Starbucks contests the court&#8217;s decision to reinstate employees before final judgment, \u2062arguing for \u2063a stricter legal standard. This case could impact how courts handle \u200dlabor \u200bdisputes under the National Labor Relations Act.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\" target=\"_blank\" rel=\"noopener\" title>Supreme Court<\/a> will hear arguments Tuesday over <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/starbucks\/\" target=\"_blank\" rel=\"noopener\" title>Starbucks<\/a>\u2018s challenge to an order requiring it to rehire fired union activists, giving the justices another shot at paring back agency power.<\/p>\n<p>Justices will hear the case <em>Starbucks Corp v. McKinney<\/em>, which stems from the firing of seven employees in Memphis, <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/tennessee\/\" target=\"_blank\" rel=\"noopener\" title>Tennessee<\/a>, in February 2022. (AP Photo\/Joshua Bessex, File)<\/figcaption><\/figure>\n<p>Starbucks and the National Labor Relations Board will appear before the nine-member high court to debate how federal courts should treat the agency\u2019s request for a district court judge to order those employees reinstated while their case proceeds. A lower court judge agreed, and the Memphis 7 returned to work in September 2022.<\/p>\n<p>Starbucks appealed a lower court judge\u2019s decision to the U.S. Court of Appeals for the 6th Circuit, which affirmed the district court\u2019s findings. Now the coffee giant is telling the high court that the 6th Circuit erred because it applied a two-factor test rather than a more strict four-factor test.<\/p>\n<p>The four-factor test is essentially a much more stringent way of considering the likelihood that a party seeking an injunction for relief will succeed on the merits. That test requires the consideration of the likelihood that the party seeking the injunction will ultimately win, if the party will <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/maryland-governors-effort-to-end-unemployment-benefits-blocked-by-judge\/\" title=\"Maryland Governor\u2019s Effort To End Unemployment Benefits Blocked By Judge\">suffer irreparable harm<\/a> without preliminary intervention by the court, if the balance of equity tips in that party\u2019s favor, and the general public\u2019s interest. <\/p>\n<p>The coffee company is essentially asking the justices to \u201crestore uniformity\u201d under the <a href=\"https:\/\/www.nlrb.gov\/guidance\/key-reference-materials\/national-labor-relations-act\" target=\"_blank\" rel=\"noopener\" title=\"National Labor Relations Act\">National Labor Relations Act<\/a>, according to its brief to the nine justices, saying the simple two-factor test is far too lenient. The NLRA includes a section that provides plaintiffs with the basis for seeking injunctions against employers during <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/yellow-files-for-bankruptcy-blames-union-for-downfall\/\" title=\"Yellow Files declares bankruptcy, accuses union for downfall.\">ongoing labor disputes<\/a>.<\/p>\n<p>\u201cStarbucks\u2019s petition essentially asks SCOTUS to reject the notion that when the NLRB seeks a preliminary injunction, the lower court should give deference to the NLRB\u2019s version of events even if the employer presents substantial evidence that calls into question the NLRB\u2019s version of events,\u201d Jonathan Turner, a partner at Mitchell Silberberg &#038; Knupp, told the <em>Washington Examiner<\/em>.<\/p>\n<p>Turner said in this case, it appears as though Starbucks has shown significant evidence that calls into question the NLRB\u2019s version of events.<\/p>\n<p>Starbucks presented video evidence in lower court proceedings that revealed the Memphis 7 were only discharged from their duties after they had violated company policy by returning to a store location after hours, letting in news crews, and locking the doors behind them \u201cso that the interviews could occur regarding their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nlrb-adopts-a-dirty-union-trick-to-infiltrate-the-government-with-marxists\/\" title=\"NLRB adopts union tactic to infiltrate government with Marxists.\">union organizing efforts<\/a>,\u201d according to Turner.<\/p>\n<p>Ronald Mann, who wrote a preview of the case for<em> SCOTUSBlog<\/em>, said the case on Tuesday \u201cmay be yet another step in the court\u2019s seeming effort to curtail the power of federal agencies this term.\u201d<\/p>\n<p>The Supreme Court has already this term weighed <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2439076\/supreme-court-questions-federal-agencies-ability-to-serve-as-judge-and-jury\/\" target=\"_blank\" rel=\"noopener\" title>several cases<\/a> asking the justices whether to curtail or in some ways limit the broader deference to federal agencies. The justices have already been asked to do away with the 1984 <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2800320\/fishermen-head-to-supreme-court-to-cast-chevron-overboard\/\" target=\"_blank\" rel=\"noopener\" title><em>Chevron <\/em>doctrine<\/a>, the long-standing precedent that federal courts should defer to an agency and its \u201creasonable\u201d interpretation of congressional statutes.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>\u201cI would be surprised if several of the justices are not attracted to the logic of holding an agency to the same standard the court traditionally applies for private litigants, leaving it to Congress to specify departures from that standard,\u201d Mann <a href=\"https:\/\/www.scotusblog.com\/2024\/04\/court-to-mull-injunction-in-starbucks-case-against-memphis-union-organizers\/\" target=\"_blank\" rel=\"noopener\" title=\"wrote\">wrote<\/a> for his preview of the <em>Starbucks <\/em>case, adding that he expects \u201csome justices will be disturbed by the NLRB\u2019s extensive attention on Starbucks.\u201d<\/p>\n<p>Arguments will be heard Tuesday at 10 a.m. local time, and a decision in the case is expected by the end of June.<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court will review Starbucks&#8217; challenge to rehire fired union activists, addressing agency authority.
