Trump\u2019s: Here\u2019s How They Stack Up\">curb illegal border crossings<\/a> on the southern <a href=\"https:\/\/washingtonexaminer.com\/tag\/border\/\" target=\"_blank\" rel=\"noopener\" title=\"border\">border<\/a> in the coming weeks. <\/p>\n<p>A more muscular step by the president has been considered for months, but multiple roadblocks have prevented Biden from issuing one. Republicans have made the border a top subject in 2024, and Biden has been trying to find the right way to address it. <\/p>\n<p>While illegal border crossings dropped in January and have remained relatively low compared to the rest of his tenure, Biden is looking for solutions within his powers. However, relying on the same executive power that then-President Donald Trump pointed to as a way to issue his \u201cMuslim ban\u201d has several problems, both politically and legally.<\/p>\n<h2>Court conundrum<\/h2>\n<p>If Biden issues an executive order, he will be relying on federal code Section 212(f), which gives the president the authority to limit foreigners from entering the country if their crossings are deemed \u201cdetrimental\u201d to U.S. interests. Trump unsuccessfully used that section to try and ban asylum-seekers from several Muslim-majority countries from entering the United States. <\/p>\n<p>\u201cWe\u2019re examining whether or not I have that power,\u201d Biden <a href=\"https:\/\/www.axios.com\/2024\/04\/10\/biden-border-executive-order-immigrants-asylum-limit\" target=\"_blank\" rel=\"noopener\" title>said<\/a> in a recent interview with Univision. <\/p>\n<p>\u201cSome are suggesting that I should just go ahead and try it,\u201d Biden continued. \u201cAnd if I get shut down by the court, I get shut down by the court.\u201d<\/p>\n<p>Homeland Security Secretary Alejandro Mayorkas, whose impeachment trial in the Senate for his alleged dereliction of duty related to the southern border could take place this week, said the administration frequently discusses solutions to the border but is unclear what would stand in courts.  <\/p>\n<p>Entering the U.S. from anywhere other than legal entry points is already illegal. Biden has used his executive order powers to reject asylum-seekers automatically who cross illegally. <\/p>\n<h2>Congress\u2019s cash<\/h2>\n<p>Any action Biden takes to direct more enforcement at the southern border will need cooperation from Congress and its control of the country\u2019s coffers.<\/p>\n<p>After months of negotiations, Congress blocked a piece of bipartisan border legislation following opposition from Trump.<\/p>\n<p>However powerful an executive order is, it is missing money behind it, something only Congress can grant to find tangible solutions, such as hiring more Customs and Border Protection officers. The bipartisan border bill would have <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2024\/02\/29\/fact-sheet-impact-of-bipartisan-border-agreement-funding-on-border-operations\/#:~:text=The%20bipartisan%20Senate%20bill%20would,officers%20to%20do%20initial%20screenings.\" target=\"_blank\" rel=\"noopener\" title>added<\/a> 1,500 more agents.<\/p>\n<p>\u201cThe administration spent months negotiating in good faith to deliver the toughest and fairest bipartisan border security bill in decades because we need Congress to make <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fact-checkers-posts-without-government-talking-points-are-missing-context\/\" title=\"Fact Checkers: Posts Without Government Talking Points Are Missing Context\">significant policy reforms<\/a> and to provide additional funding to secure our border and fix our broken immigration system,\u201d White House spokesman Angelo Fernandez Hernandez <a href=\"https:\/\/www.politico.com\/news\/2024\/02\/23\/progressive-groups-biden-immigration-00142957#:~:text=Exclusive-,Progressive%20groups%20preemptively%20rip%20Biden%20over%20immigration%20executive%20actions,%2C%20echo%20%E2%80%9Cextremist%E2%80%9D%20tactics.\" target=\"_blank\" rel=\"noopener\" title>said<\/a>. <\/p>\n<p>\u201cNo executive action, no matter how aggressive, can deliver the significant policy reforms and additional resources Congress can provide and that Republicans rejected,\u201d he said.<\/p>\n<p>\u201cWe cannot give ourselves resources,\u201d Mayorkas said.<\/p>\n<h2>Biden\u2019s base<\/h2>\n<p>Biden also faces the threat of his Democratic base moving away from him ahead of the election. The 2024 general election is expected to be narrow and will be tricky for Biden if he cannot count on the most left-leaning members of his base for a vote.<\/p>\n<p>In February, a <a href=\"https:\/\/www.politico.com\/news\/2024\/02\/23\/progressive-groups-biden-immigration-00142957#:~:text=Exclusive-,Progressive%20groups%20preemptively%20rip%20Biden%20over%20immigration%20executive%20actions,%2C%20echo%20%E2%80%9Cextremist%E2%80%9D%20tactics.\" target=\"_blank\" rel=\"noopener\" title>group of progressives<\/a> composed of more than 150 international, national, state, local, and faith-based entities warned Biden of taking on the approach from the Trump administration on border policies.<\/p>\n<p>\u201cWe urge you to heed our warning: This tired approach failed under the past administration, will fail and cause great harm again, and will tarnish your administration irreparably,\u201d the groups said in the letter organized by the National Immigrant Justice Center and Human Rights First.<\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>\u201cOn your first day in office, you rightly rescinded a number of abhorrent signature policies of your predecessor.
