During a hearing, GOP\u2063 lawmakers challenged the Department of \u2063Homeland Security&#8217;s approach\u200b to immigrant detention, highlighting \u2063conflicting \u200cstatements on resource availability. McCarthy leads delegation of GOP reps. to southern border\">await immigration court proceedings<\/a>.<\/p>\n<p>GOP lawmakers on the House Homeland Security Committee attempted to poke holes during a hearing on Capitol Hill into Mayorkas\u2019s statements that the <a href=\"https:\/www.washingtonexaminer.com\/tag\/dhs\" title>Department of Homeland Security<\/a> wants to detain more immigrants at U.S. Immigration and Customs Enforcement detention centers but was stretched too thin financially to do so.<\/p>\n<p>\u201cThere are thousands of beds available per day, roughly 9,000 on average in FY 2022, 3,000 a day in FY 2023,\u201d said House Homeland Security Chairman Mark Green (R-TN) during a DHS appropriations hearing Tuesday. \u201cYet the arguments before the Supreme Court and in your testimony before here to Congress had been that the resources are overwhelmed and therefore we have to just catch and release these people into the country.<\/p>\n<p>\u201cIn your opening statement, you said we need more resources,\u201d Green said to Mayorkas. \u201cThat claim for more resources so that we can adhere to the laws \u2014 you\u2019re actually in this budget decreasing the requested ICE detention beds. That seems to me to be illogical if the reason we can\u2019t enforce the laws as they\u2019re written on the books is because we don\u2019t have enough resources. There are thousands of empty beds. (AP Photo\/Jose Luis Magana)<\/figcaption><\/figure>\n<p>\u201cWhen the relevant provisions of the INA were passed in 1996, there were fewer than 10,000 beds while apprehensions were routinely over 1 million,\u201d DHS wrote in the email. \u201cCongress has never provided the funding for detaining every individual who crosses illegally.\u201d<\/p>\n<p>But Republicans who met Tuesday to ask Mayorkas about the fiscal 2025 budget, which would go into effect in October, said the Biden administration\u2019s proposal to fund <a href=\"https:\/\/www.dhs.gov\/sites\/default\/files\/2024-03\/2024_0311_fy_2025_budget_in_brief.pdf\" title>34,000<\/a> beds sorely missed the mark. Mayorkas defended how the department had approached bed space for the forthcoming year.<\/p>\n<p>\u201cMr. Chairman, let me be very clear that we maximize the use of detention beds that are available,\u201d Mayorkas said.<\/p>\n<p>The hearing fell on the same day House Republicans <a href=\"https:\/\/www.washingtonexaminer.com\/news\/senate\/2968019\/house-delivers-mayorkas-impeachment-articles-senate\/\" target=\"_blank\" rel=\"noopener\" title=\"transmitted two articles of impeachment\">transmitted two articles of impeachment<\/a> against Mayorkas to the Senate for trial proceedings. Republicans impeached Mayorkas in February, alleging his handling of the border crisis amounted to high crimes and misdemeanors, but the Democrat-led Senate is expected to dismiss the charges.<\/p>\n<p>The DHS website contains budgets going back to 2004, when the department was created. The oldest available information on the DHS site on the number of beds the White House requested funding for was in 2007, when the Bush administration requested<a href=\"https:\/\/www.dhs.gov\/xlibrary\/assets\/Budget_BIB-FY2007.pdf\" title> 27,500<\/a> beds. That number rose through the years and grew to <a href=\"https:\/\/www.dhs.gov\/sites\/default\/files\/publications\/FY_2016_DHS_Budget_in_Brief.pdf\" title>34,000<\/a> by 2016, then <a href=\"https:\/\/www.dhs.gov\/sites\/default\/files\/publications\/fy_2021_dhs_bib_0.pdf\" title>60,000<\/a> in 2021 as the Trump administration cracked down on illegal immigration.<\/p>\n<p>Ahead of fiscal 2022, the Biden White House proposed cutting bed space by nearly half to <a href=\"https:\/\/www.dhs.gov\/sites\/default\/files\/publications\/dhs_bib_-_web_version_-_final_508.pdf\" title>32,500<\/a> beds. The pandemic had significantly slowed illegal immigrant arrests at the southern border, but by January 2021, the number of people attempting to cross began to soar. Still, the Biden administration pushed for reduced ICE space despite its Title 42 public health authority to immediately turn away immigrants at the border.<\/p>\n<p>Instead, the Biden administration began to arrest then release immigrants into the United States with few facing detention through court proceedings, years down the road.<\/p>\n<p>The Biden White House proposed further reducing detention space to <a href=\"https:\/\/www.dhs.gov\/sites\/default\/files\/2022-03\/22-%201835%20-%20FY%202023%20Budget%20in%20Brief%20FINAL%20with%20Cover_Remediated.pdf\" title>25,000<\/a> beds in 2023. At that time in 2022, Border Patrol agents at the southern border were arresting roughly <a href=\"https:\/\/www.cbp.gov\/newsroom\/stats\/southwest-land-border-encounters\" title>200,000<\/a> illegal immigrants each month, very few of whom would be detained.<\/p>\n<p>Biden\u2019s DHS recommended bed space for 2024 remained at <a href=\"https:\/\/www.dhs.gov\/sites\/default\/files\/2023-03\/DHS%20FY%202024%20BUDGET%20IN%20BRIEF%20%28BIB%29_Remediated.pdf\" title>25,000<\/a>, as illegal migrant arrests remained at an average of more than 200,000 people arrested per month in 2023.<\/p>\n<p>In 2023, roughly 36,800 illegal immigrants were detained by ICE, while more than 6.1 million were allowed to remain out of custody, according to the DHS data below.<\/p>\n<figure><figcaption>U.S. Immigration and Customs Enforcement \/ Department of Homeland Security<\/figcaption><\/figure>\n<p>Government data analyzed and released Tuesday by the Transactional Records Access Clearinghouse, a nonpartisan research center at\u00a0Syracuse University in New York, <a href=\"https:\/\/trac.syr.edu\/whatsnew\/email.240416.html\" title>concluded<\/a> that the number of illegal immigrants currently in ICE custody was at the lowest rate since the start of fiscal 2024 last October.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\" title>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>TRAC determined the decline in illegal migration at the southern border in recent weeks was the leading reason fewer people were being detained, but added that ICE has increasingly relied on electronic ways to track immigrants released at the border rather than detention.<\/p>\n<p>At present, 183,000 of the 6.<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/analysis-bidens-immigration-policies-may-fuel-migrant-caravan-crisis-at-southern-border\/\" title=\"Analysis: Biden\u2019s immigration policies may fuel migrant caravan crisis at southern border\">1 million illegal immigrants<\/a> in the U.S. were being tracked through ICE\u2019s Alternatives to Detention program, meaning the roughly 5.8 million remaining immigrants were either not being tracked or detained through standard means.<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>House Republicans pressed Alejandro Mayorkas, a key Biden administration border official, for releasing millions of illegal immigrants into the country instead of detaining them.
