Comparisons with cases \u200binvolving liberal judges&#8217; spouses show no ethical issues raised. \u200dJustice\u200c Thomas stands firm with no reason for recusal.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>The left\u2019s intolerance toward an independent Supreme Court and its gaslighting tactics are on full display in the latest calls for Justice Clarence Thomas to recuse from the presidential immunity case the court will hear next week. <a href=\"http:\/\/MoveOn.org\" target=\"_blank\" rel=\"noreferrer noopener\">MoveOn.org<\/a> is even raising money off this absurd claim to pressure Justice Thomas to recuse. These thuggish tactics won\u2019t work.  <\/p>\n<p>President Trump is presenting the argument that he is immune from prosecution for any official acts he took as president, including those related to the 2020 election integrity challenges and the events of Jan. 6,2021. The left <a href=\"https:\/\/verdict.justia.com\/2024\/04\/12\/how-not-to-restore-public-confidence-in-the-supreme-court\" target=\"_blank\" rel=\"noreferrer noopener\">demands<\/a> that Justice Thomas recuse himself from this case and all Jan. 6-related cases because he has an alleged conflict of interest arising from his wife\u2019s activities regarding the post-2020 election integrity challenges and the events of Jan. 6. But Ginni Thomas\u2019 activities raise no conflicts of interest requiring Justice Thomas\u2019 recusal from these cases, and it\u2019s not even a close call.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-939573214\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-cfa5855bc60f4bc3dc9e74ea70c9f6bb fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-cfa5855bc60f4bc3dc9e74ea70c9f6bb\"><\/div>\n<h2 class=\"wp-block-heading\"><strong>Dishonest and Unfounded Attacks<\/strong><\/h2>\n<p>Ginni Thomas is a longtime political activist. Like millions of Americans, she raised questions about fraud and irregularities in the 2020 election. The attacks on her, including in a recent <a href=\"https:\/\/verdict.justia.com\/2024\/04\/12\/how-not-to-restore-public-confidence-in-the-supreme-court\" target=\"_blank\" rel=\"noreferrer noopener\">piece<\/a> by Professor Gary Simson, a longtime Justice Thomas <a href=\"https:\/\/scholarship.law.cornell.edu\/cgi\/viewcontent.cgi?article=2308&#038;context=facpub\" target=\"_blank\" rel=\"noreferrer noopener\">hater<\/a>, are dishonest and misleading. <\/p>\n<p>For example, Simson claims she \u201ctirelessly lobbied Republican state legislators to displace lawful electors.\u201d That\u2019s a lie.\u00a0Ginni Thomas sent two prewritten form emails to a group of state legislators who were selected by others. She did not write the emails, did not edit them, and did not pick the legislators. She merely pushed the send button. That\u2019s not even \u201cworked a little\u201d and certainly not \u201ctirelessly lobbied.\u201d The rest of Simson\u2019s screed is of the same level of dishonesty.<\/p>\n<p>Yes, Mrs. Thomas had significant <a href=\"https:\/\/www.markpaoletta.com\/jan-6-letter-on-behalf-of-ginni-thomas\" target=\"_blank\" rel=\"noreferrer noopener\">concerns<\/a> about potential fraud and irregularities in the 2020 election, and her minimal activity was focused on ensuring that reports of fraud and irregularities were investigated. This is nothing out of the ordinary. In fact, we have seen many instances of <a href=\"https:\/\/x.com\/CoVet_81\/status\/1714681668093521931\" target=\"_blank\" rel=\"noreferrer noopener\">Democrats<\/a> <a href=\"https:\/\/x.com\/KanekoaTheGreat\/status\/1687285384361979904\" target=\"_blank\" rel=\"noreferrer noopener\">challenging<\/a> election results and Hollywood actors <a href=\"https:\/\/www.dailysignal.com\/2020\/12\/17\/how-democrats-attempted-a-2016-electoral-college-coup\/\" target=\"_blank\" rel=\"noreferrer noopener\">encouraging<\/a> Trump electors to vote for someone other than Trump in the certification process for the 2016 election.<\/p>\n<p>Beyond that, Mrs. Thomas played <a href=\"https:\/\/x.com\/MarkPaoletta\/status\/1608927004761681922\" target=\"_blank\" rel=\"noreferrer noopener\">no role<\/a> in any events following the 2020 election. She briefly attended the Jan. 6 rally but left before President Trump spoke and long before some of the crowd went to the Capitol. She also condemned the violence on Jan. 6, which was reflected in one of her texts to White House Chief of Staff Mark Meadows at the time. Ginni Thomas\u2019 activities were minimal and mainstream. <\/p>\n<div class=\"fdrlst__b89e9-70d62754d79b19a968a0f7122db3171e fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-70d62754d79b19a968a0f7122db3171e\"><\/div>\n<p>But don\u2019t take my word for it.\u00a0The congressional Select Committee to Investigate Jan. 6 <a href=\"https:\/\/www.markpaoletta.com\/jan-6-letter-on-behalf-of-ginni-thomas\">requested<\/a> to interview Ginni Thomas, and despite there being no legitimate reason to interview her, she fully cooperated with the committee\u2019s inquiry. Mrs. Thomas voluntarily <a href=\"https:\/\/x.com\/MarkPaoletta\/status\/1608927004761681922\">met<\/a> with the committee for four hours and answered every question posed to her to the best of her recollection. <\/p>\n<p>After this inquiry, the 100 percent partisan Democrat-appointed J6 Committee did not <a href=\"https:\/\/x.com\/MarkPaoletta\/status\/1608927004761681922\" target=\"_blank\" rel=\"noreferrer noopener\">mention<\/a> her name once in its comprehensive 845-page final report. Nor was Mrs. Thomas mentioned in any of the committee\u2019s hearings.\u00a0So much for Simson\u2019s baseless argument that she had \u201cintimate involvement\u201d in the 2020 post-election activities.   <\/p>\n<h2 class=\"wp-block-heading\"><strong>Refusing to Recuse, a Precedent <\/strong><\/h2>\n<p>In one of the most celebrated recusal cases in modern times, leftist Judge Stephen Reinhardt of the U.S. Court of Appeals for the Ninth Circuit <a href=\"https:\/\/thefederalist.com\/2022\/10\/10\/no-justice-clarence-thomas-doesnt-have-to-recuse-because-his-wife-has-political-opinions\/\">refused<\/a> to recuse from an appeal of a challenge to a same-sex marriage ban despite his wife\u2019s organization, the ACLU-Southern California chapter (ACLU-SC), weighing in in the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/abortions-plunged-staggering-60-in-texas-first-month-after-heartbeat-act-went-into-effect\/\" title=\"Abortions Plunged Staggering 60% In Texas First Month After \u2018Heartbeat Act\u2019 Went Into Effect\">district court proceedings<\/a> below.<\/p>\n<p>The ACLU-SC, and specifically its Executive Director Ramona Ripston, vocally opposed this law. In fact, the ACLU-SC joined two amicus briefs in the district court arguing that this amendment violated the U.S. Constitution. At the time, Ripston was married to Judge Reinhardt.<\/p>\n<div class=\"fdrlst__b89e9-be1174d1a7a7559f064a583b162b087d fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-be1174d1a7a7559f064a583b162b087d\"><\/div>\n<p>Judge Reinhardt refused to recuse, and his <a href=\"https:\/\/cite.case.law\/f3d\/630\/909\/\" target=\"_blank\" rel=\"noreferrer noopener\">opinion<\/a> setting forth his reasons should be read aloud by every critic who believes Justice Thomas must recuse from these Jan. 6-related cases because of his wife\u2019s views:<\/p>\n<blockquote class=\"wp-block-quote\">\n[M]y wife and I share many fundamental interests by virtue of our marriage, but her views regarding issues of public significance are her own, and cannot be imputed to me, no matter how prominently she expresses them. \u2026<\/p>\n<p>My wife has no \u201cinterest\u201d in the outcome of this case that might be substantially affected by its outcome, over and beyond the interest of any American with a strong view concerning the social issues that confront this nation.<\/p>\n<\/blockquote>\n<p>Five judicial ethics experts, including Professor Stephen Gillers, filed a <a href=\"https:\/\/www.law.nyu.edu\/sites\/default\/files\/ECM_PRO_075198.pdf\">brief<\/a> in the U.S. Supreme Court supporting this decision: <\/p>\n<blockquote class=\"wp-block-quote\">\n<p>Ms. Ripston\u2019s opinions, views, and public pronouncements of support for the district court decision below do not trigger any reasonable basis to question Judge Reinhardt\u2019s ability to honor his oath of office. A contrary outcome would deem a judge\u2019s spouse unable to hold most any position of advocacy, creating what amounts to a disabling marriage penalty.<\/p>\n<\/blockquote>\n<p>The left celebrated Judge Reinhardt for not recusing on this case and attacked anyone who raised any concerns about Reinhardt not recusing.\u00a0But this fits a pattern where the left rarely if ever has any ethics concerns about the spouses of liberal judges.<\/p>\n<p>The left did not have any concerns when Justice Ginsburg never once recused from cases in which her husband\u2019s law firm <a href=\"https:\/\/www.newsweek.com\/baseless-recusal-attack-clarence-thomas-opinion-1686780\">represented<\/a> clients in cases before the Supreme Court.\u00a0She even <a href=\"https:\/\/thefederalist.com\/2023\/07\/20\/democrats-concerned-with-scotus-ethics-rules-should-look-into-leftist-justices-first\/\">ruled<\/a> in favor of the clients of her husband\u2019s firm. <\/p>\n<p>The left had no problem when D.C. Circuit Judge Nina Pillard\u2019s husband, David Cole, who is the ACLU\u2019s national litigation director, <a href=\"https:\/\/www.washingtonexaminer.com\/magazine-features\/766390\/the-medias-war-on-clarence-and-ginni-thomas\/\" target=\"_blank\" rel=\"noreferrer noopener\">publicly agreed<\/a> with a district court judge\u2019s ruling rejecting President Trump\u2019s argument that he did not have to produce his taxes pursuant to a congressional subpoena, and then Judge Pillard participated in a full D.C. Circuit proceeding that allowed that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/female-high-school-students-appeal-ruling-on-transgender-athletes\/\" title=\"Female High School Students Appeal Ruling on Transgender Athletes\">district court ruling<\/a> to stand.  <\/p>\n<p>Ginni Thomas does not have an \u201cinterest\u201d in the presidential immunity case, which involves whether Trump has immunity for any official action he took as president, or any Jan. 6-related case that will come before the Supreme Court, as that <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/28\/455\" target=\"_blank\" rel=\"noreferrer noopener\">term<\/a> is defined in the statute. She is not a party, nor a lawyer in the proceeding, nor a witness, and she has no \u201cinterest that could be substantially affected by the outcome\u201d of the case. Justice Thomas has no reason to recuse.<\/p>\n<p>But the left likes to gaslight the American people by claiming Justice Thomas\u2019 \u201cimpartiality might reasonably be questioned\u201d in these cases, when they ignore all the other times they were perfectly fine with liberal justices sitting on cases where their spouse had some connection or more serious questions could be raised about impartiality.<\/p>\n<p><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2023\/07\/20\/democrats-concerned-with-scotus-ethics-rules-should-look-into-leftist-justices-first\/\" target=\"_blank\" rel=\"noreferrer noopener\">If Democrats Are Worried About SCOTUS Ethics Rules, They Should Look Into Lefty Justices First<\/a>]<\/strong><\/p>\n<p>It\u2019s only Justice Thomas who must recuse from cases because his wife has expressed her views on a general topic, but, unlike Judge Reinhardt\u2019s wife, never on the legal merits of a specific case before the court. This double standard also has a whiff of racism, with the left portraying Justice Thomas as heavily influenced by his wife\u2019s views. Leftist <a href=\"https:\/\/x.com\/swskaggs\/status\/1597668087662534663\">memes<\/a> on X showing Ginni Thomas removing a mask of her husband\u2019s face to signal that it\u2019s really her making these decisions reveal the despicable racism that characterizes the left\u2019s ideology and decades-long campaign against Justice Thomas.<\/p>\n<p>These attacks demanding Justice Thomas recuse have nothing whatsoever to do with ethics or a concern about the public\u2019s trust in the court. The left\u2019s recusal demands are meant to shrink the court so that the left has their preferred leftist justices deciding these cases. Thanks to Trump\u2019s three appointments to the court, the left is furious they no longer have a court that acts like a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/clarence-thomas-has-no-reason-to-recuse-from-any-j6-cases-and-its-not-even-close\/\" title=\"Clarence Thomas has no grounds for recusal in any January 6 cases, and the argument is clear\">super-legislature implementing left-wing policies<\/a> like race-based affirmative action.   <\/p>\n<p>More generally, Simson and his leftist allies\u2019 baseless and vicious smears are meant to undermine the public\u2019s trust in the court and gaslight the American people to believe there is an ethics crisis.
