This law aims \u200bto safeguard minors\u200c from \u200cirreversible harm\u200c caused \u2063by <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/think-tank-report-questions-claims-that-puberty-blockers-hormones-prevent-suicide-among-trans-kids\/\" title=\"Think Tank Report Questions Claims That Puberty Blockers, Hormones Prevent Suicide Among \u2018Trans\u2019 Kids\">gender-related medical interventions<\/a>. The decision followed a \u200clower court&#8217;s injunction, which was partially lifted,\u200b permitting Idaho to uphold the legislation. It\u2063 clarifies \u200cthe main points concisely and effectively.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<div>\n<div>\n<figure>\n<p>         <span>Image Credit<\/span>FDRLST\/Canva       <\/p>\n<\/figure><\/div>\n<p>The U.S. Supreme Court on Monday <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23a763_n7io.pdf#page=14\" target=\"_blank\" rel=\"noreferrer noopener\">granted<\/a> Idaho\u2019s request to partially stay a lower court injunction that previously prohibited the state from enforcing its law criminalizing child sterilization and mutilation. <\/p>\n<p>The <a href=\"https:\/\/legislature.idaho.gov\/statutesrules\/idstat\/title18\/t18ch15\/sect18-1506c\/\" target=\"_blank\" rel=\"noreferrer noopener\">Vulnerable Child Protection Act<\/a>, passed by the Idaho legislature and signed into law <a href=\"https:\/\/thefederalist.com\/2023\/04\/06\/indiana-and-idaho-are-the-latest-states-to-ban-childhood-genital-mutilation\/\" target=\"_blank\" rel=\"noreferrer noopener\">in 2023<\/a>,  ensures those who participate in the physical and chemical \u201ctransing\u201d of a minor will face a felony charge and a maximum of 10 years behind bars for inflicting irreversible damage on children in the name of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gop-the-fight-against-critical-race-theory-has-only-just-begun\/\" title=\"GOP: The Fight Against Critical Race Theory Has Only Just Begun\">radical gender ideology<\/a>.<\/p>\n<p>\u201cThese medical and surgical interventions can cause irreversible physical alterations; and some render the patient sterile or with lifelong sexual dysfunction, while others <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/idaho-governor-signs-law-blocking-taxpayer-funding-for-trans-surgeries\/\" title=\"Idaho Governor approves law prohibiting the use of taxpayer funds for transgender surgeries\">mutilate healthy body organs<\/a>,\u201d the legislation\u2019s <a href=\"https:\/\/legislature.idaho.gov\/wp-content\/uploads\/sessioninfo\/2023\/legislation\/H0071SOP.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">statement of purpose declares<\/a>.<\/p>\n<p>A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-announces-new-legal-team-for-impeachment-defense-after-previous-team-collapsed\/\" title=\"Trump Announces New Legal Team For Impeachment Defense After Previous Team Collapsed\">federal district court<\/a> in the state halted enforcement of the law shortly before its enactment on Jan. 1, 2024. Clinton-appointed Judge B. Lynn Winmill <a href=\"https:\/\/thehill.com\/homenews\/lgbtq\/4595963-supreme-court-idaho-felony-ban-gender-affirming-care\/\" target=\"_blank\" rel=\"noreferrer noopener\">claimed<\/a> in his universal injunction that cross-sex hormones and other procedures falsely labeled as \u201cgender-affirming care\u201d are \u201csafe, effective, and medically necessary for some adolescents.\u201d <a href=\"https:\/\/thefederalist.com\/2024\/04\/10\/prominent-u-k-doctors-independent-review-finds-no-good-evidence-supports-chemically-castrating-kids\/\">Studies suggest otherwise.<\/a><\/p>\n<p>\u201cAmong other things, this meant Idaho could not enforce its prohibition against surgeries to remove or alter children\u2019s genitals, even though no party before the court had sought access to those surgeries or demonstrated that Idaho\u2019s prohibition of them offended federal law,\u201d Supreme Court Justice Neil Gorsuch noted in his concurrence. \u201cThe court\u2019s order promised to suspend Idaho\u2019s law indefinitely, too, as this litigation (like many today) may take years to reach final judgment.\u201d<\/p>\n<p>After Judge Winmill\u2019s injunction and an appeal to the Ninth Circuit, the Court of Appeals refused Idaho Attorney General Ra\u00fal Labrador\u2019s request for a stay on the district court\u2019s injunction, which the Supreme Court called a \u201cbrief unreasoned order.\u201d<\/p>\n<p>In a 5-4 decision on Monday, the Supreme Court determined that the district court \u201cprohibiting a State from enforcing any aspect of its <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/planned-parenthood-drops-lawsuit-against-lubbock-texas-over-abortion-ban-ordinance\/\" title=\"Planned Parenthood Drops Lawsuit Against Lubbock, Texas, over Abortion Ban Ordinance\">duly enacted law<\/a> against anyone\u201d went \u201cmuch further\u201d than permitted. <\/p>\n<p>\u201cOrdinarily, injunctions like these may go no further than necessary to provide interim relief to the parties,\u201d the concurring justices noted.<\/p>\n<p>Instead, the lower courts prevented Idaho \u201cfrom enforcing any aspect of its duly enacted law against anyone \u2014 all without any showing that other provisions in the statute violate federal law or the rights of any current party.\u201d <\/p>\n<p>\u201cAs in so many other recent cases, the district court\u2019s universal injunction effectively transformed a limited dispute between a small number of parties focused on one feature of a law into a far more consequential referendum on the law\u2019s every provision as applied to anyone,\u201d the ruling stated.<\/p>\n<p><a href=\"https:\/\/twitter.com\/gregg_re\/status\/1779997437148402083?s=46&#038;t=G1nRzF-HvbepVmWZPyfXAw\" target=\"_blank\" rel=\"noreferrer noopener\">Tucked into<\/a> the justices\u2019 order allowing enforcement of the law was a warning to lower courts against weaponizing universal injunctions, with Justice Gorsuch concluding:<\/p>\n<blockquote>\n<p>A return to a more piecemeal and deliberative judicial process may strike some as inefficient. It may promise less power for the judge and less drama and excitement for the parties and public.
