The U.S. Supreme Court has agreed to review the\u2063 Biden\u2062 administration&#8217;s appeal regarding the regulation\u2062 of ghost \u2064guns. In \u20622022, the Bureau of\u2062 Alcohol, Tobacco,\u200b Firearms, and Explosives expanded the definition of &#8220;firearm&#8221; under the \u2063Gun Control Act of 1968. The debate in \u2064court focuses on the\u2062 extent of federal gun regulations and the enforcement of background checks and serial numbers on ghost\u200d gun parts.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p style=\"font-weight: 400\">On Monday, the U.S. Supreme Court agreed to consider the Biden administration\u2019s appeal of a decision that rejected the administration\u2019s regulation of ghost guns.<\/p>\n<p style=\"font-weight: 400\">In 2022, the Biden administration\u2019s Bureau of Alcohol, Tobacco, Firearms and Explosives broadened the interpretation of the definition of \u201cfirearm\u201d in the Gun Control Act of 1968. \u201cThe 1968 Gun Control Act, the 1988 Undetectable Firearms Act and other federal laws all govern firearms produced by a 3D printing process or any other process, just as they apply to conventional manufacturing processes using machine tools,\u201d NSSF <a href=\"https:\/\/www.nssf.org\/government-relations\/factsheets\/ghost-guns-undetectable-firearms-explained-2\/\" target=\"_blank\" rel=\"noopener\">notes<\/a>. The Gun Control Act interpreted \u201cfirearm\u201d to mean \u201cany weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of an explosive\u201d and \u201cthe frame or receiver of any such weapon.\u201d<\/p>\n<p style=\"font-weight: 400\">The rule claimed that the parts in ghost guns lay under the rubric of \u201cfirearm\u201d under the federal Gun Control Act so the federal government could regulate them. It required \u201cmanufacturers and sellers to obtain licenses, mark their products with serial numbers and conduct background checks,\u201d The New York Times <a href=\"https:\/\/www.nytimes.com\/2024\/04\/22\/us\/supreme-court-ghost-guns.html\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p style=\"font-weight: 400\">In August 2023, in a 5-4 vote, the Supreme Court allowed the Biden administration\u2019s rule to stay in effect despite the fact that it had been challenged. In November, the 5th U.S. Circuit Court of Appeals found the Biden administration\u2019s regulation unlawful. \u201cOnly Congress may make the deliberate and reasoned decision to enact new or modified legislation regarding firearms,\u201d the court <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2024\/04\/22\/supreme-court-biden-ghost-gun-background-checks\/73280704007\/\" target=\"_blank\" rel=\"noopener\">wrote<\/a>. \u201cBecause Congress has neither authorized the expansion of firearm regulation nor permitted the criminalization of previously lawful conduct, the proposed rule constitutes unlawful agency action, in direct contravention of the legislature\u2019s will,\u201d they <a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/supreme-court-decide-biden-administration-can-regulate-ghost-guns-rcna147065\" target=\"_blank\" rel=\"noopener\">added<\/a>.<\/p>\n<p style=\"font-weight: 400\">Solicitor General Elizabeth Prelogar countered that if the 5th U.S. Circuit Court of Appeals\u2019 decision were implemented, \u201cAnyone could buy a kit online and assemble a fully functional gun in minutes \u2014 no background check, records, or serial number required. The result would be a flood of untraceable ghost guns into our nation\u2019s communities, endangering the public and thwarting law-enforcement efforts to solve violent crimes.\u201d<\/p>\n<p style=\"font-weight: 400\">\u201cIf a state placed a tax on the sale of home goods, such as tables, chairs, couches and bookshelves, Ikea surely could not avoid that tax by claiming that it does not sell any of those items and instead sells \u2018furniture parts kits\u2019 that must be assembled by the purchaser,\u201d she argued. \u201cSo too with guns: An ordinary speaker of English would recognize that a company in the business of selling kits that can be assembled into firearms in minutes \u2014 and that are designed, marketed and used for that express purpose \u2014 is in the business of selling firearms.\u201d<\/p>\n<p style=\"font-weight: 400\">A brief for the Supreme Court asserted, \u201cConsistent with Congress\u2019s decision not to interfere with the making of firearms by private citizens, commercial production and sale of other items that may be used by private citizens to make firearms for their own use is outside the scope of the Act.\u201d<\/p>\n<p style=\"font-weight: 400\">Additionally, it offered another perspective, <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23A82\/274511\/20230802162019194_2023-08-02%20VanDerStok%20-%20Resp%20in%20Oppn%20to%20Stay%20vf.pdf\" target=\"_blank\" rel=\"noopener\">stating<\/a>:<\/p>\n<blockquote>\n<p style=\"font-weight: 400\"><em>A better analogy would be to a \u201ctaco kit\u201d sold as a bundle by a grocery store that includes taco shells, seasoning packets, salsa and other toppings, along with a slab of raw beef. No one would call the taco kit a taco. In addition to \u201cassembly,\u201d turning it into one would require cutting or grinding and cooking the meat \u2014 and until that was done, it would be nonsensical to treat it as food and the equivalent of a taco.<\/em><\/p>\n<\/blockquote>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The US Supreme Court will review the Biden administration&#8217;s appeal on regulating ghost guns following the ATF&#8217;s 2022 expansion of the &#8220;firearm&#8221; definition in the Gun Control Act of 1968.
