Lake and Mark Finchem argued that Arizona-certified optical scanners and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pa-county-reports-voting-machine-issues-affecting-republican-ballots-dominion-releases-statement\/\" title=\"PA County Reports Voting Machine Issues Affecting Republican Ballots; Dominion Releases Statement\u00a0\">ballot marking devices<\/a> were wrongly certified. The \u2062case was previously dismissed by a federal judge in 2022 and\u2064 later by the 9th U.S. Circuit Court of Appeals in October \u200b2023. The \u200cU.S. \u2064Supreme \u200bCourt&#8217;s refusal\u200d to entertain Kari Lake&#8217;s voting machine lawsuit is a blow to\u200c the ex-Arizona gubernatorial candidate. Lake and Mark Finchem contended\u2062 that the Arizona-certified optical scanners and ballot marking devices were wrongly endorsed. This legal battle faced\u200c rejection first by a federal judge\u200d in 2022 and then by the 9th U.S. Circuit Court of Appeals in October 2023.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div data-td-block-uid=\"tdi_78\">\n<p>The U.S. <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\/\" target=\"_blank\" rel=\"noopener\" title>Supreme Court<\/a> has opted not to hear <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/kari-lake\/\" target=\"_blank\" rel=\"noopener\" title>Kari Lake\u2019s<\/a> voting machine lawsuit, spelling further trouble for the former Arizona gubernatorial candidate\u2019s lawsuit.<\/p>\n<p>The lawsuit had been filed by Lake and former Arizona secretary of state candidate Mark Finchem, who argued in their <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/court\/\" target=\"_blank\" rel=\"noopener\" title>court<\/a> filing that they had sufficiently argued that all Arizona-certified optical scanners and ballot marking devices \u201chave been wrongly certified for use.\u201d Prior to the Supreme Court declining to take up the case, the lawsuit was rejected by a federal judge in 2022, with that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/indiana-supreme-court-upholds-firing-of-catholic-school-teacher-over-same-sex-marriage\/\" title=\"Indiana Supreme Court Upholds Firing Of Catholic School Teacher Over Same-Sex Marriage\">decision affirmed<\/a> by the 9th U.S. Circuit Court of Appeals in October 2023.<\/p>\n<p>\u201cWe are obviously disappointed that the U.S. Supreme Court decided not to review the decisions of the Arizona district court and the Ninth Circuit, and order that our challenge to the 2022 election procedures be heard on the merits,\u201d a Monday <a href=\"https:\/\/thehill.com\/homenews\/campaign\/4611220-supreme-court-declines-to-hear-kari-lake-voting-machine-lawsuit\/\" target=\"_blank\" rel=\"noopener\" title>statement<\/a> from Kurt Olsen, one of Lake\u2019s attorneys, said.<\/p>\n<figure><figcaption>Republican Arizona Senate candidate Kari Lake speaks at the 2024 Conservative Political Action Conference in Oxon Hill, Maryland, Feb. 24, 2024. (AP Photo\/Alex Brandon, File)<\/figcaption><\/figure>\n<p>Olsen added that Lake and Finchem\u2019s case was dismissed due to \u201ca purported lack of standing to assert an injury,\u201d and that the courts have not ruled on the case\u2019s merits because of this. Ruben Gallego (D-AZ), both of whom are seeking to replace Sen. <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/kyrsten-sinema\/\" target=\"_blank\" rel=\"noopener\" title>Kyrsten Sinema<\/a> (I-AZ).
