They argue that Allen was not read his Miranda Rights and was misled by Indiana State Police \u2062officials during the interview. The attorneys also claim crucial parts \u2064of the\u200b interview recording are missing or edited, casting doubt on its integrity. This legal battle aims to prevent jurors from hearing potentially tainted \u200bevidence during Allen&#8217;s trial.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>Defense attorneys for the man accused of killing two Delphi, Indiana, teens in 2017 don\u2019t want jurors to hear his recorded police interrogation, saying he was never read his Miranda Rights.<\/p>\n<p>In a motion <a href=\"https:\/\/fox59.com\/wp-content\/uploads\/sites\/21\/2024\/04\/Motionpdf.pdf\" target=\"_blank\" rel=\"noopener\">filed<\/a> on Monday, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/president-trump-please-pardon-jon-woods-a-victim-of-process-crimes-like-michael-flynn\/\" title=\"President Trump, Please Pardon Jon Woods, a Victim of Process Crimes Like Michael Flynn\">defense attorneys<\/a> Andrew Baldwin and Bradley Rozzi argued that their client, Richard Allen, had his civil rights violated during that interrogation, Fox 59 <a href=\"https:\/\/fox59.com\/indiana-news\/richard-allens-attorneys-claim-delphi-murders-suspect-was-lied-to-by-police-never-read-miranda-rights-during-interrogation\/amp\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>. In addition to not reading him his Miranda Rights, the attorneys argue that Indiana State Police officials lied to Allen during that interrogation.<\/p>\n<p>Allen, 50, has been charged with kidnapping and killing 13-year-old Abby Williams and 14-year-old Libby German, whose bodies were found off a hiking trail in Delphi, Indiana, back in 2017.<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/watchdogs-sound-alarm-as-ilhan-omar-continues-to-evade-financial-disclosure-of-reportedly-lucrative-book-deal\/\" title=\"Watchdogs Sound Alarm As Ilhan Omar Continues To Evade Financial Disclosure Of Reportedly Lucrative Book Deal\">latest filing<\/a> claims that on October 13, 2022, Allen and his wife drove to the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/police-show-up-to-home-in-quebec-after-neighbor-snitches-on-residents-for-illegally-gathering-drags-man-out-by-his-neck-video\/\" title=\"Police Show Up to Home in Quebec After Neighbor Snitches on Residents For \u201cIllegally Gathering\u201d \u2013 Drags Man Out by His Neck (VIDEO)\">police station<\/a> to pick up a car that had been seized nearly two weeks earlier as part of the investigation into Allen\u2019s involvement in the teens\u2019 deaths. When they arrived, the defense attorneys say, Allen was separated from his wife and questioned without being read his Miranda Rights or told he was free to leave at any time or that the interview was being recorded, Fox reported.<\/p>\n<p>Baldwin and Rozzi also argue that the beginning of the recorded interview either never existed or has disappeared in the years since.<\/p>\n<p>\u201cIn this case, either (a) the camera was only turned on after they were already minutes into the interview,\u201d the latest filing says. \u201cOr (b) the camera was recording the entire time, but the beginning of the interview was later edited out before being turned over to defense.\u201d<\/p>\n<p>Due to these issues, the defense attorneys say they don\u2019t want jurors at Allen\u2019s upcoming trial to hear the interview. Included in the interview are statements from police claiming to have expert testimony linking Allen to evidence found at the crime scene and a trooper telling him, \u201cYou\u2019re guilty, and I know it, and I\u2019m gonna f***ing prove it.\u201d<\/p>\n<p>The filing comes just days after Baldwin and Rozzi <a href=\"https:\/\/www.dailywire.com\/news\/delphi-murder-suspects-attorneys-dont-want-jailhouse-confessions-heard-at-trial\" target=\"_blank\" rel=\"noopener\">requested<\/a> to have Allen\u2019s prison confessions suppressed from the jury as well.<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/rep-swalwells-attorneys-claim-they-cant-corner-rep-brooks-to-serve-him-lawsuit\/\" title=\"Rep. Rozzi said in a motion to suppress statements filed Thursday that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/delphi-murder-suspects-attorneys-dont-want-jailhouse-confessions-heard-at-trial\/\" title=\"Defense lawyers for the Delphi murder suspect are fighting to prevent jailhouse confessions from being heard during the trial\">prison officials put inmates<\/a> at Allen\u2019s cell door and had them keep logs of everything Allen said and did. Rozzi said that some of those inmates actively questioned Allen, which Rozzi said amounts to a \u201csustained form of interrogation; one that lasted more than five months before he was finally broken.\u201d<\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1712932862202000&#038;usg=AOvVaw0plT8RRdMy9XUpIhocnjQS\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p>Rozzi argued in another filing that allowing those statements to be used in Allen\u2019s trial would violate his constitutional rights, since he didn\u2019t have an attorney present when he made the comments.<\/p>\n<p>Further, Rozzi said Allen \u201cslipped into a state of psychosis plagued with grossly disorganized, delusional, paranoid and highly dysfunctional behavior\u201d while he was in prison. This behavior included \u201cperiods of not sleeping for days, paranoia, stripping off his clothes, drinking toilet water, covering himself with and eating his own feces, and many other socially unacceptable behaviors.\u201d<\/p>\n<p>The defense attorneys also argued that Allen\u2019s alleged confessions don\u2019t even align with the evidence from the crime scene, meaning they can\u2019t be accurate.<\/p>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Defense attorneys representing Richard Allen, the accused in the 2017 Delphi, Indiana teen murder case, are seeking to exclude his police interrogation recording from the trial.
