The Court&#8217;s decision highlighted that there is no threshold for harm required to allege discrimination under Title VII \u2064of the Civil Rights Act. This decision simplifies the process for\u200d employees alleging discrimination, as they are not required to demonstrate substantial harm to support their case.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>The Supreme Court on Wednesday made a decision that has largely flown under the radar, but has big implications for employers who have diversity, equity, and inclusion (DEI) programs.<\/p>\n<p>The Supreme Court <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-193_q86b.pdf\" target=\"_blank\" rel=\"noopener\">ruled<\/a> 9-0 in favor of St. Louis Police Sergeant Jatonya Clayborn Muldrow, who sued the St. Louis Police Department (SLPD) after she was transferred from one department to another against her wishes. Muldrow worked for nearly 10 years in the SLPD\u2019s specialized Intelligence Division, but in 2017, the new Intelligence Division commander requested she be transferred from the unit so she could be replaced with a man.<\/p>\n<p>The request was approved and Muldrow was transferred to a position where she was now \u201csupervising the day-to-day activities of neighborhood patrol officers,\u201d instead of working in the Intelligence Division. While her rank and pay remained the same, her job changed and she lost the use of an unmarked take-home vehicle, as well as a more regular schedule where she had weekends off.<\/p>\n<p>Muldrow sued, claiming she was discriminated against because she was a woman, a violation of Title VII of the Civil Rights Act. A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-upholds-arizona-voter-restrictions-spelling-trouble-for-doj-georgia-voter-rights-lawsuit\/\" title=\"Supreme Court Upholds Arizona Voter Restrictions, Spelling Trouble For DOJ Georgia \u2018Voter Rights\u2019 Lawsuit\">lower court found<\/a> she had not been discriminated against because she did not show that she had been \u201csignificantly\u201d harmed by the transfer, so Muldrow appealed, eventually getting her case before the Supreme Court.<\/p>\n<p>The Supreme Court determined that there was no threshold for harm, and that someone alleging discrimination \u201cdoes not have to show \u2026 that the harm incurred was significant. Or serious, or substantial, or any similar adjective.\u201d<\/p>\n<p>Typically, Title VII prohibits employers from discriminating on the basis of \u201crace, color, religion, sex, or national origin\u201d when it comes to \u201ccompensation, terms, conditions, or privileges.\u201d<\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1713611654298000&#038;usg=AOvVaw3YPWSe9w05H79aayRzLC1M\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p>With the Supreme Court decision stating that an employee doesn\u2019t have to show \u201csignificant\u201d harm, many have taken the new ruling to mean it will be easier for women and minorities to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/groomers-really-are-everywhere\/\" title=\"Groomers Really Are Everywhere\">sue based<\/a> on alleged discrimination.<\/p>\n<p>The American Civil Liberties Union (ACLU), for example, <a href=\"https:\/\/www.aclu.org\/press-releases\/supreme-court-delivers-big-win-for-workplace-equality-in-muldrow-v-city-of-st-louis-ruling\" target=\"_blank\" rel=\"noopener\">touted<\/a> the ruling as \u201ca huge victory for workers and workplace equality.\u201d<\/p>\n<p>But some conservatives have noted that this ruling could make it easier to sue employers who have DEI programs that favor women and minorities.<\/p>\n<p>The Daily Signal <a href=\"https:\/\/www.dailysignal.com\/2024\/04\/17\/supreme-court-just-made-easier-sue-employers-dei-policies\/\" target=\"_blank\" rel=\"noopener\">noted<\/a> that it\u2019s \u201cfashionable for corporate employers to create race- and sex-based employment conditions and privileges as part of their DEI initiatives.\u201d The outlet pointed to LinkedIn\u2019s \u201cemployee resource groups,\u201d which provide mentoring and training programs for \u201csystemically marginalized\u201d groups. The outlet suggests that these programs would fall under the \u201cprivileges of employment,\u201d mentioned under Title VII, and that the additional pay given to leaders of these groups would count as \u201ccompensation\u201d under the law.<\/p>\n<p>The ACLU pushed back on this notion, with Ming-Qi Chu, the deputy director of the organization\u2019s Women\u2019s Rights Project, dismissing the idea as \u201cfearmongering.\u201d<\/p>\n<p>\u201cThe fearmongering of DEI opponents has no basis in law and fundamentally misunderstands how most DEI programs work. The purpose of DEI and other remedial workplace programs is to improve the process by which employment decisions are made and close the gap in opportunities among workers. They do not disadvantage any particular worker. This is why they have long been held lawful. These scare-tactics are trying to chill employers\u2019 commitment and investment in expanding workplace opportunity.
