With 464,922 encountered by Customs and Border Protection, this unprecedented increase began after halting returns\u200d to Mexico, \u2063leading\u200d to \u2063ongoing challenges in handling the \u2064influx. The central role\u200c of U.S. policies \u200dand external factors in driving this migration trend continues to be a topic of debate and concern.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Nearly half a million immigrant children have arrived without a parent at the nation\u2019s borders during President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noopener\" title=\"Joe Biden\">Joe Biden<\/a>\u2018s tenure, a milestone no other administration has come close to hitting.<\/p>\n<p>In the three years since Biden took office and stopped returning to Mexico <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/unaccompanied-minors\" target=\"_blank\" rel=\"noopener\" title>unaccompanied minors<\/a>, a whopping 464,922 <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/children\" target=\"_blank\" rel=\"noopener\" title>children<\/a> have been encountered by U.S. <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/customs-and-border-protection\" target=\"_blank\" rel=\"noopener\" title>Customs and Border Protection<\/a> police nationwide, according to a <em>Washington Examiner<\/em> analysis of federal data from Feb. 1, 2021, through Jan. 31, 2024.<\/p>\n<p>\u201cThe increase started when the Biden administration announced they were exempting children from Title 42 and announced that we would not be removing children,\u201d said Rodney Scott, the former Border Patrol chief under the Trump and Biden administrations who is a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cnn-ripped-for-bizarre-distortion-of-clarence-thomas-dissent-in-pa-election-case\/\" title=\"CNN Ripped For \u2018Bizarre Distortion\u2019 Of Clarence Thomas Dissent In PA Election Case\">distinguished senior fellow<\/a> for border security at the Texas Public Policy Foundation, a conservative think tank in Austin.<\/p>\n<figure><\/figure>\n<p>A leading aid organization for child immigrants, Kids in Need of Defense, said the sudden implosion of children and teenagers crossing the southern border alone over the past several years was fully anticipated because they were barred from seeking asylum as a result of U.S. measures implemented at the border during the coronavirus pandemic.<\/p>\n<p>\u201cThere had basically been a backup at the border. \u2026 It was like releasing a pressure valve. So all these kids who have been waiting in really terrible conditions in northern Mexico were finally able to present for protection,\u201d said Jennifer Podkul, KIND\u2019s vice president for policy and advocacy. \u201cPeople working on this issue were not surprised at all.\u201d<\/p>\n<p>But that influx of minors in early 2021 has not gone away in three years \u2014 it\u2019s become the new normal.<\/p>\n<figure><figcaption>Customs and Border Protection staff look on as a person carries a young child through razor wire in Eagle Pass, Texas, on Sept. 25, 2023. (Photo by ANDREW CABALLERO-REYNOLDS\/AFP via Getty Images)<\/figcaption><\/figure>\n<h2>A history of child migration <\/h2>\n<p>Children did not begin migrating to the United States in a significant fashion until a decade ago following changes to U.S. law.<\/p>\n<p>In 2008, the William Wilberforce Trafficking Victims Protection Reauthorization Act declared that unaccompanied children from Canada and Mexico who arrived at the border would be immediately returned, but children from other countries would be taken into custody as possible trafficking victims.<\/p>\n<p>For cartels, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/blackburn-cartels-traffickers-exploiting-unfinished-border-wall-construction\/\" title=\"Blackburn: Cartels, Traffickers Exploiting Unfinished Border Wall Construction\">transnational criminal organizations<\/a> that profit thousands of dollars per person they smuggle into the U.S., it was a money-making opportunity because it meant a new population of people who would likely not be turned away at the border could pay to be smuggled in.<\/p>\n<p>In the summer of 2014, the Obama administration experienced the first surge. In fiscal 2014, Border Patrol apprehended <a href=\"https:\/\/www.washingtonexaminer.com\/news\/1321130\/biden-administration-has-14000-migrant-children-without-parents-in-its-custody\/\" target=\"_blank\" rel=\"noopener\" title>68,000<\/a> solo children. That figure was record-breaking at the time and then dissipated, but it spiked during the Trump administration when <a href=\"https:\/\/www.washingtonexaminer.com\/news\/1321130\/biden-administration-has-14000-migrant-children-without-parents-in-its-custody\/\" target=\"_blank\" rel=\"noopener\" title>80,000<\/a> children arrived in 2019. It dropped as the pandemic began in early 2020.<\/p>\n<figure>\n<div>\n<blockquote data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">\ud83d\udea8Heartbreaking News Alert: Rio Grande City Border Partol Agents find a 2-month-old child left abandoned at the border! Chavez (@USBPChiefRGV) <a href=\"https:\/\/twitter.com\/USBPChiefRGV\/status\/1706659403590476066?ref_src=twsrc%5Etfw\">September 26, 2023<\/a><\/p><\/blockquote><\/div>\n<\/figure>\n<h2>The Biden effect<\/h2>\n<p>As White House administrations shifted from Trump to Biden in early 2021, border policies changed, and travel restrictions were lifted in some places. Migration subsequently increased around the world, including among children heading to the U.S.<\/p>\n<p>In February 2021, the Biden administration <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2613091\/biden-administration-stops-border-officials-from-expelling-unaccompanied-children-despite-court-allowing-it\/\" target=\"_blank\" rel=\"noopener\" title>chose<\/a> to stop returning children to Mexico, as had been the case since March 2020. Within weeks, children began arriving by the hundreds per day.<\/p>\n<p>In 2021, Border Patrol apprehended 144,000 children, federal <a href=\"https:\/\/www.cbp.gov\/newsroom\/stats\/nationwide-encounters\" target=\"_blank\" rel=\"noopener\" title>data<\/a> show. In 2022, 149,000 children arrived alone.<\/p>\n<p>In 2023, the number dropped to 131,000, and it is on track to hit 125,000 by the end of fiscal 2024 in September.<\/p>\n<p>Roughly 95% of the 464,922 total children crossed the southern border illegally, compared to 5% who made the journey and surrendered to customs officers at ports of entry. <\/p>\n<figure><figcaption>A U.S. Border Patrol agent helps a small migrant child who crossed the Rio Grande from Mexico to the U.S. with a group on Friday, Sept. 22, 2023, in Eagle Pass, Texas.<\/figcaption><\/figure>\n<h2>Why are children coming at alarmingly high rates?<\/h2>\n<p>A 2023 report by the Council on Foreign Relations identified environmental challenges, chronic violence, and a lack of economic opportunity as top factors that prompt Central American residents to flee. <\/p>\n<p>\u201cMost others have historically come from Mexico, where the homicide rate is at near-record levels amid a long-standing war against drug cartels. Perceptions that Biden is more welcoming than his predecessor have also driven migration, some observers say,\u201d the Council on Foreign Relations researchers Diana Roy and Amelia Cheatham wrote in the <a href=\"https:\/\/www.cfr.org\/backgrounder\/us-detention-child-migrants#:~:text=Under%2520U.S.%2520law%252C%2520unaccompanied%2520aliennecessarily%2520enter%2520the%2520country%2520alone.%202023\" target=\"_blank\" rel=\"noopener\" title>report<\/a>.<\/p>\n<p>Ron Vitiello, a former CBP senior official who ran on the Republican ticket for Senate in Virginia this cycle, <a href=\"https:\/\/www.washingtonexaminer.com\/border-security-experts-the-wall-isnt-enough-legal-loopholes-must-be-closed\" target=\"_blank\" rel=\"noopener\" title>said<\/a> during a 2018 press conference that legal loopholes, such as those in the <a href=\"https:\/\/www.congress.gov\/bill\/110th-congress\/house-bill\/7311\" target=\"_blank\" rel=\"noopener\" title=\"trafficking victims law,\">trafficking victims law<\/a>, were not protecting children immigrants but enabling and enticing them. <\/p>\n<p>\u201cIf you come as a family unit or an unaccompanied minor, the way the policy loopholes and the legal framework is set up [is so] that we turn these folks over,\u201d Vitiello said. \u201cThey\u2019re eventually released into our communities, and so that encourages others to come.\u201d<\/p>\n<h2>Are they smuggled or trafficked?<\/h2>\n<p>Not all children who go to the border alone come of their own volition.<\/p>\n<p>\u201cThe total population of unaccompanied and accompanied children includes both just traditional, smuggled aliens, as well as trafficking,\u201d Scott said in reference to children who may owe smugglers thousands of dollars for getting them to the U.S.<\/p>\n<p>\u201cThe alien does not realize yet that they\u2019re being trafficked, and we\u2019re not doing good interviews,\u201d Scott said. \u201cIt\u2019s extremely difficult to detect trafficking at the border.\u201d<\/p>\n<p>Podkul works extensively with children and recently traveled near the Darien Gap, a massive jungle that connects Panama and Colombia that immigrants must pass through to get from South America to Central America on their journey north.<\/p>\n<figure><figcaption>According to a Border Patrol union official, drug cartels bring unaccompanied children to the Rio Grande Valley to serve as diversions that distract border security officials from smugglers and drug traffickers. (AP Photo\/Eduardo Verdugo)<\/figcaption><\/figure>\n<p>First, some travel with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/massachusetts-history-class-forced-students-to-comment-on-how-systemic-racism-impacted-george-floyd\/\" title=\"Massachusetts History Class Forced Students To Comment On How \u2018Systemic Racism\u2019 Impacted George Floyd\">extended family members<\/a>, such as an uncle or cousin, or family friends. However, under U.S. law, that adult is not legally the child\u2019s guardian or parent, making the child an \u201cunaccompanied minor.\u201d<\/p>\n<p>Second, children may start out traveling with a parent but get separated for reasons out of their control, including smugglers who \u201cdivvy up families\u201d as they put people on buses or through stretches of the Darien Gap.<\/p>\n<p>\u201cThere\u2019s kids who are fleeing abuse at home. So they\u2019re fleeing an abusive parent, and that\u2019s why they\u2019re deciding to come and make the journey, or other dangers at home,\u201d Podkul said.<\/p>\n<p>Finally, children from Central America, in particular, may choose to leave their families before getting to the age when gangs, such as MS-13, will recruit them, often against their will and through deadly retribution if they refuse.<\/p>\n<p>\u201cThey\u2019re leaving to protect their younger siblings or their parents who they know the gangs will start going after the family members to pressure the kid,\u201d Podkul said. \u201cIt\u2019s kind of a benevolent act of the kid to protect their family.\u201d<\/p>\n<figure><figcaption>In this March 30, 2021, photo, minors are inside a pod at the Donna Department of Homeland Security holding facility, the main detention center for unaccompanied children in the Rio Grande Valley run by U.S. Customs and Border Protection, in Donna, Texas. (AP Photo\/Dario Lopez-Mills)<\/figcaption><\/figure>\n<h2>Who are these children?<\/h2>\n<p>In 2023, slightly more than two-thirds of unaccompanied minors were between the ages of 15 and 17, according to Department of Health and Human Services <a href=\"https:\/\/www.acf.hhs.gov\/orr\/about\/ucs\/facts-and-data\" target=\"_blank\" rel=\"noopener\" title>data<\/a>. Of the remaining, children were between the ages of 0 and 12, 19%, or 13 and 14 years old, 12%.<\/p>\n<p>The percentage of children arriving at the border from countries other than Mexico, Guatemala, Honduras, and El Salvador has gone from less than 5% a decade ago to 13% last year. Three out of five child immigrants were boys.<\/p>\n<p>\u201cChina, Afghanistan, India, Uzbekistan \u2014 the numbers of countries and nationalities who are coming through is increasing,\u201d Podkul said in a general comment about who is transiting the Darien Gap area.<\/p>\n<p>Children remained in government custody for an average of a month before being released into the U.S., according to federal data.<\/p>\n<h2>What happens when a child crosses the border?<\/h2>\n<p>Under normal circumstances, children without parents are taken into Border Patrol custody after they walk across the border and are to be transferred within 72 hours to HHS, which has jurisdiction over caring for children.<\/p>\n<p>But the influx of children prompted the Biden administration to take emergency action responding to the arrivals and has continued to despite Republicans\u2019 calls to deter more children from coming. Biden <a href=\"https:\/\/www.washingtonexaminer.com\/news\/1322554\/biden-to-house-hundreds-of-migrants-in-tents-on-texas-border\/\" target=\"_blank\" rel=\"noopener\" title>created<\/a> tent cities at various spots up and down the border where unaccompanied children could be housed,<a href=\"https:\/\/www.acf.hhs.gov\/orr\/fact-sheet\/programs\/uc\/influx-care-facilities-fact-sheet\" target=\"_blank\" rel=\"noopener\" title> including in<\/a> Texas cities El Paso, Carrizo Springs, and Pecos. <\/p>\n<figure><figcaption>U.S. Customs and Border Protection<\/figcaption><\/figure>\n<p>HHS would detain each child before releasing the child to a sponsor in the U.S. Children often arrived at the border clutching a paper with a phone number on it.<\/p>\n<p>HHS was referred 118,938 children in 2023, most of whom passed through its pop-up tents before being released.<\/p>\n<p>\u201cWe really need to focus more on what\u2019s pushing kids and how do we address that?\u201d Podkul said. \u201cJust because we have a law that might be protective law or something that\u2019s some sort of magnet, that\u2019s not going to outweigh the risks that these kids absolutely know that they\u2019re taking by making this journey.\u201d<\/p>\n<h2>Where does that child go from the border?<\/h2>\n<p>Under the Biden administration, HHS releases data every weekday on the number of unaccompanied minors who were apprehended at the border the previous day and transferred from Border Patrol into HHS custody.<\/p>\n<p>\u201cAs soon as children enter [Office of Refugee Resettlement] care, they are put in contact with their parents, guardians, or relatives, if known, and the process of finding a suitable sponsor begins. Most sponsors are a parent or a close family relative living in the United States,\u201d HHS said in a statement. \u201cWhile ORR programs are looking for sponsors, children are provided age-appropriate care and wraparound services in one of the 289 facilities and programs in 29 states funded by ORR.\u201d<\/p>\n<figure>\n<div>\n<blockquote data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">2\/28: This morning, <a href=\"https:\/\/twitter.com\/TxDPS?ref_src=twsrc%5Etfw\">@TxDPS<\/a> Troopers recovered 5 unaccompanied children in Eagle Pass. If a family member cannot be found, an unrelated adult will receive the child. <\/p>\n<p>HHS conducts criminal public records checks on the specific sponsor, though a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/children-at-risk-department-of-energy-did-not-properly-vet-whether-hired-childcare-workers-were-sex-offenders-criminals\/\" title=\"\u2018Children At Risk\u2019: Department Of Energy Did Not Properly Vet Whether Hired Childcare Workers Were Sex Offenders, Criminals\">sex offender registry check<\/a> is not required by law.<\/p>\n<p>The child may remain in the U.S. through immigration court proceedings for illegally entering at the border. Cases can take a couple of years to a decade to resolve.<\/p>\n<h2>Where does it go from here?<\/h2>\n<p>Of the more than 464,000 children who arrived at the border alone under Biden, HHS has discharged 391,000 children into the country between 2021 and January 2024. Fiscal 2021 began shortly before the November 2020 election while Donald Trump was in office.<\/p>\n<p>The <em>New York Times<\/em> <a href=\"https:\/\/www.washingtonexaminer.com\/?p=27358\" target=\"_blank\" rel=\"noopener\" title>reported<\/a> last spring that HHS had attempted to follow up with children after they were released to sponsors but could not reach 85,000 sponsors.<\/p>\n<p>Last May, 75 House Republicans <a href=\"https:\/\/www.washingtonexaminer.com\/?p=27358\" target=\"_blank\" rel=\"noopener\" title>accused<\/a> Biden officials of knowingly and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/republicans-demand-answers-after-biden-administration-loses-track-of-85000-migrant-children\/\" title=\"GOP seeks explanation as Biden admin loses 85K migrant kids.\">recklessly discharging unaccompanied children<\/a> to adults across the country and doing nothing to find the children.<\/p>\n<p>The letter referenced reports by the <em>New York Times<\/em> that <a href=\"https:\/\/www.washingtonexaminer.com\/policy\/immigration\/thousands-migrants-surge-across-border-brownsville-texas\" target=\"_blank\" rel=\"noopener\" title>found<\/a> children were being extorted by smugglers to pay off the thousands of dollars they owed.
