The court ruled that the law, HB 3293\u200c from 2021, violated Title IX, which <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nancy-pelosi-mocked-after-bragging-she-told-ukraine-president-zelensky-that-billie-jean-king-sends-her-regards\/\" title=\"Nancy Pelosi Mocked After Bragging She Told Ukraine President Zelensky that Billie Jean King Sends Her Regards\">prohibits sex-based discrimination<\/a> in schools. The case involved Becky Pepper Jackson, a 13-year-old boy taking puberty-blocking medication, who was\u2063 denied participation in girls&#8217; sports. \u200cWest Virginia Attorney General Patrick\u2064 Morrisey vowed to continue \u2063fighting to uphold Title\u200d IX.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p style=\"font-weight: 400\">On Tuesday, the 4th U.S. Circuit Court of Appeals <a href=\"https:\/\/abcnews.go.com\/US\/wireStory\/federal-appeals-court-overturns-west-virginia-transgender-sports-109309437\">overturned<\/a> a West Virginia law that barred biological boys from participating in girls\u2019 sports.<\/p>\n<p style=\"font-weight: 400\">The court claimed that HB 3293, passed in 2021, violated Title IX, which bars sex-based discrimination in schools. The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/attorneys-who-won-supreme-court-gun-case-forced-to-quit-law-firm\/\" title=\"Attorneys Who Won Supreme Court Gun Case Forced To Quit Law Firm\">case revolved<\/a> around Becky Pepper Jackson, a 13-year-old boy who has been taking puberty-blocking medication and who was barred by the state from continuing to be a member of the middle school girls\u2019 cross country and track team.<\/p>\n<p style=\"font-weight: 400\">\u201cI will keep fighting to safeguard Title IX. We must keep working to protect women\u2019s sports so that women\u2019s safety is secured and girls have a truly <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/5-times-transgender-athletes-dominated-womens-sports\/\" title=\"5 Times Transgender Athletes Dominated Women\u2019s Sports\">fair playing field<\/a>,\u201d Republican West Virginia Attorney General Patrick Morrisey said after the decision was made. \u201cWe know the law is correct and will use every available tool to defend it.\u201d<\/p>\n<p style=\"font-weight: 400\">\u201cWomen and young girls deserve to compete on a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/brexit-trade-deal-published-as-uk-calls-for-end-to-ugly-divisions\/\" title=\"Brexit trade deal published as UK calls for end to \u2018ugly\u2019 divisions\">level playing field<\/a>,\u201d Alliance Defending Freedom Legal Counsel Rachel Rouleau <a href=\"https:\/\/adfmedia.org\/case\/bpj-v-west-virginia-state-board-education\">stated<\/a>. \u201cThe court\u2019s decision undermines equal opportunities and contradicts both biological reality and common sense. Title IX was designed to provide women with fair competition, and West Virginia\u2019s women\u2019s sports law does the same. Across the country, women and girls are unjustly losing medals, podium spots, public recognition, and the opportunity to compete when males take their places. While everyone knows that men competing against women creates huge disadvantages and safety concerns, the 4th Circuit fell prey to activists who are pushing an ideology over what is just for women and girls. The dissenting judge, G. Steven Agee, wrote that the opinion \u201cturns Title IX on its head and reverses the monumental work Title IX has done to promote girls\u2019 sports from its inception \u2026 B.P.J. displaced at least one hundred biological girls at track-and-field events and pushed multiple girls out of the top ten. Similarly, by making the conference championships in two events (something reserved for the top three girls on a team), B.P.J. took away at least two biological girls\u2019 opportunities to participate in the conference championships. And this was in a single season.
