He pointed \u200dout\u200c the opening statements as a pivotal moment leading to\u2064 his strong \u2062stance.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>Boston University law professor Jed Handelsman Shugerman delivered a blistering New York Times <a href=\"https:\/\/www.nytimes.com\/2024\/04\/23\/opinion\/bragg-trump-trial.html\" target=\"_blank\" rel=\"noopener\">guest essay<\/a> trashing Manhattan District Attorney Alvin Bragg\u2019s case against former President Donald Trump.<\/p>\n<p>Shugerman titled the piece, \u201cI thought the Bragg case against Trump was a legal embarrassment. Now I think it\u2019s a historic mistake\u201d \u2014 and then argued that in addition to the hush-money case against Trump being thin at best, the arguments being used to support it bordered on absurd.<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/medical-professor-warned-colleagues-that-schools-racial-preferences-were-illegal-and-he-was-removed-from-directorship-now-hes-suing\/\" title=\"Medical Professor Warned Colleagues That School\u2019s Racial Preferences Were Illegal And He Was Removed From Directorship. Now He\u2019s Suing.\">professor\u2019<\/a>s comments came on the heels of Monday\u2019s <a href=\"https:\/\/www.dailywire.com\/news\/michael-avenatti-claims-he-is-willing-to-testify-in-trump-hush-money-trial\" target=\"_blank\" rel=\"noopener\">opening statements<\/a> \u2014 which he cited as the reason he now believes prosecutors in the case have made a \u201chistoric mistake.\u201d<\/p>\n<p>\u201cTheir vague allegation about \u2018a criminal scheme to corrupt the 2016 presidential election\u2019 has me more concerned than ever about their unprecedented use of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-rules-ca-gov-overstepped-his-authority-with-covid-order-issues-permanent-injunction-restraining-newsom-from-further-issuing-unconstitutional-orders\/\" title=\"Judge Rules CA Gov Overstepped His Authority with Covid Order, Issues Permanent Injunction Restraining Newsom From Further Issuing Unconstitutional Orders\">state law<\/a> and their persistent avoidance of specifying an election crime or a valid theory of fraud,\u201d Shugerman wrote, noting that the prosecutors appeared to be attempting to use state laws to shoehorn in a case that belonged in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/d-c-statehood-is-a-democrat-power-grab\/\" title=\"D.C. Statehood Is A Democrat Power Grab\">federal jurisdiction<\/a>.<\/p>\n<p>He went on to explain that there was a way to do that \u2014 if prosecutors argued that Trump had been attempting to deceive state regulators. But they didn\u2019t.<\/p>\n<p>Instead, Bragg\u2019s office argued that Trump had committed \u201celection fraud\u201d by attempting to \u201cunlawfully influence\u201d the 2016 presidential election.<\/p>\n<p>The problems with that argument, Shugerman said, were simple: \u201cIt is legal for a candidate to pay for a nondisclosure agreement. Calling it \u2018election fraud\u2019 is a legal and strategic mistake, exaggerating the case and setting up the jury with high expectations that the prosecutors cannot meet,\u201d Shugerman continued.<\/p>\n<p>Shugerman concluded by saying that while he agreed both sides should get the chance to make their cases before the court, this particular case should be held up as an example of the system getting things wrong.<\/p>\n<p>\u201cEight years after the alleged crime itself, it is reasonable to ask if this is more about Manhattan politics than New York law.
