action would be legal.\u201d<\/p>\n<p>\u201cI\u2019m sure you\u2019ve thought of lots of hypotheticals where a president could say, \u2018I\u2019m using an official power,\u2019 and yet the president uses it in an absolutely outrageous manner,\u201d Alito said. Sauer responded, \u201cThat, if it were an objective determination, may well be an interesting approach to take.\u201d<\/p>\n<p>Sotomayor then interjected, asking Sauer to apply such an approach to the allegations against Trump and repeating the baseless claim that the Republican electors who cast their votes for Trump ahead of Jan. 6, 2021, are \u201cfake.\u201d<\/p>\n<p>\u201cWhat is plausible about the president insisting and creating a fraudulent slate of electoral candidates?\u201d Sotomayor asked. \u201cAssuming you accept the facts of the complaint on their face, is that plausible that that would be within his right to do?\u201d<\/p>\n<div class=\"fdrlst__b89e9-dd750e56d809bfaa24eec3c68f8902e2 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-dd750e56d809bfaa24eec3c68f8902e2\"><\/div>\n<p>\u201cAbsolutely, your honor,\u201d Sauer argued, citing President Ulysses S. Grant \u201csending federal troops to Louisiana and Mississippi in 1876 to make sure that the Republican electors got certified in those two cases, which delivered the election to Rutherford B. Hayes.\u201d <\/p>\n<p>\u201cThe notion that it\u2019s completely implausible \u2026 can\u2019t be supported based on the face of this indictment,\u201d Sauer added before being cut off by Sotomayor, who asked if such a standard could be applied even with a president \u201cknowing that the slate [of electors] is fake; that they weren\u2019t actually elected; that they weren\u2019t certified by the state.\u201d <\/p>\n<p>Sauer disputed Sotomayor and Smith\u2019s characterization of the electors as \u201cfake\u201d and \u201cfraudulent,\u201d and noted that \u201con the face of the indictment, it appears that there was no deceit about who had emerged from the realm at state conventions and this was being done as an alternative basis.\u201d <\/p>\n<p>Contrary to the web of dishonesty spun by Sotomayor and legacy media, the naming of contingent Republican electors during the 2020 election was neither unprecedented nor unlawful. In fact, as I\u2019ve <a href=\"https:\/\/thefederalist.com\/2023\/09\/01\/exclusive-fani-willis-possesses-evidence-exonerating-georgias-alternate-electors\/\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a> previously, the process undertaken in states such as <a href=\"https:\/\/thefederalist.com\/2023\/09\/01\/exclusive-fani-willis-possesses-evidence-exonerating-georgias-alternate-electors\/\" target=\"_blank\" rel=\"noreferrer noopener\">Georgia<\/a> \u201cclosely mirrors efforts taken during the 1960 presidential contest between John F. Kennedy and Richard Nixon.\u201d <\/p>\n<div class=\"fdrlst__b89e9-d8d4e93d28905bea5755e182b029d6aa fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-d8d4e93d28905bea5755e182b029d6aa\"><\/div>\n<p>As Margot Cleveland has <a href=\"https:\/\/thefederalist.com\/2023\/05\/15\/the-lefts-2020-fake-electors-narrative-is-fake-news\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> in The Federalist, a disagreement over who won Hawaii\u2019s electoral votes prompted Kennedy and Nixon electors each to cast their votes for their respective candidates. And while Hawaii\u2019s acting Republican governor certified the election for Nixon initially, a legal challenge and subsequent court decision resulted in the state\u2019s electoral votes being given to Kennedy.<\/p>\n<p>Had courts ruled in Trump\u2019s favor in lawsuits disputing the election results in battleground states, the alternate electors would have been in place to ensure the will of the people was exercised.<\/p>\n<p>Sotomayor\u2019s latest display of activism from the bench came a day after Arizona Attorney General Kris Mayes, a Democrat, <a href=\"https:\/\/dailycaller.com\/2024\/04\/25\/kris-mayes-indictment-fake-election-scheme-18-charges-donald-trump-connections\/\" target=\"_blank\" rel=\"noreferrer noopener\">released<\/a> an indictment alleging 18 Arizona Republicans illegally partook in what she called a \u201cfake elector scheme.\u201d According to The Daily Caller, the charges released thus far show \u201c11\u00a0Arizona\u00a0Republicans are named for allegedly submitting a document to Congress which falsely declared that Trump beat President Joe Biden in the state\u2019s election.\u201d <\/p>\n<p>Among those named in the indictment are former Arizona GOP Chair Kelli Ward and her husband and Turning Point Action COO Tyler Bowyer.<\/p>\n<p>Michigan Attorney General Dana Nessel, also a Democrat, <a href=\"https:\/\/thefederalist.com\/2023\/07\/19\/as-michigan-charges-trump-electors-with-felonies-recall-how-leftists-everywhere-urged-2016-electors-to-defect-to-hillary\/\" target=\"_blank\" rel=\"noreferrer noopener\">charged<\/a> 16 Republican electors in her state last July. <\/p>\n<p>As my colleague Jordan Boyd previously <a href=\"https:\/\/thefederalist.com\/2023\/07\/19\/as-michigan-charges-trump-electors-with-felonies-recall-how-leftists-everywhere-urged-2016-electors-to-defect-to-hillary\/\" target=\"_blank\" rel=\"noreferrer noopener\">highlighted<\/a>, Democrats and their media allies had no problem \u201ccalling for electoral disobedience\u201d after Trump won the 2016 election.
