The rules, which redefine sex to include \u200dgender identities, lack clarity on transgender sports participation. Criticism also stemmed from\u200c Bob Eitel, citing radical changes, and Nicole Neily, concerned about school discretion. Concerns extend to due process \u2062protections for students accused of sexual misconduct.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Former Education Secretary <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/betsy-devos\/\" target=\"_blank\" rel=\"noopener\" title>Betsy DeVos<\/a> slammed the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noopener\" title>Biden administration\u2019s<\/a> <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/title-ix\/\" target=\"_blank\" rel=\"noopener\" title>Title IX<\/a> overhaul, saying the statute created to protect women would now be used to \u201charm\u201d them.<\/p>\n<p>The Biden administration <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2971440\/biden-administration-finalizes-controversial-title-ix-rule\/\" target=\"_blank\" rel=\"noopener\" title>finalized the rules<\/a> on Friday related to sex discrimination and sexual harassment under Title IX, redefining sex to include claimed gender identities. The rules did not <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/now-its-girls-irish-dancing-trans-teen-winner-muscles-females-out-of-prestigious-world-competition-slot\/\" title=\"Trans Teen Wins Prestigious World Irish Dancing Slot, Outshining Female Competitors\">address transgender participation<\/a> in sports, which is part of separate rulemaking likely to be finalized near the end of the year.<\/p>\n<p>\u201cI never thought I\u2019d see the day where Title IX would be used to harm women, but sadly, that day has come,\u201d DeVos, who ushered through the Education Department\u2019s 2020 rulemaking on Title IX, said in a statement. \u201cThe Biden Administration\u2019s radical rewrite of Title IX guts the half century of protections and opportunities for women and\u00a0callously replaces them with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/men-are-not-women\/\" title=\"Men Are Not Women\">radical gender theory<\/a>, as Biden\u2019s far-left political base demanded.\u201d<\/p>\n<p>DeVos explained that the new rules require that boys be allowed in girls\u2019 bathrooms as early as elementary school, and she said that even these rules would likely have an effect on women\u2019s sports, aside from the forthcoming rules specific to that topic.<\/p>\n<p>The Biden administration was roundly slammed by other organizations as well.<\/p>\n<p>Bob Eitel, co-founder of the Defense of Freedom Institute and former senior counsel to DeVos during the Trump administration, said, \u201cPresident Biden\u2019s new Title IX rule is a textbook example of how extremists in the administration have hijacked the law to force radical changes in American society through its schools, colleges, and universities.\u201d<\/p>\n<p>\u201cGender ideology reigns supreme in Biden\u2019s new rule that redefines \u2018sex\u2019 under Title IX to include an undefined \u2018gender identity\u2019 despite the law\u2019s exquisitely clear text, purpose, and legislative history that sex is biological and binary,\u201d he added.<\/p>\n<p>Nicole Neily, president of Parents Defending Education, added, \u201cExtending Title IX to cover gender identity means that schools will no longer have discretion over whether \u2014 or how \u2014 to provide certain services and activities to students on the basis of self-declared gender identity.\u201d<\/p>\n<p>\u201cTitle IX was written in 1972 when \u2018sex\u2019 meant male and female, and no amount of interpretive jiujitsu permits a cabinet agency to rewrite the plain language of the law,\u201d she concluded.<\/p>\n<p>One major concern is the changes to due process protections for students accused of sexual misconduct on college campuses that the Education Department, under DeVos, worked to ensure during the 2020 rulemaking process.<\/p>\n<p>The Biden administration said it kept several of those <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-southern-baptist-convention-must-respond-to-reports-of-abuse-with-full-transparency\/\" title=\"The Southern Baptist Convention Must Respond To Reports Of Abuse With Full Transparency\">due process provisions<\/a>, but Eitel said the White House \u201csugarcoats\u201d the \u201cgutting\u201d of those protections. \u201cIt is a sure bet that the campus \u2018kangaroo courts\u2019 and \u2018guilty until proven innocent\u2019 approach to Title IX discipline that plagued schools for so long will now return to campuses,\u201d he said.<\/p>\n<p>Will Creeley, legal director for the Foundation for Individual Rights and Expression, also criticized the impact of new standards for investigating campus misconduct, saying, \u201cColleges should use the time-tested tools that make finding the truth more likely. But the new regulations no longer require them to do so.
