The case is seeking Supreme Court review to stop federal interference in state elections, with potential ramifications on political \u200bcontrol in 2025.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>President Joe Biden is using the federal government to tread on the authority of the legislative branch, according to an appeal filed today with the U.S. Supreme Court. <\/p>\n<p>The <a href=\"https:\/\/www.scotusblog.com\/election-law-explainers\/the-certiorari-process-seeking-supreme-court-review\/\" target=\"_blank\" rel=\"noreferrer noopener\">petition for certiorari,<\/a> exclusively obtained by The Federalist, argues that Biden\u2019s <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2021\/03\/07\/executive-order-on-promoting-access-to-voting\/\" target=\"_blank\" rel=\"noreferrer noopener\">Executive Order 14019<\/a>, which commands federal agencies to orchestrate an unprecedented, national get-out-the-vote effort, violates the Constitution. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1481472878\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-f321a90f36aa0ea5a874e374ccf5a037 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-f321a90f36aa0ea5a874e374ccf5a037\"><\/div>\n<p>\u201cThe executive action taken by the President, nullifies the votes of the individual legislators, nullifies the enactment of the Legislature, violates the Electors Clause, violates the Elections Clause, deprives the legislators of their particular rights, and jeopardizes candidates\u2019 rights to an election free from fraud and abuse,\u201d states the request for the high court\u2019s review, filed by 27 Pennsylvania state lawmakers. <\/p>\n<p>But the plaintiffs aren\u2019t asking the Supreme Court to weigh in on the merits of the case. They\u2019re after the critical question of standing: whether individual lawmakers have the right to take such claims of federal executive branch incursions on legislative duty to court. <\/p>\n<p>Earlier this month, the legislators appealed the case to the U.S. 3rd Circuit Court of Appeals after a <a href=\"https:\/\/casetext.com\/case\/keefer-v-biden\" target=\"_blank\" rel=\"noreferrer noopener\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-administration-mounts-losses-in-supreme-court\/\" title=\"Biden Administration Mounts Losses in Supreme Court\">lower court dismissed<\/a> the lawsuit<\/a> for lack of standing. But the lawmakers say time is of the essence, and they\u2019re seeking expedited consideration from the Supreme Court in a request to bypass the usual appeals process. They\u2019re optimistic that a majority of the justices will find in their favor and the lawsuit will go back to the lower court to rule on the merits. And they\u2019re very confident they\u2019ll ultimately win an injunction stopping state and federal overreach in Pennsylvania elections. <\/p>\n<p>\u201cPetitioners ask this Court to resolve the nationwide conflict over individual legislator standing,\u201d the petition states. \u201cPetitioners have no other recourse. The stakes could not be higher.\u201d<\/p>\n<div class=\"fdrlst__b89e9-5a4df79ac6e39d79e5c067fd379536e6 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-5a4df79ac6e39d79e5c067fd379536e6\"><\/div>\n<h2 class=\"wp-block-heading\">Duty and Nullification<\/h2>\n<p>Government watchdogs have <a href=\"https:\/\/thefederalist.com\/2024\/04\/19\/meet-the-pennsylvania-lawmaker-leading-the-united-states-most-important-election-integrity-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">described<\/a> the Pennsylvania State Freedom Caucus\u2019 lawsuit as \u201cthe most <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidenbucks-tentacles-expand-as-judge-shuts-down-lawsuit\/\" title=\"Bidenbucks' Influence Grows Following Lawsuit Shutdown\">important election integrity lawsuit<\/a> in the country.\u201d\u00a0The outcome could ultimately determine political control in 2025. <\/p>\n<p>Biden\u2019s fiat directs federal \u201cdepartments and agencies\u201d to \u201cpartner\u201d with state, local, tribal, and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/watchdog-dojs-election-plan-raises-threat-of-selective-enforcement-against-red-states\/\" title=\"Watchdog: DOJ's Election Plan Raises Threat of \"Selective Enforcement\" Against Red States\">territorial election officials<\/a> on voter registration and other GOTV initiatives.<\/p>\n<p>Critics of the federalized GOTV drive call it <a href=\"https:\/\/thefederalist.com\/2024\/04\/15\/bidenbucks-make-zuckbucks-look-like-chump-change\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cBidenbucks,<\/a>\u201d a nod to <a href=\"https:\/\/thefederalist.com\/2024\/04\/15\/bidenbucks-make-zuckbucks-look-like-chump-change\/\" target=\"_blank\" rel=\"noreferrer noopener\">Zuckbucks<\/a>, the hundreds of millions of dollars in private donations that Facebook founder Mark Zuckerberg dropped on local election offices during the 2020 election. Biden claims his order is all about promoting the \u201cexercise of the right to vote\u201d and eliminating \u201cdiscrimination and other barriers to voting.\u201d Such lofty-sounding goals, however, get lost in the implementation of the plan, which appears to be created to target traditionally Democrat voters with the assistance of White House-\u201capproved\u201d leftist groups.<\/p>\n<p>In January, 27 Republican state lawmakers \u2014 26 members of the state House of Representatives and one senator \u2014 filed a federal <a href=\"https:\/\/dockets.justia.com\/docket\/pennsylvania\/pamdce\/1:2024cv00147\/140876\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a> against Biden and Pennsylvania Democrat <a href=\"https:\/\/www.governor.pa.gov\" target=\"_blank\" rel=\"noreferrer noopener\">Gov. Josh Shapiro<\/a>, Secretary of the Commonwealth <a href=\"https:\/\/www.dos.pa.gov\/about-us\/Pages\/Secretary-of-the-Commonwealth.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">Al Schmidt<\/a>, and <a href=\"https:\/\/www.dos.pa.gov\/about-us\/Pages\/Deputy-Secretary-for-Elections-and-Commissions.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">Jonathan Marks<\/a>, deputy secretary for state Elections and Commissions. The <a href=\"https:\/\/www.electionresearchinstitute.org\">Election Research Institute (ERI)<\/a>, a nonpartisan nonprofit working to restore confidence in the election system, is sponsoring this case. The lawsuit also names seven Biden cabinet members, including <a href=\"https:\/\/www.state.gov\/biographies\/antony-j-blinken\/\" target=\"_blank\" rel=\"noreferrer noopener\">Secretary of State Antony Blinken,<\/a> Health and Human\u00a0Services Secretary <a href=\"https:\/\/www.hhs.gov\/about\/leadership\/xavier-becerra.html\" target=\"_blank\" rel=\"noreferrer noopener\">Xavier Becerra,<\/a> and Education Secretary <a href=\"https:\/\/www2.ed.gov\/news\/staff\/bios\/cardona.html\" target=\"_blank\" rel=\"noreferrer noopener\">Miguel Cardona<\/a>. All of these agencies, and many more, are in on the scheme. <\/p>\n<div class=\"fdrlst__b89e9-6c24ec45eb7c5d2df4de3291946f5c9b fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-6c24ec45eb7c5d2df4de3291946f5c9b\"><\/div>\n<p>The lawmakers say Biden has infringed on their constitutional rights and responsibilities to operate elections without federal and state executive branch meddling.\u00a0\u201c[A]ll agency action in conformity with [EO] 14019 is without congressional delegation or funding, and conducted merely by executive fiat,\u201d the lawsuit <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2024\/01\/M.D.-Pa.-24-cv-00147-dckt-000048_000-filed-2024-03-26.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">asserts<\/a>.<\/p>\n<p>Biden\u2019s order, the lawsuit alleges, has the force of changing Pennsylvania election law, \u201cwhich usurps the state legislature\u2019s powers and violates the state legislators\u2019 federal civil rights under the <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artII-S1-C2-1\/ALDE_00013798\/\" target=\"_blank\" rel=\"noreferrer noopener\">Electors Clause<\/a> and the <a href=\"https:\/\/constitution.congress.gov\/browse\/article-1\/section-4\/#:~:text=Clause%201%20Elections%20Clause,the%20Places%20of%20chusing%20Senators.\" target=\"_blank\" rel=\"noreferrer noopener\">Elections Clause.<\/a>\u201d The latter <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/4-devastating-consequences-of-the-democrat-for-the-people-act\/\" title=\"4 Devastating Consequences Of The Democrat \u2018For The People Act\u2019\">grants state legislatures<\/a> the authority to prescribe the \u201cTimes, Places\u00a0and Manner of holding Elections for Senators and Representatives.\u201d The former gives each state the power to \u201cappoint, in such Manner as the Legislature thereof may direct, a Number of Electors\u201d to vote for president. That number is based on each state\u2019s two U.S. senators and its total U.S. House members. <\/p>\n<p>The key to both foundational clauses is that state legislatures not only have the right but the duty to set out the terms of elections. <\/p>\n<p>\u201cEO 14019\u2019s implementation is a usurpation of Pennsylvania state law,\u201d the petition charges. \u201cThe will of the legislators who successfully voted for the state law to be enacted was manifested through final legislative action, 25 P.S. \u00a7 107 (2022). EO 14019 nullifies the intended legal effects of the enacted state law, depriving the individual state legislators of the intended legal effects of their successful vote.\u201d<\/p>\n<p>Same goes for automatic voter registration and other election-related policies unilaterally implemented by Shapiro and the secretary of the commonwealth. Pennsylvania\u2019s leftist executive branch disregarded the will of the General Assembly \u2014 and the people of Pennsylvania \u2014 in enacting liberal election edicts, the petition alleges. <\/p>\n<h2 class=\"wp-block-heading\">Beyond Zuckbucks <\/h2>\n<p>Pennsylvania was one of many states embroiled in the <a href=\"https:\/\/thefederalist.com\/2024\/04\/05\/in-opposite-day-logic-usa-today-breathlessly-defends-zuckerbucks\/\" target=\"_blank\" rel=\"noreferrer noopener\">Zuckbucks<\/a> controversy of 2020. As a swing state, the Keystone State was a target of unprecedented private money \u2014\u00a0 more than $22 million in so-called \u201cCovid-19 response grants\u201d filtered from the Facebook founder to leftist \u201cvoter rights\u201d nonprofits. According to the <a href=\"https:\/\/thefga.org\/wp-content\/uploads\/2021\/04\/Pennsylvania-Zuckerbucks.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Foundation for Government Accountability<\/a>, more than <a href=\"https:\/\/thefga.org\/wp-content\/uploads\/2021\/03\/Pennsylvania-Zuckerbucks-brief-3-16-21.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">90 percent<\/a> of that money went to counties that voted for Joe Biden. Philadelphia County alone received more than $10.5 million in Zuckerberg-funded election administration grants. <\/p>\n<p>In <a href=\"https:\/\/www.abc27.com\/election\/pennsylvania-law-funds-state-elections-bans-outside-funds\/\" target=\"_blank\" rel=\"noreferrer noopener\">July 2022,<\/a> Gov. Tom Wolf, a Democrat, signed a bill banning private money in Pennsylvania election administration. It demands that elections receive <a href=\"https:\/\/www.ncsl.org\/elections-and-campaigns\/prohibiting-private-funding-of-elections\" target=\"_blank\" rel=\"noreferrer noopener\">\u201clawful appropriations\u201d<\/a> from federal, state, and local governments. The <a href=\"https:\/\/www.legis.state.pa.us\/cfdocs\/legis\/li\/uconsCheck.cfm?yr=2022&#038;sessInd=0&#038;act=88\" target=\"_blank\" rel=\"noreferrer noopener\">bill<\/a> barred public officials from soliciting or contracting with third-party, nongovernmental organizations \u201cfor the registration of voters or the preparation, administration or conducting of an election in this commonwealth.\u201d <\/p>\n<p>Now the Biden administration comes storming in with its order urging \u201capproved\u201d third-party groups to work with federal, state, and local governments on voter registration and GOTV initiatives. Congress never appropriated taxpayer funds for the enactment of Biden\u2019s order, a fact the <a href=\"https:\/\/thefederalist.com\/2024\/04\/02\/pennsylvania-lawmakers-to-appeal-bidenbucks-lawsuit-to-u-s-supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">administration has acknowledged<\/a>. The administration <a href=\"https:\/\/thefederalist.com\/2024\/04\/22\/why-west-virginias-secretary-of-state-wont-follow-bidens-illegal-directives-federalizing-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">won\u2019t<\/a> even tell Congress or state elections officials what it is doing, and who\u2019s doing what. <\/p>\n<p>\u201cExactly what the legislators sought to prevent has now been facilitated by executive action by the President who is also a candidate in the 2024 election and stands to benefit personally from the executive action,\u201d the lawmakers\u2019 Supreme Court filing states. <\/p>\n<h2 class=\"wp-block-heading\">\u2018Before the Consequences Become Catastrophic\u2019<\/h2>\n<p>Last month, without delving into the merits of the lawsuit, <a href=\"https:\/\/www.pamd.uscourts.gov\/content\/judge-jennifer-p-wilson\" target=\"_blank\" rel=\"noreferrer noopener\">Judge Jennifer P. Wilson<\/a> of the Middle District of\u00a0Pennsylvania granted the Biden administration\u2019s motions to dismiss <a href=\"https:\/\/thefederalist.com\/2024\/04\/02\/pennsylvania-lawmakers-to-appeal-bidenbucks-lawsuit-to-u-s-supreme-court\/\">because<\/a> of the \u201cPlaintiffs\u2019 lack of standing to raise the claims at issue.\u201d\u00a0Wilson cited rulings from the U.S. Supreme Court and the U.S. 3rd Circuit Court of Appeals that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pennsylvania-lawmakers-to-appeal-bidenbucks-lawsuit-to-u-s-supreme-court\/\" title=\"Pennsylvania lawmakers plan to appeal the 'Bidenbucks' lawsuit to the U.S. Supreme Court\">found \u201cindividual legislators<\/a> did not have standing to bring a challenge to an action that allegedly injured the legislature as a whole.\u201d<\/p>\n<p>\u201cPlaintiffs have alleged only an institutional injury resulting from \u2018a general loss of legislative power,\u2019\u201d the judge <a href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2024\/01\/M.D.-Pa.-24-cv-00147-dckt-000048_000-filed-2024-03-26.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote.<\/a> \u201cA vague, generalized allegation that elections, generally, will be undermined, is not the type of case or controversy that this court may rule on under Article III.\u201d <\/p>\n<p>The plaintiffs beg to differ. They note that their claim mentions nothing of \u201cinstitutional injury,\u201d or a wrong committed against the entire legislature. They contend the district court judge omits other federal and state court rulings that have granted individual state legislators standing in complaints against the federal government. In fact, the petition notes several state supreme court cases and a key U.S. Supreme Court ruling from the late 1930s \u2014 <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/307\/433\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Coleman v. Miller<\/em><\/a>  \u2014 that created a pathway to legislator standing. <\/p>\n<p>But other rulings contradict those decisions. That\u2019s why, the Pennsylvania lawmakers assert, the U.S. Supreme Court\u2019s intervention is so imperative. The status quo, they argue, is \u201cunsustainably paradoxical.\u201d <\/p>\n<p>\u201cThe Court\u2019s lack of clear direction on individual state legislator standing under the Elections Clause and Electors Clause references to the word \u2018legislature\u2019 is disabling federal court remedies for state legislators against federal executive and state executive usurpations of state legislative law-making under the Elections and Electors Clause,\u201d the petition asserts. <\/p>\n<p>Erick Kaardal, attorney for the plaintiffs, said Biden\u2019s and Shapiro\u2019s actions have circumvented the clear authority granted to these legislators, and the plaintiffs should have standing to prevent \u201cnullification\u201d of that authority. <\/p>\n<p>The petition points to Supreme Court Justice Clarence Thomas\u2019 previous <a href=\"https:\/\/www.supremecourt.gov\/opinions\/20pdf\/20-542_2c83.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">observation<\/a> that a case involving federal elections \u201cheightens the need for review\u201d because, as the court <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/440\/173\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> in 1979, elections are \u201cof the most fundamental significance under our constitutional structure.\u201d<\/p>\n<p>The petition closes with a warning from Thomas\u2019 dissenting opinion in 2021\u2019s <em><a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/20-542_2021-02-22\" target=\"_blank\" rel=\"noreferrer noopener\">Republican Party of Pennsylvania v. Degraffenreid<\/a><\/em>. The lawsuit, involving Acting Secretary of the Commonwealth Veronica Degraffenreid, took on the multiple broken laws and irregularities plaguing Pennsylvania\u2019s handling of the 2020 election. <\/p>\n<p>\u201cChanging the rules in the middle of the game is bad enough. Such rule changes by officials who may lack authority to do so is even worse,\u201d Thomas wrote, commenting on the alterations the state supreme court made shortly before the 2020 presidential election to the laws passed by the legislature. \u201cWhen those changes alter election results, they can severely damage the electoral system on which our self-governance so heavily depends.\u201d<\/p>\n<p>\u201cIf state officials have the authority they have claimed, we need to make it clear,\u201d Thomas added. \u201cIf not, we need to put an end to this practice now before the consequences become catastrophic.\u201d<\/p>\n<div class=\"fdrlst__b89e9-4792e05e79b0371553b2ea90931888cd fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-4792e05e79b0371553b2ea90931888cd\"><\/div>\n<hr class=\"wp-block-separator\">    \t\t\t\t\t   \t\t\t\t\t\t\t\t\t<\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>President Biden accused of overstepping by directing federal agencies to conduct a national voter drive.
