Bonta argues that the voter ID policy contradicts the foundational principle of \u200dfree voting rights.\u2064 The measure, known as \u200cMeasure A, is set to go into effect \u2062in 2026 and includes \u200cprovisions for\u2062 in<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/huntington-beach-voters-approve-voter-id-for-city-elections-driving-california-leftists-nuts\/\" title=\"Huntington Beach voters pass voter ID, irking California leftists\">-person voting locations<\/a> and \u2062ballot drop-box monitoring. California \u200cAttorney General Rob Bonta has taken legal\u2064 action against Huntington Beach \u200cin an attempt to halt a \u2062voter ID law that \u2062was recently endorsed \u2062by the city&#8217;s residents. Bonta&#8217;s opposition to the voter ID policy is \u2063based on its perceived infringement on the fundamental right to vote freely. The law, referred to as Measure A, \u200dis scheduled to be implemented in 2026 and incorporates elements such as the establishment of additional in-person voting\u2062 sites and the supervision\u2063 of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/missouri-legislature-takes-an-axe-to-zuckbucks-in-state-elections\/\" title=\"Missouri Legislature Takes An Axe To Zuckbucks In State Elections\">ballot drop-boxes<\/a>.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<div>\n<figure>                         <\/figure>\n<\/p><\/div>\n<p>California Attorney General Rob Bonta sued Huntington Beach on Monday in an effort to prevent a voter ID law passed by city residents from taking effect. <\/p>\n<p>\u201cThe right to freely cast your vote is the foundation of our democracy and Huntington Beach\u2019s voter ID policy flies in the face of this principle,\u201d Bonta, a Democrat, <a href=\"https:\/\/www.courthousenews.com\/california-sues-huntington-beach-over-voter-id-referendum\/\" target=\"_blank\" rel=\"noreferrer noopener\">baselessly claimed<\/a> during a press conference.<\/p>\n<p>Passed by city voters during last month\u2019s California primaries, <a href=\"https:\/\/ocvote.gov\/sites\/default\/files\/elections\/2024%20Primary\/HBEA%201%20-%20LAYOUT.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Huntington Beach Measure A<\/a> amends the city charter by authorizing the local government to require electors to provide identification to vote in municipal elections. The provision \u2014 which won\u2019t take effect until 2026 \u2014 also allows the city to \u201cprovide more in-person voting locations\u201d and \u201cmonitor ballot drop-boxes.\u201d<\/p>\n<p>The initiative was originally <a href=\"https:\/\/thefederalist.com\/2024\/03\/11\/huntington-beach-voters-approve-voter-id-for-city-elections-driving-california-leftists-nuts\/\" target=\"_blank\" rel=\"noreferrer noopener\">proposed<\/a> and passed by Huntington Beach\u2019s city council late last year before it was sent to voters for approval. <\/p>\n<p>Prior to the council\u2019s passage of the measure, Bonta sent a <a href=\"https:\/\/oag.ca.gov\/system\/files\/attachments\/press-docs\/9-28-23%20HUNTINGTON%20BEACH%20VOTER%20ID%20BALLOT%20MEASURE_LETTER.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">letter<\/a> to Huntington Beach\u2019s leading officials in September, claiming the measure \u201cconflicts with state law.\u201d He also regurgitated the <a href=\"https:\/\/thefederalist.com\/2024\/02\/02\/if-democrats-love-democracy-why-do-they-attack-election-security-measures-voters-want\/\" target=\"_blank\" rel=\"noreferrer noopener\">debunked lie<\/a> that voter ID measures \u201cserve to suppress voter participation\u201d and threatened to take \u201caction\u201d if the city council failed to withdraw the proposal.<\/p>\n<p>Filed in Orange County Superior Court on Monday, Bonta\u2019s <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2024\/04\/bonta-huntington-beach-voter-id-lawsuit.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">suit<\/a> contends that local laws such as Huntington Beach\u2019s voter ID provision are \u201cpreempted and invalid\u201d in matters in which \u201clocal law conflicts with state law reasonably tailored to the resolution of a statewide concern.\u201d <\/p>\n<p>\u201cUnder the California Constitution, the laws of charter cities supersede state law with respect to \u2018municipal affairs,\u2019 but state law is supreme with respect to matters of \u2018statewide concern,&#8217;\u201d the lawsuit reads. \u201cCalifornia maintains a uniform and robust legal scheme for protecting the rights of eligible voters and safeguarding the integrity of the electoral process. These laws preempt the grant of authority under Section 705, subdivision (a)(2) of the Huntington Beach City Charter.\u201d<\/p>\n<p>Bonta further argued that Measure A \u201cconflicts with state law concerning voter eligibility and the right to cast a ballot,\u201d and that requiring city voters to present a form of ID for municipal elections undermines the authority of the California State Legislature, \u201cplacing the onus on registered voters to establish their eligibility to vote, and groundlessly challenging the right to vote.\u201d<\/p>\n<p>In a statement responding to the lawsuit, Huntington Beach City Attorney Michael Gates <a href=\"https:\/\/www.courthousenews.com\/california-sues-huntington-beach-over-voter-id-referendum\/\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> Courthouse News Service the city plans to \u201cvigorously uphold and defend the will of the people.\u201d <\/p>\n<p>\u201cThe people of Huntington Beach have made their voices clear on this issue and the people\u2019s decision on the March 5th ballot measures for election integrity is final,\u201d Gates said. <\/p>\n<p>Gates noted how <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billHistoryClient.xhtml?bill_id=202320240SB1174\" target=\"_blank\" rel=\"noreferrer noopener\">legislation<\/a> introduced earlier this year by Huntington Beach\u2019s Democrat state Sen. Dave Min \u2014 seeking to outlaw initiatives like Measure A \u2014 proves that Bonta\u2019s claims of illegality hold no weight. Min\u2019s bill would prohibit local governments \u201cfrom enacting or enforcing any charter provision, ordinance, or regulation requiring a person to present identification for the purpose of voting or submitting a ballot at any polling place, voting center, or other location where ballots are cast or submitted.\u201d<\/p>\n<p>As reported by Courthouse News Service, \u201cGates said this proves that Bonta [is] wrong \u2014 if passing voter ID laws was illegal, why was a new bill necessary?\u201d<\/p>\n<p>Bonta has asked the court to issue a writ of mandate declaring Huntington Beach\u2019s new voter ID law invalid and requiring the city \u201ccease its implementation or enforcement.\u201d He also requested a permanent injunction preventing the provision\u2019s implementation and enforcement, and a declaratory judgment proclaiming it \u201cis preempted by and violates\u201d state law. <\/p>\n<hr>\n<p>      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
