Starbucks Workers United union remains \u2062a\u2064 point of contention.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>The Supreme Court on Tuesday began hearing Starbucks\u2019 challenge to the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/labor-board-rebukes-union-for-threatening-worker\/\" title=\"Labor Board Rebukes Union for Threatening Worker\">federal labor agency<\/a> that forced the coffee giant to rehire seven workers who tried to unionize.<\/p>\n<p>In the summer of 2022, Starbucks fired seven baristas who were organizing a union at their Memphis location, arguing the workers violated company policy by having a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/chicago-news-crew-robbed-at-gunpoint-while-reporting-on-robberies\/\" title=\"Chicago news crew robbed while reporting on robberies.\">television news crew<\/a> come to the store after hours.<\/p>\n<p>However, the <span class=\"LinkEnhancement\">National Labor Relations Board obtained a court order to reinstate the terminated baristas, agreeing with the workers that they were fired over their union activities. An appeals court later upheld that decision.<\/span><\/p>\n<p><span class=\"LinkEnhancement\">Starbucks argues that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/is-the-democrats-election-heist-too-big-to-fail\/\" title=\"Is the Democrats\u2019 Election Heist \u2018Too Big to Fail\u2019?\">federal courts<\/a> should have stricter standards for reinstating fired employees. Currently, a court may grant an injunction against a company if it is deemed \u201cjust and proper.\u201d<\/span><\/p>\n<p>During the first day of arguments, some of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/va-gov-elect-glenn-youngkin-promises-to-join-fight-against-biden-vax-orders\/\" title=\"VA Gov.-Elect Glenn Youngkin Promises To Join Fight Against Biden Vax Orders\">justices appeared<\/a> to agree with Starbucks.<\/p>\n<p>Justice Neil Gorsuch pointed out that other federal agencies are subject to a stricter standard.<\/p>\n<p>\u201cIn all sorts of alphabet soup agencies, we don\u2019t do this. District courts apply the \u2018likelihood of success\u2019 test as we normally conceive it. So why is this particular statutory regime different than so many others?\u201d Gorsuch <a href=\"https:\/\/www.reuters.com\/world\/us\/us-supreme-court-examines-firings-pro-union-starbucks-workers-2024-04-23\/\" target=\"_blank\" rel=\"noopener\">asked<\/a>.<\/p>\n<p>Starbucks has a notoriously fraught relationship with its union, Starbucks Workers United, but tensions have recently cooled somewhat.<\/p>\n<p>Starbucks and union representatives announced in February that they would resume talks. They were set to meet on Wednesday for a bargaining session, the first in close to a year, with the goal of getting a contract by the end of 2024.<\/p>\n<p>Nevertheless, Starbucks has decided to plow ahead with its case before the high court to the dismay of union officials.<\/p>\n<p>\u201cThe day [Starbucks] committed to a new path should\u2019ve been the day that they pulled back the case before SCOTUS,\u201d Lynne Fox, president of Workers United, the parent union of Starbucks\u2019 union, <a href=\"https:\/\/www.washingtonpost.com\/business\/2024\/04\/23\/starbucks-union-supreme-court\/\" target=\"_blank\" rel=\"noopener\">told<\/a> The Washington Post.<\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1700760801843000&#038;usg=AOvVaw2PQrVSrJfhxNb4LcARqniG\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p>Twelve current and former Starbucks baristas also wrote to the Supreme Court to claim they had been fired or punished for supporting <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-nixes-union-contract-with-pro-trump-labor-group\/\" title=\"Biden Nixes Union Contract With Pro-Trump Labor Group\">union activity<\/a>. Some said they had lost their health insurance or had their electricity cut because they could not pay their bills.<\/p>\n<p>If the court decides in favor of Starbucks, the decision could discourage union activity at other companies. Union activity has <a href=\"https:\/\/www.nlrb.gov\/news-outreach\/news-story\/union-petitions-up-35-unfair-labor-practices-charge-filings-up-7-in-the\" target=\"_blank\" rel=\"noopener\">surged<\/a> across the country this year.<\/p>\n<p>Amazon, SpaceX, and Trader Joe\u2019s have also recently challenged the <span class=\"LinkEnhancement\">National Labor Relations Board.<\/span><\/p>\n<p>SpaceX filed a federal lawsuit in Texas earlier this year against the agency after the labor board accused the company of illegally firing eight employees for criticizing Elon Musk, the company\u2019s founder.<\/p>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Starbucks challenges federal labor agency in Supreme Court over rehiring unionizing workers.
