The jury <a href=\"https:\/\/apnews.com\/article\/rancher-migrant-shooting-arizona-mexico-border-4e6e07909f0b9d53ee58a99fbf515870\" target=\"_blank\" rel=\"noopener\">started<\/a> deliberating on Thursday after a four-week trial and could not reach a unanimous decision by Monday.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cBased upon the jury\u2019s inability to reach a verdict on any count,\u201d Judge Thomas Fink <\/span><a href=\"https:\/\/www.fox10phoenix.com\/news\/george-kelly-trial-mistrial-declared-for-arizona-border-rancher-accused-of-killing-migrant\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">said<\/span><\/a><span style=\"font-weight: 400\">, \u201cThis case is in mistrial.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">A status hearing will take place on April 29 to determine whether prosecutors will attempt another trial. Kelly pled <a href=\"https:\/\/www.dailywire.com\/news\/elderly-arizona-rancher-pleads-not-guilty-to-shooting-illegal-immigrant-trespassing-on-his-property\" target=\"_blank\" rel=\"noopener\">not guilty<\/a> in March 2023 to the murder charge as well as a count of aggravated assault.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cIt\u2019s a victory,\u201d <a href=\"https:\/\/www.theepochtimes.com\/article\/arizona-rancher-murder-trial-revelations-5632640?utm_source=twitter&#038;utm_medium=social\" target=\"_blank\" rel=\"noopener\">said<\/a> defense lawyer Kathy Lowthorp of the mistrial, The Epoch Times reported. \u201cIt\u2019s the second best answer \u2013 not guilty, and then a mistrial. So either way, it\u2019s a win, just not the perfect win.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">Kelly had been accused of shooting Cuen-Buitimea, a Mexican national, on January 31, 2023, when he was trespassing with a group of other suspected illegal immigrants on Kelly\u2019s property near Nogales, Arizona.\u00a0The defense argued that Kelly only fired warning shots and did not shoot Cuen-Buitimea. Kelly\u2019s legal team said he had heard a shot and immediately called Border Patrol before later finding Cuen-Buitimea\u2019s body on his property when he again called the authorities.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">According to the rancher, he fired warning shots after he saw the group go by because he was worried for his and his wife\u2019s safety after he saw a group of men with rifles go by his home.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Santa Cruz County prosecutor Mike Jette <a href=\"https:\/\/www.foxnews.com\/us\/judge-declares-mistrial-case-arizona-rancher-charged-murder-mexican-national-border-property\" target=\"_blank\" rel=\"noopener\">accused<\/a> Kelly of escalating the situation, claiming the rancher did not see anyone armed.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cHe escalates the situation. His wife is fine,\u201d Jette said, Fox News reported. \u201cYou do not have the right to use deadly physical force to protect a person who didn\u2019t need protecting. You don\u2019t have the right to use deadly force when there is no threat to home or yard, and you don\u2019t have the right to initiate, instigate or escalate with deadly force.\u201d<\/span><\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1713635892817000&#038;usg=AOvVaw3lXMk_jhNQC8Fngje8e8XV\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p><span style=\"font-weight: 400\">Kelly\u2019s team argued that even though he didn\u2019t use deadly force, he could have been justified to use it because of the situation.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cHe can fire warning shots to protect himself and to protect his wife,\u201d defense attorney Brenna Larkin said. \u201cAnd that\u2019s exactly what he did. That\u2019s exactly what any man who cares about his wife and his home should do in this situation when faced with the threat that he was faced with.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Cuen-Buitimea had previously been <a href=\"https:\/\/nypost.com\/2024\/04\/22\/us-news\/judge-declares-mistrial-in-case-of-arizona-rancher-charged-with-murder-of-mexican-national-on-border-property\/\">deported<\/a> from the United States after reportedly entering the country multiple times.
