Morrisey, backed by activist Riley Gaines, seeks to contest the Biden administration&#8217;s updated sex definitions in Title IX.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/tag\/west-virginia\/\" target=\"_blank\" rel=\"noopener\" title>West Virginia<\/a> Attorney General Patrick Morrisey announced on Wednesday he will ask the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a> to step in after a federal appeals court found a state law violated the rights of a transgender middle school track and field runner.<\/p>\n<p>Morrisey, who was standing alongside activist and former swimming athlete Riley Gaines when he announced the move, said he would file a cert petition to the nine justices as soon as next week. His decision comes days after the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noreferrer noopener\">Biden administration<\/a> finalized its <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2971440\/biden-administration-finalizes-controversial-title-ix-rule\/\" target=\"_blank\" rel=\"noopener\" title=\"controversial federal Title IX\">controversial federal Title IX<\/a> rule to expand the definition of sex to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-administration-finalizes-controversial-title-ix-rule-to-redefine-sex\/\" title=\"Biden administration completes contentious Title IX rule restructuring sex definition\">include transgender identities<\/a>.<\/p>\n<figure><\/figure>\n<p>\u201cToday is a great day, and we\u2019re making a major announcement. We are going to go to the U.S. Supreme Court to overturn [a lower court\u2019s] challenge to the Save Women\u2019s Sports Act,\u201d Morrisey <a href=\"https:\/\/vimeo.com\/event\/4254551\" target=\"_blank\" rel=\"noopener\" title=\"said\">said<\/a>.<\/p>\n<p>Earlier this month, a three-judge panel on the U.S. Court of Appeals for the 4th Circuit ruled against West Virginia in a case that sought to uphold its law that prevents athletes of opposite sexes from competing against one another. <\/p>\n<p>The appeals panel did not overturn West Virginia\u2019s law, but the majority found it unfairly discriminated against Becky Pepper-Jackson under Title IX, which has historically been in place to block sex-based discrimination in any school or education program that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/personal-injury-lawyer-finds-a-new-practice-area-suing-for-kids-harmed-by-crt-in-schools\/\" title=\"Personal Injury Lawyer Finds A New Practice Area: Suing For Kids Harmed By CRT In Schools\">receives federal funds<\/a>.<\/p>\n<p>Activists such as Gaines contend that allowing a biological male who identifies as a female to compete against other females is its own form of sex discrimination and will lead to disastrous consequences for female athletes.<\/p>\n<p>In a dissent accompanying the court\u2019s opinion,\u00a0Judge G. Steven Agee\u00a0said that the 4th Circuit\u2019s opinion \u201cturns Title IX on its head and reverses the monumental work Title IX has done to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/circuit-court-overturns-west-virginia-law-barring-boys-in-girls-sports\/\" title=\"West Virginia Law Prohibiting Boys in Girls\u2019 Sports Overturned by Circuit Court\">promote girls\u2019 sports<\/a> from its inception.\u201d<\/p>\n<p>West Virginia has so far seen some setbacks in attempting to have its law upheld by the courts.<\/p>\n<p>Last April, the <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2009004\/supreme-court-to-allow-transgender-student-in-west-virginia-to-play-on-girls-sports-team-for-now\/\" target=\"_blank\" rel=\"noopener\" title=\"justices declined to act\">justices declined to act<\/a> on a separate petition by West Virginia regarding a federal appeals court order that made it possible for Pepper-Jackson to remain on the school\u2019s girls\u2019 track and cross-country team.<\/p>\n<p>Morrisey said that even counsel for Pepper-Jackson, who has the backing of the American Civil Liberties Union, has argued that there is a place for gender and sex separation in sports.<\/p>\n<p>\u201cWe believe we have a strong case on the merits,\u201d Morrisey said, noting that two justices have previously said they would take up the case.<\/p>\n<p>\u201cWe\u2019re confident that now that we\u2019re further along procedurally, that the other justices will agree,\u201d adding that \u201cwe\u2019re seeing immediate harm to girls\u201d in sports.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>The case began after the ACLU initially sued West Virginia over its 2021 law.
