The judge ruled that while prosecutors can inform jurors of\u200d Trump&#8217;s comments on the tape, they cannot play it or \u200dintroduce related\u200d <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/deplorable-and-predatory-behavior-the-lincoln-project-condemns-cofounder-after-nyt-reports-he-allegedly-sexually-harassed-14-year-old-boy\/\" title=\"\u2018Deplorable And Predatory Behavior\u2019: The Lincoln Project Condemns Cofounder After NYT Reports He Allegedly Sexually Harassed 14-Year-Old Boy\">sexual misconduct allegations<\/a>. \u2062This decision \u200cfollows efforts to link the tape to Trump&#8217;s payments to \u2063Stormy Daniels.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>A judge in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noreferrer noopener\">Donald Trump<\/a>\u2019s hush money trial denied prosecutors\u2019 request on Monday that they be permitted to use as evidence allegations of sexual assault against the former president related to the infamous <em>Access Hollywood<\/em> tape.<\/p>\n<p>Judge Juan Merchan said such allegations amounted to \u201crumors\u201d that would be prejudicial toward Trump, according to <a href=\"https:\/\/www.cnn.com\/politics\/live-news\/trump-hush-money-trial-04-15-24\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">reports<\/a> from the Manhattan courtroom.<\/p>\n<p>\u201cThey are very prejudicial, and at this point, given what we know today, it was just a rumor,\u201d Merchan said.<\/p>\n<p>The tape, a 2005 clip of Trump making a vulgar comment about women, aired a month before the 2016 presidential election. Prosecutors will be able to tell jurors what Trump said on the tape, but the judge said they cannot play it, nor can they introduce evidence of the sexual misconduct allegations that surfaced in the weeks after it leaked.<\/p>\n<p>Manhattan District Attorney Alvin Bragg had asked Merchan for permission to use the tape and related material as evidence against Trump as a way to prove that Trump was allegedly incentivized in 2016 to pay porn star Stormy Daniels to silence her to help his election prospects.<\/p>\n<p>The tape and subsequent sexual assault allegations made by three women sent Trump\u2019s campaign into a \u201ctailspin,\u201d prosecutors <a href=\"https:\/\/www.politico.com\/live-updates\/2024\/04\/15\/trump-hush-money-criminal-trial\/no-access-hollywood-tape-00152240\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> Monday, arguing that it was crucial that they be able to prove that to the jury, according to <em>Politico<\/em>.<\/p>\n<p>Merchan decided in an order last month that prosecutors would not be permitted to air the tape during the trial but that they could use testimony about the tape. Merchan indicated at the time that he would save his decision on whether to allow prosecutors to use the sexual assault allegations for the first day of trial.<\/p>\n<p>Merchan had said in the order that he agreed with Trump \u201cthat a compromise should be struck to avoid undue prejudice to the Defendant.\u201d<\/p>\n<p>\u201cThis Court rules that the proper balance lies in allowing the People to elicit testimony about a videotaped interview which surfaced on October 7, 2016, that contained comments of a sexual nature which Defendant feared could hurt his presidential aspirations,\u201d Merchan wrote. \u201cHowever, it is not necessary that the tape itself be introduced into evidence or that it be played for the jury.\u201d<\/p>\n<p>Merchan reiterated Monday that the tape itself could not be played for the jury, saying, according to <em>Politico<\/em>, that what he \u201cdidn\u2019t want was for jurors to hear Mr. Trump\u2019s voice.\u201d<\/p>\n<p>The judge also ruled that prosecutors cannot use footage from a videotaped deposition Trump gave during the lawsuit against him by E. Jean Carroll, a writer who accused the former president of sexual assault. Merchan said introducing that evidence from the Carroll case would be \u201cbuilding in a trial into a trial,\u201d according to CNN.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>Merchan\u2019s decisions regarding permissible evidence came ahead of what is expected to be days, or possibly weeks, of jury selection before parties can begin presenting their cases.<\/p>\n<p>Bragg, an elected Democrat, has charged Trump with 34 counts of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/rep-jordan-subpoenas-former-manhattan-prosecutor-who-pushed-for-trump-indictment\/\" title=\"Rep.
