The Biden administration\u200d argues that the ban contradicts \u2062the Emergency Medical Treatment &#038;\u200d Labor\u200c Act. Wade<\/em>.<\/p>\n<p>The court <a href=\"https:\/\/www.politico.com\/news\/2024\/04\/24\/supreme-court-abortion-five-questions-00153965\" target=\"_blank\" rel=\"noopener\">heard<\/a> oral arguments on Wednesday in a case known as <em>Moyle v. United States<\/em>, which deals with whether Idaho emergency room doctors are required by federal law to perform abortions to stabilize pregnant women in medical crises.<\/p>\n<p>Idaho bans all abortions except to save the life of the mother or in cases of rape and incest. Doctors who perform abortions can face criminal penalties, including up to five years in prison and the loss of their medical license.<\/p>\n<p>The Biden administration is arguing that Idaho\u2019s abortion ban flies in the face of a federal law, the 1986 Emergency Medical Treatment &#038; Labor Act, known as EMTALA, which requires hospitals receiving federal funds to provide patients with stabilizing care. Hospitals that flout the law are at risk of losing their Medicare funding.<\/p>\n<p>The federal law requires hospitals to care for people with an \u201cemergency medical condition,\u201d including pregnant women in situations where \u201cthe absence of immediate medical attention could reasonably be expected to result in\u201d putting \u201cthe health of the woman or her unborn child\u201d in \u201cserious jeopardy.\u201d<\/p>\n<p>The administration claims the federal law should override Idaho\u2019s abortion ban since, in some cases, stabilizing care will mean an emergency room abortion.<\/p>\n<p>Meanwhile, Idaho officials counter that the Biden administration is simply trying to undermine the state\u2019s abortion ban. Idaho\u2019s attorney general, Ra\u00fal Labrador, <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-726\/301167\/20240222152045736_Main%20Document%2023-727.pdf\" target=\"_blank\" rel=\"noopener\">alleged<\/a> in a brief that the administration is attempting to use federal law to turn Idaho emergency rooms into \u201cabortion enclaves in violation of state law.\u201d<\/p>\n<p>The administration\u2019s interpretation of the federal law would make it easier for women to obtain medically unnecessary abortions, state officials argued. One of Idaho\u2019s lawyers <a href=\"https:\/\/www.cbsnews.com\/news\/supreme-court-idaho-abortion-ban-federal-law-emergency-care\/\" target=\"_blank\" rel=\"noopener\">said<\/a> a pregnant woman could potentially claim that her mental health required her to get an abortion.<\/p>\n<p>The case is being closely watched since the justices\u2019 decision could potentially have broad implications for the more than a dozen states that have enacted strict <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/article-from-the-guardian-bashes-white-evangelicals-for-their-anger-over-abortion\/\" title=\"Article From The Guardian Bashes \u2018White Evangelicals\u2019 For Their \u2018Anger\u2019 Over Abortion\">state abortion bans<\/a>.<\/p>\n<p>On Wednesday, justices appeared divided on the case mainly along ideological lines. The court currently has a majority of six conservative justices.<\/p>\n<p>However, there appeared to be a split along gender lines as well. The court\u2019s four female justices, including conservative Amy Coney Barrett, pushed back on Idaho\u2019s claim that its abortion ban supersedes the federal law.<\/p>\n<p>Barrett\u2019s <a href=\"https:\/\/www.cnn.com\/politics\/live-news\/abortion-supreme-court-idaho-04-24-24\/h_28e59414f20bb545e081e85aecc69ccf\" target=\"_blank\" rel=\"noopener\">criticism<\/a> was less about the abortion issue itself and more about how much discretion doctors have to make decisions in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-admin-silently-erases-unborn-child-in-legal-argument-pushing-abortion-on-religious-medical-workers\/\" title=\"Biden Admin Silently Erases \u2018Unborn Child\u2019 In Legal Argument Pushing Abortion On Religious Medical Workers\">emergency medical situations<\/a>. She appeared frustrated with Idaho\u2019s attorney and accused him of \u201chedging\u201d in his answers.<\/p>\n<p>The Biden administration initially sued Idaho in August 2022. The court is also handling a case involving the availability of the abortion drug mifepristone.
